A RESOLUTION APPROVING REVISIONS TO THE
UNIT DEVELOPMENT PLAN FOR CREEKVIEW COMMONS
SUBDIVISION LOCATED ON MONROE STREET (FUTURE)
AT ELY BLVD. NORTH
WHEREAS, by Ordinance No. 1493 N. C. S. , Creekview Commons Subdivision
was rezoned to Planned Unit Development and,
WHEREAS, by action taken on September 24, 1985, the Planning Commission
recommended conditional adoption of a revised final unit development plan
for said subdivision to incorporate/revise development standards.
NOW, THEREFORE, BE IT RE50LVED that the unit development plan
previously approved for the project by City Council Resolution No. 9314
N. C. S. is hereby amended to permit revision to development plan as
described in the Planning Commission minutes of September 24, 1985;
BE IT FURTHER RESOLVED that the City Council hereby adopts the
findings of the Planning Commission as its findings as set out hereinafter:
Finding s :
1. Said amendment to the plan clearly results in a more desirable use of
land and a better physical environment than would be possible under
the original development plan.
Z. The PUD District, as originally developed with no change proposed,
has a suitable relationship to one (1) or more thoroughfares; and no
additional traffic is anticipated as a result of the proposed amendment.
3. The plan amendment continues to present a unified and organized
arrangement of buildings and service facilities which are appropriate in
relation to adjacent properties, and adequate landscaping is proposed
to insure compatibility.

4. The natural and scenic qualities of the site are protected with
adequate available public and private spaces designated on the unit
development plan, and no change is proposed.
5. The development of the subject property, in the manner as proposed
to be amended by the applicant, will not be detrimental to the public
welfare, will be in the best interests of the City and will be in
keeping with the general intent and spirit of the zoning regulation of
the City of Petaluma, and the Petaluma General Plan, and with the
Environmental Design Plan.
BE IT FURTHER RESOLVED that the City Council hereby approves the
revised unit development plan subject to the conditions of approval set out
hereinafter .

Previously Approved Conditions :
1. Architectural and landscape plans shall be subject to review and
approval by the Site Plan and Architectural Review Committee prior to
Final Map approval. Plan review shall consist of at least the following
items: building design, materials and colors; landscape design,
location, variety and size; fencing, signs, pedestrian paths, street
furniture, trash enclosures, mechanical equipment and outdoor lighting
design; and recreation area design.
2. T'he conditions, covenants and restrictions (CC & K's) for the
development shall be subject to approval by the City Attorney prior to
Final Map approval. Included in the CC & R's shall be a permanent
restriction to prohibit the on-site storage of recreational vehicles,
boats, and trailers. This restriction shall apply anywhere within this
planned unit development (P. U. D.) Zone .

3. Interior noise levels from exterior sources shall not exceed 40 dba in
bedrooms and 45 dba in other habitable rooms.
4. Housing units served by driveways less than twenty (20) feet in
length shall be provided with remote control garage door openers to
prevent vehicular congestion in the private street system.
5. The landscape plan shall provide for the planting of native plant
material along Lynch Creek, subject to approval by the Site Plan and
Architectural Review Committee, and by the State Fish and Game
Department.
6. Home occupations shall not be allowed, per the adopted CC & R's.
7. Exterior alterations to structures or fences shall not be permitted
without prior consideration and approval of the Homeowners
Architectural Committee, as required by the CC & R's, and by SPARC.
8. Garage conversions are prohibited, as set forth within the CC & R's.
9. Any other questions concerning land use regulation shall be governed
by the City Zoning Ordinance as long as it does not expressly conflict
with the project CC & R's or the adopted PUU unit development plan.
Recommended Additional Conditions :
10. The applicant shall provide for perpetual maintenance of all
landscaping, pathways and other improvements in Common Area "B" ,
subject to approval by staff . Perpetual maintenance may be
accommodated through a maintenance assessment district, the form ation
of which must be ratified by the City Council prior to final map
revision approval.
11. The proposed sound wall along Ely Blvd. frontage shall wrap along the
creek setback line to the estimated 55 Ldn contour line to insure

adequate protection for Building #10, subject to staff review and
approval.
12. Developer shall build a 6' heavy timber, solid fence along the project's
south boundary (south line of Monroe Street and Common Area "B" )
along the rear yards of the residences facing Wynoochee Way, design
subject to review and approval of staff prior to construction.
Developer shall be given credit for materials and labor cost of said
fence against Community Facilities Development Fees generated from the
Creekview Commons project.
13. The project sponsor shall be required to pay low and moderate income
housing in-lieu fees of an amount to be determined according to the
schedule established by City Council Resolution No. 84-199 N. C. S. , or
make alternative arrangements to meet the low and moderate income
housing provision requirements of the Housing Element subject to
approval of the City and prior to approval of the Final Map revision.
14. All public improvements shall be completed in conjunction with Phase I
construction .
BE IT FURTHER RESOLVED that the City Council finds that the
requirements of the California Environmental Quality Act Guidelines have
been met and hereby incorporates by reference the previously prepared
environmental documentation for the project.
