ASSESSMENT DISTRICT AND AUTHORIZING LEVY AND COLLECTION OF ASSESSMENTS PURSUAN,T TO ~ ~ ~ LANDSCAPING AND LIGHTING ACT OF 1972 CASA DEL ORO LANDSCAPING AS;SESS'MENT DISTRICT WHEREAS, a petitiori and consent for the formation of territory into a landscaping assessment ai_strict and to the levy. and collection. of assessments therein pur,suant to the; _Lan:dscaping and Lighting Act of 1972 signed, by all of _. the owners of land as sh'ow•n on ~the last egualized County Assessment Roll; or '' entitled to be shown as owners on `the next County Assessment Roll, or where any of said property 'is subject to a recorded written agreement of sale, are shown .therein as purchaser, of all of the territory more particularly hereinafter described was filed with the City Clerk of said City; pursuant to the Landscaping and Lighting Act of 1972 ("Act" ), Uivision 15, Part 2(commencing with §22500) of the Streets and Highways Code of the State of California and especially §2260.8.1 thereof; WHEREAS, said petition and consent consented. to said Council's conduct of said proceedings without notice and hearing and without the filing of an Engineer's Report all in accordance with said -Act and especially said §22608.1 thereof; and, WHEREAS, proof satisfactory to this Council qf such consent by all of said owners of property within said territory has been filed with the Clerk of the ,~ City : // ~~ r~:~-: z:~, 85-392 1 ~~~~~~~~~ BE IT RESOLVED by the Council of the City of Petaluma, County of Sonoma as follows : 1. Said petition and consent for the formation of territory into a landscaping assessment district and to the levy and collection of assessments therein pursuant to the Landscaping and Lighting Act of 1972 was signed by all of the owners of land as shown on the last equalized County Assessment Roll, or entitled to be shown as owners on the next County Assessment Roll, or where any of said property is subject to a recorded written agreement of sale, are shown therein as purchaser. 2. The description of the exterior boundaries of the territory proposed to be formed into a landscaping assessment district is more particularly described on Exhibit "A" hereto attached and by reference made a part hereof . 3. The formation of said territory into a landscaping assessment district and the authority of this Council to levy and collect assessments therein pursuant to said Act is hereby approved without notice and hearing and without the filing of an Engineer's Report pursuant to §22608.1 of said Act. 4. Said territory be, and it is hereby, ordered formed into a landscaping assessment district for the installation or construction of improvements and the maintenance or servicing, or both, thereof together with any and all incidental expenses in connection therewith all as more particularly authorized pursuant to said Act, and shall hereafter by designated as "Casa del Oro Landscaping Assessment District" , by which name it shall hereafter be referred to in all subsequent proceedings, including proceedings for the levy and collection of assessments. ccreso/85-392 Reso. 85-392 NCS 2 ~ •, ~ as~7~~J7 5. Proceedings shall be taken by this Council pursuant to said Act for any fiscal year during which an assessment is to be levied and collected within said tiistrict. 6. The Clerk of this City is authorized~ and directed to file a certified copy of this resolution to.gether with a map of said District with the County Auditor of Sonoma County.
