A RESOLUTION DENYING THE APPEAL OF
RAJA D`EVELOPMENT COMPANY, IN,C.
FROM THE ACTION OF T.HE SITE PLAN AN~D ARCHITECTURAL
REVIEW COMMITT-EE DENYING CHANGES TO WINDOWS WITHIN
THE CREEKVIEW CQMMONS CONDOMINIU'M SUBDIVISION PROJECT
WHEREAS, Raja Development Company, Inc. , has appealed the action of the
Site Plan and Architectural Review Committee of April 25, 1985, denying the
developer'.s request to reduce the windows to a single pane design on the
68-unit .single-family dwelling project to be located on Monroe Street at the
intersection. of Ely Boulevard, adjacent to Lynch Creek; and
WHEREAS, the matter has been properly brought before and heard by the
City Council and the applicants and all interested parties were permitted to
be heard; and
WHEREAS, the City Council hereby finds as follows:
1. That the use of windows of a two pane design will retain the original
quality of the projeet.
NOW, THEREFORE, BE IT FZESOLV~D that. based ori the foregoing finding,
the appeal is hereby denied and the action of the Site Plan and
Architectural Review Gonimittee is u:pheld with the,~ original eighteen
conditions as listed below c -~ ' ~ ~ .

l. Window trim an:d treatment shall be 2" X 6" and 1° X 8" as originally
approved.
2. Corner and roof edge trim shall be 2° X 6" as originally approved.

3. Rear windows shall match front windows as shown on the revised plans
in a multi-light design (mullioned) , (file no. 5. 741A, plans dated
1/21/85).
4. A typical roof vent with decorative cap to blend with roof color and
material sha11 be reviewed and approved by planning staff.
5. Downspouts and rain gutter shall be shown on plans, shall be reviewed
and approved by staff and shall be painted to match building trim.
6. Rear yard fences for Building #10, with rear elevations facing Ely
Blvd. shall be designed to provide sound buffering, subject to review
and approval of staff. Windows on rear elevation of Building #10 shall
be designed to provide interior noise levels not to exceed 40 dBa in
bedrooms and 45 dBa in other habitable rooms.
7. Common mailbox kiosks shall be developed throughout the site, location
and design shall be reviewed and approved by Community Development
and Planning Department.
8. All parking spaces shall be designed and striped in accordance with
SPARC standards.
9. Creekfront, pool and play area improvements shall be in accordance
with the originally approved development plan. The landscape plan
shall provide for the planting of native plant material along Lynch
Creek, subject to approval of the Community Development and Planning
Department and State Department of Fish and Game.
10. Provision shall be made for the maintenance of street frontage
landscaping and pedestrian improvements on Monroe Street.
11. All trees shall be fifteen gallon size, double staked; all shrubs shall
be five gallon size. All landscaped areas not irnproved with lawn shall

be protected with a two-inch deep bark mulch as a temporary measure
until the ground cover is established.
12. All plant material shall be served by a City approved automatic
underground irrigation system.
13. All planting shall be maintained in good growing condition. Such
maintenance shall include, where appropriate, pruning, mowing,
weeding, cleaning of debris and trash, fertilizing and regular
watering. Whenever necessary, planting shall be replaced with other
plant materials to insure continued compliance with applicable
landscaping requirements. Required irrigation systems shall be fully
maintained in sound operating condition with heads periodically cleaned
and replaced when missing to insure continued regular watering of
landscape areas, and health and vitality of landscape materials.
14. All outdoor mechanical equipment shall be fully visually screened upon
installation subject to the approval of the Community Development
Department .
15. Location and design of exterior lighting fixtures shall be shown on
plans and be subject to approval of the Community Development and
Planning Department. Such lighting shall be of a low level type and
conform to the City's performance standards .
16. Driveway and parking surface areas shall be improved with a City
approved surface of asphaltic-concrete or concrete pavement. All
parking surface areas shall be bordered with concrete curbing which is
designed to meet at least the minimum specificatioxis of the City
Parking Design Standards .
17. The concrete pedestrian path shall be extended to connect to the
western property line. All on-site pedestrian paths shall be
constructed of concrete.

18. Housing units served by driveways less than twenty (20) feet in
length shall be provided with remote control garage door openers to
prevent vehicular congestion in the street.
