RESOLUTION UPHQLDIN.G APPEAL ALLOWING ACGESSORY DWELLING
AT 337 PLEASANT STREET (BERMAN, AP ND. 006-241-40)
WHEREAS, Charles Berman applied for a use. . permit allowing an accessory
dwelling in his residence located at 337 Pleasant Street, and
WHEREAS, the Planning Commission held a public hearing and considered
public input on July 23, 1985, prior to denying said- application, and
WHEREAS, Charles Berman appealed the Planning Commission denial on July
30, 1985, and .
~VHEREAS, the City Council held a public hearing on said appeal, and
WHEREAS, input solicited by the Planning Commission as well as additional
information presented at the C.ouncil public hearing was considered prior to
Council decision on this matter, and
WHEREAS, City staff had recommended approval of said application.
NOW , THEREFORE BE IT RESOLVED that the " Gity . Council of the City of
Petaluma hereby upholds the appeal of Planning Commission denial of a use
permit for a 49'5 square foot accessory dwelling ¢ontaining a living room,
one bedroom, bath and closets subject to the following findings.
1. The accessory dwelling conforms with the regulations of the zoning
ordinance .
2. The accessory dwelling prov'ides an alternate housing source without
disrupt'ion .to an established neighborhood and, therefore, conforms to
the policies of the General Plan and EDP ,
. 3. The aceessory dwelling at this time, an,d under :the circumstances of
'. this particular case;, does not constitute a nuisance and is not
detrimental to the public welfare of the commuriity .
NOW, THEREFORE BE IT FURTHER RESOLVED that this use permit is
approved subject to the following conditions:
1. Building permits shall be obtained and City~ inspections conducted for
all illegal improvements done as required by the Chief Building
Inspector.
2. The acces;sory dw.elling may not be enlar.ged beyond its current 495
sq. ft. size without a new use permit. . ~
3. This permit expires when any one of the following events occur:
- a. Sale -or other transfer. of tfie subject parcel by. appl'icant: ~-.

Applicant no longer maintains this residence as his principal
residence.
c. When the necessity of live~-in,child car.e ceases.
d. In four years f.r,om the date of this resolution, unless the
applicant can ~:prove ~ to ~.the satisfaction of' the Director of
Community . De~elopment that the use 'of.- the accessory dwellin~g~ is
necessary for: the. continued care of :his ~son., ~
4. The applicant shall immediately execute ;and :record with the Sonoma
County Recorder's Office the agreement. . attached hereto and marked
Exhibit A and incorporated herein by reference.
5. Applicant shall remove the kitchen ~facility 'in t'he'. accessory dwelling
upon the occurrence ~~of an.y of the> conditioris set forth in paragraph 3
above.
