HomeMy WebLinkAboutResolution 2002-191 N.C.S. 12/02/2002Resolution No. 2002-19~ N.C.S. of the City of Petaluma, California SETTING WATER RATES AND CHARGES WHEREAS, the Petaluma Municipal Code Title 15 provides for the establishment and operation of a water system and the charging of certain fees and charges; and, WHEREAS, Chapter 15.16 provides the setting of certain fees and charges by resolution; and, WHEREAS, Resolution 2001-122 N.C.S. set various fees and charges currently in effect; and, WHEREAS, the City of Petaluma operates and maintains a potable water system; and, WHEREAS, the report Water, Wastewater, and Storm Drainage Rate Study (September 2002) (herein after referred to as "Rate Study") presents a comprehensive analysis of the water resource utility's rate structure; and, WHEREAS, the City Council discussed and considered the Rate Study on October 7, 2002; and, WHEREAS, the City Council conducted a public meeting on the proposed rates on October 7, 2002, and heard and considered public comment on the proposed rates and fees at -a public hearing on December 2, 2002; and, WHEREAS, the Rate Study is hereby incorporated by reference in this Resolution in its entirety as if fully written out herein. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Petaluma repeals Resolution No. 2001-122 N.C.S. and hereby sets the following fees and charges: Resolution No. Zpp2_191 N.C.S. Section 1-Metered Services. The fixed monthly service charge shall be as set forth in Table 1. Table 1. Beginning July 1, 2007 and each July thereafter, fixed monthly service charges shall increase by three and one-half percent (3.5°Io). Section 2 -Water Consumption. Water consumption charges shall be as set forth in Table 2. Table 2. Page 2 Section 3 -Private Fire Protection. Section 4 -Public Fire Hydrant Service to City or Other Public Authority. (A) Water consumed for fire or other public related uses shall be charged at the consumption rate in Section 2. (B) There shall be a minimum. charge of $2.00 per hydrant per year. Section 5 - Not used. Section 6 -Return Check Fee. Return check fee shall be $15.00. Section 7 -Service Resumption After Payment of Delinquent Bill. Turn-on due to resumption of service from payment of delinquent bill shall be $30.00. Section 8 -Service During Non-Business Hours. Turn-on or off of service or other services at the request or caused by the consumer, regardless of reason, after 4:00 PM, Monday through Friday, holidays or weekends shall be $60.00 per service call. Section 9 -Deposit. Deposit to open account or re-establish an account due to delinquency shall be $50.00. Section 10 -Delinquent Notice. The first delinquent notice mailed to the consumer shall cause a $5 charge to be added to the consumer account. Resolution No. 2002-191 N.C.S. Page 3 Section 11-.Meter Testing Deposit. Meter Size Amount 1 inch or less $10.00 Greater than 1 inch $15.00 Section 12 -Miscellaneous Fees and Charges. Actual cost for various services plus a 20°Io administrative charge will be charged to the consumer for services requested or caused by the consumer. Section 13 -Meter Penalty Charges. (A) There is a $50 first time penalty for a meter valve being turned on and/or unauthorized taking of water by anyone other than City employees. This penalty also may be imposed for damaging or unauthorized tampering of City water service. (B) There is a $200 penalty for each additional action. Section 14 -Fire Hydrant Load Meter. (A) A $1,200 deposit shall be required by the consumer in order to obtain a meter and connection to a fire hydrant. (B) A $2.00 per day meter charge will be levied for use of the meter. (C) The applicant will be charged for the actual water use based on the rates in Section 2. Section 15 -Bridge Meter. (A) A $600 deposit shall be required by the consumer in order to obtain a meter and connection to a fire hydrant. (B) A $2.00 per day meter charge will be levied for use of the meter. (C) The applicant will be charged for the actual water use based on the rates in Section 2. Resolution No. 2002-191 N.C.S. Page 4 Section 16 -Construction Service. (A) A $100 deposit shall be required fora 3/4 inch or 1 inch construction meter set at curb stop. (B) A $1.00 per day meter charge will be levied for use of the meter. (C) The applicant will be charged for the actual water use based on the rates in Section 2. Under the power and authority conferred upon this Council by the Charter of said City.
