HomeMy WebLinkAboutResolutions 85-375 N.C.S. 12/16/1985~esolutl~ll No. 85-375 N C.S. ofi the City of Petaluma, California RESOLUTION CONDITIONALLY UPHOLDING APPEAL OF SPARC CONDITIONS OF APPROVAL TO INDUSTRIAL/OFFICE BUILDING FOR CHRISTEN5EN/COATES (AP #005-050-22) WHEREAS, Christensen/Coates, general contractors, applied to the Site Plan and Architectural Review Committee (SPARC) on September 23, 1985 for approval of an industrial/office building at the southwestern corner of Lakeville Highway and Casa Grande Road, Sonoma County Assessor's Parcel No. 005-050-22, pursuant to the requirements of Zoning Ordinance Section Z6-401; and WHEREAS, on October 24, 1985, SPARC reviewed this project during a public meeting at which time all public input was heard and considered prior to SPARC rendering its decision; and WHEREAS, staff had recommended approval of this application subject to 21 conditions, four of which were recommended by staff toward fulfilling the requirements of the California Environmental Quality Act (CEQA) ; and WHEREAS, in addition to fifteen other conditions, SPARC adopted said four CEQA conditions recommended by staff on October 24, 1985, and WHEREAS, Christensen/Coates appealed the following three of those four SPARC conditions on November 1, 1985 to the City Council: a. Lakeville Highway and Casa Grande Road shall be widened and improved (including curbs, gutters, sidewalks, bus pullouts, and necessary drainage improvements) to the satisfaction of the City Engineer and in conformance to the adopted Lakeville Plan Line Study. This includes the entire frontage along Lakeville Highway, i.e. including area along Lakeville Mini-Storage. b. The applicant shall pay a pro rata share towards the signalization of Casa Grande Road and Lakeville Highway as determined by the City Engineer . c. Contribution for sound wall construction shall be made prior to issuance of building permit, proportionate share formula to be developed by staff with approval by City Council; and WHEREAS, the Council held a public hearing on this matter on November 18, 1985 at which time any interested persons were invited to speak on this matter; and WHEREAS, all public testimony was considered by the Council prior to a decision being rendered; k~s. na. 85-37.5............ N.cs. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby upholds the appeal of Christensen/Coates based on the following findings: l. The proposed industrial/office building, as conditionally approved, will not degrade the quality of the environment. 2. The project will not achieve short-term goals to the disadvantage of long term goals because the expected delay in Lakeville Highway frontage improvements and sound wall construction is not significant. 3. The project does not have impacts which are individually limited but cumulatively considerable because of the conditions of approval. 4. All other uncontested SPARC conditions shall remain in effect. 5. The revised conditions of approval, setforth below, are consistent with previous approvals and development patterns on this parcel. 6. It is the City's intent to swiftly pursue and form an assessment district for the improvement of Lakeville Highway pursuant to the adopted Plan Line Study. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Petaluma hereby amends the three contested conditions of approval to read as follows : 1, The applicant shall participate in an assessment district to improve the parcels' frontage along Lakeville Highway, provide a traffic signal at Casa Grande/Lakeville intersection, and to construct a soundwall pursuant to the adopted Lakeville Highway Plan Line Study . 2. Casa Grande Road shall be improved concurrent with building construction as required by the City Engineer. 3. A$15,000.00 contribution towards sound wall design shall be made within 30 days from date of this resolution which will be credited towards the project site's contribution in the assessment district. If no assessment district is formed within two years of payment, the contribution shall be refunded. Under the power and authority conferred upon this Council by the Charter of said City.
