1 AUTHORIZING ISSUANCE AND NOTICE OF A REQUEST FOR
2 PROPOSALS CALLING FOR SEALED BIDS FOR AN AGREEMENT
3 GRANTING THE EXCLUSIVE RIGHT TO PROVIDE SERVICES FOR
4 THE COLLECTION OF SOLID WASTE, RECYCLABLE MATERIALS,
5 AND YARD TRIMMINGS WITHIN THE CITY OF PETALUMA

9 WHEREAS, pursuant to Petaluma Municipal Code section 8.16.070 the City Council is
10 authorized to enter into an agreement granting the exclusive right to be the official provider of
11 services for the collection and disposal of solid waste within the City of Petaluma; and

13 WHEREAS, the City's current agreement for the collection and disposal of solid waste will
14 expire in June, 2004; and

16 WHEREAS, the City Council wishes .to elicit bids for anew agreement for such services, to take
17 effect following expiration of the current agreement; and

19 WHEREAS, concurrently herewith, the City Council has approved a "Request for Proposals for
20 Solid Waste, Recyclable Materials, and Yard Trimmings Services" ("RFP") with which to
21 request sealed bids for the exclusive right to provide services for the collection and disposal of
22 solid waste, recyclable materials, and yard trimmings within the City of Petaluma, and a form of
23 "Franchise Agreement" to be awarded to the successful bidder.

25 NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby authorizes the
26 immediate release of the approved RFP and Franchise Agreement for the purpose of inviting
27 sealed bids for an agreement to be the exclusive provider of services for the collection and
28 disposal of solid waste, recyclable materials, and yard trimmings within the City of Petaluma.
29 True and correct copies of the approved RFP and Franchise Agreement shall be kept on file in
30 the office of the City Clerk, and available for examination by prospective bidders, beginning on
31 or about December 3, 2002.

33 BE IT FURTHER RESOLVED, that the submittal of proposals shall be subject to the
34 following requirements:

36 1. All proposals to be considered must be received by the City on or before February 28,
37 2003 at 5:00 p.m., and all proposals received by the City shall be opened immediately
3 8 thereafter.

1 2. All proposals shall comply with the terms, requirements, and specifications. set forth in
2 the RFP, including, inter alia, providing the information required therein concerning the
3 amount the bidder will pay the City monthly as consideration for the contract to be the
4 exclusive provider of services for the collection and disposal of solid waste, recyclable
5 materials, and yard trimmings within the City of Petaluma.

7 4. Each proposal shall be accompanied by a cashier's check in the sum of FIFTY
8 THOUSAND DOLLARS ($50,000.00), as a bid deposit, which sum shall be forfeited by
9 the bidder to whom the contract is awarded, as liquidated and unascertainable damages to
10 the City, if thereafter the bidder fails or refuses to enter into a contract within thirty (30)
11 days after receiving notice of the award.

13 5. The City Council reserves the right to reject any and all bids, including the highest bid, if
14 it determines that, because of experience, financial responsibility or reputation, or some
15 other factor, the acceptance of a lower bid is for the best interests of the City.

17 6. Each bidder shall. agree to perform and comply with and be bound by all the terms,
18 conditions and provisions required by Petaluma Municipal Code chapter 8.16, and the
19 other specifications set forth in this Resolution, the RFP, and the Franchise Agreement.

21 BE IT FURTHER RESOLVED, that the City Clerk is hereby directed to cause notice of the
22 issuance of the RFP to be published in the official newspaper of the City by two publications not
23 less than five days apart, the last of which shall not be less than twenty days prior to the time
24 fixed herein for the opening of bids.
