A IYESOLUTION APPROVING A REVTSED UNIT DEVELOPMENT PLAN
FOR R. OYAL OAKS MOBILE HOME, PARK PHASE II LOCATED
ON THE EAST SIDE 'OF N.ORTH MC;DOWELL BOULEVARD NEAR
SUNRISE PARKWAY (A.P. 'No.. 137-060-38)
WHEKEAS, by Ordinance No. 1474 N. C. S. , the area represented by
Assessor's Parcel No. 137-060-38 was rezoned to Planned Unit Development.
WHEREAS, by action taken on May 14, 1985 the Planning Commission
recommended conditional adoption of a revised final unit development plan
for Phase II of said project.
NOW, THEREFORE, BE~ IT RESOLVED that the unit development plari
previously approved for the project by City Council resolution No. 9231
N. C. S. as revised by City Council Resolutions No. 9843 N.C. S. and No.
8493 N.C.S., is hereby amended to permit the requested changes in number
of units, storage area, building envelopes, carport locations and design and
landscaping plan described in the Planning Commission minutes of May 14,
1985 pursuant to Section 19A-504 of Zoning Ordinance No. 1072 N. C. S. , as
amended; and,
BE IT FURTHER RESOLVED that the City Council hereby adopts the
findings of the Planning Commission as its findings as set out hereinafter:
l. The revised plan clearly results in a more desirable use of land and a
better physical environment.
2. The revision will not affect the finding that the originally approved
PU~D District is proposed on property which has a suitable relationship
to one (1) or more thoroughfares; and that said thoroughfares are
adequate to carry any additional traffic generated by the development.
3. The revised plan for the proposed development presents a unified and
organized ar"rangement of buildings and service facilities which are
appropriate in relation to adjacent or nearby properties and that

adequate landscaping and/or screening is included if necessary to
insure compatibility.
4. The natural and scenic qualities of the site are protected, with
adequate available public and private spaces designated on the revised
Unit Development Plan.
5. The development of the subject property, in the manner proposed by
the applicant, will not be detrimental to the public welfare, will be in
the best interests of the City and will be in keeping with he general
intent and spirit of the zoning regulation of the City of Petaluma, with
the Petaluma General Plan, and with the Environmental Design Plan
adopted by the City.
BE IT FURTHER RESOLVED that the City Council hereby approves the
amended Development Plan subject to the conditions set out hereinafter:
Revisions :
l. Add two additional spaces to the development of Phase II.
2. Reduction of RV storage area.
3. Create building envelopes to establish minimum setbacks for units.
4. Relocate carports to provide for larger front setbacks and to conform
to minimum distance requirements to residential unit.
5. Reduce lot dimensions for four lots with rear yards facing Maria Drive.
6. Design changes for carports and garages.
7. Provide specific landscaping plan.
Conditions :
1. Setbacks :
a. For units with garages: front setback from lot line shall be a
minimum of ten (10) feet or twenty (20) feet or greater.

b. For units with carports with entry steps located in carport area:
Carport/driveway depth shall be a minimum of forty feet long by
twenty feet wide to permit at least three off-street parking spaces
in accordance with City standards. Carports without entry steps
shall either maintain a front setback of ten feet or sufficient
setback to achieve an overall length of forty feet or more from
the lot line.
c. In no case shall residential units be located closer than ten feet
from front lot line.
d. In no case shall a parking structure be located less than three
feet from side lot line.
e. In no case shall a residential structure be located less than five
feet from side lot line.
f. In no case shall residential structures not directly adjacent to the
greenbelt be located less than ten feet from rear lot line.
g. Where residential structures back onto the central "greenbelt" ,
the maximum reear lot setback sha11 be five (5) feet, i,e., five
feet between rear of unit and edge of greenbelt.
h. In no case shall structures on adjacent lots be located closer than
eight feet from each other.
2. Carports shall be redesigned to the approval of SPARC with special
emphasis on restoration of architectural detail similar to the design
approved in the 1983 plan.
3. Maria Drive improvements, landscaping areas and masonry wall to
match McDowell shall be completed within two years or at such time as
Maria Drive is constructed between project and Sunrise Parkway,
whichever occurs first. Bonding for said improvements in the interim
is required.

4. Revised site plan, landscape and irrigation plans and architectural
drawings shall be submitted to SPARC for approval within thirty days
after approval of the PUD development plan revisions by the City
Gouncil.
5. A11 previous conditions of approval not modified by the preceding
eonditions shall remain in force.
6. Developer sha11 utilize alterriative garage roof design to provide
architectural appearance variations on Lots 61 through 79.
7. Structures on lots 86 - 94 shall maintain required setbacks frorn
existing overhead _PG.&E lines.
8. Special developmen.t arid service fees shall be paid at the time each
unit is set.
BE IT FURTHER RESOLVED that the City Council finds that the
requirements of the Galifornia Environmental Quality Act Guidelines, Section
15083 have been satisfied and hereby= incorporates; by reference the
Negative Declaration adopted by Council resolution No. 9230 N.C.5. on July
6, 1981. _ . ~
