MAY 2 0 1985 1 1 of the City of Petaluma, California RESOLUTION SU.SPENDING THE ISS,UANCE OF BUILDING PERA~IITS FO.R NEW RESIDENT'IAL DWELI,ING UNITS WITHIN THE GEOGRAPHIC BOUNDARIES OF THE WAUGH AND CINNABAR SCHOOL DISTRICTS WHER:EAS, Chapter 17..28 of the Petaluma Mun'icipal Code is known as the "School Facilities Fees/J~ed.ication Ordinance"; and, WHEREAS, Section 17.28.040 provides that the City Council may from time to time, by resolution issue regulations to provide for the administration and implementation of Chapter 1?.28; and., WHEREAS, the Waugh and Cin.nabar School Districts have presented findin~s to the City that con.ditions of overcrowding exist within their respective school districts and have requested imposition of fees/and or dedication of land for new residential dwelling units within the geographic boundaries of their districts to miti~ate such overcrowding; and WHEREAS, Section 17.28.050 provides that fees are to be collected at the time building permits are approvecl and issued; and WHEREAS, the City Council finds and. d.etermines that the approval and issuance of building permits for new residential dwelling units within the Waugh and Cinnabar Sehool Districts may const'itute an immediate threat to the p'ublic health, safety' an,d welfare as there is a reasonable ]ikelihoocl_ that cond.itions of overcr.owding exist, within said districts, and the City Counci.l. in conjunction with the Community Development and Plannin~ Department require a reasonable time to determine if there is City concu.rrence that overcrowding exists and to implement a fee .schedule; . NOW, THEREF,ORE, ]3E IT RESOLVED t}ia't ~ the City Council herebv extends the suspension on the approval and issuance of building permits for new residential dwelling units within the geographic boundaries of the Waugh and Cinnabar School, Dis-tricts established by R.esolution No. 85-110 N.C.S.; and, BE IT FURTHER RESQLVEn that this resolution shall expire on June 20, 1985, unless rescinded prior to such time. res moratoria school fees r'r`R FCfILTnder the;power and authority conferred upon this Council by the Gharter of said City.
