A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PETALUMA APPROVING AND AUTHORIZING THE MAYOR OR
CITY MANAGER TO EXECUTE A JOINT EXERCISE OF POWERS
AGREEMENT
BE IT RESOLVED BY THE City Counci.I of the City, California, that
WHEREAS, pursuant to the provisions of Article 1(commencing with
Section 6500) of Chapter 5 of Division 7 of Title 1 of the Government Code
of the State of California, two or more publ-ie entities may enter into a joint
exercise of powers agreement to carry out the powers common to each
entity;
WHEREAS, the City of Petaluma and other public entities are each
empowered by Part 5(commencing with Section 52000) of Division 31 of the
Health and Safety Code of the State of California (the "Act" ) to issue
revenue bonds for the purpose of financing the construction, acquisition
and rehabilitation of homes for the benefit of the residents thereof;
WHEREAS, under the Costa-Marks Housing Bond Allocation Act of 1981
and the Mortgage Subsidy Bond Act of 1980, capacity to issue such bonds
will be allocated to the City of Petaluma by the R+fortgage Bond Allocation
Committee, created by the Costa-Marks Housing Bond Allocation Act of
1981, and such capacity may be assigned to an authority created by such a
joint powers agreement; and ~
WHEREAS, this City Council has found and determined, and hereby
finds and determines, that it is in the best interests of Petaluma that
Petaluma enter into a joint exercise of powers agreement with another public
entity to exercise their respective powers pursuant to the Act and for the
, Authority to procee'd pursuant to the Act .for the purpose . of financing home
~. mortgages with respect to property within the boundaries of the parties to
• the agreement. .
NOW, THEREFORE, IT .IS ORD'ERED as follows; ~
1. The recitals her.ein contained are true and correct, and this City
Council so firids.
2. The form of agreement, to be determined. The City Council
hereby authorizes the Mayor or City~ Manager .to review alI terms and
conditions and if~ found to be equita6le to. execute ~ said agreement. The
City Glerk is directed to file a copy of _ said form of ~ agreement in the office
of the City Clerk., the Mayor and the City Manager are authorized and
directed to execute and the City Clerk .is authorized and directed to attest•
their signatures,: affix the corporate seal and to ,:deli:ver an agreement in
substantially said form with such additions th'ereto or changes therein as
such officers may require= or approve, such approval to be conclusively
evidenced by' the `execution~ and delivery thereof.

3. The City Council authorizes the Mayor or City Manager to assign
its allocation of qualified mortgage bonds made to :it by the A~lortgage Bond
Allocation C'omrnit'tee to the Joint Powers Authority.-
4. This Resolution shall take effect immediately upon adoption.
