RESOLUTION AUTHORIZING THE MAYOR OR CITY
MANAGER T(~ ENTER INTO AND EXECUTE AN
AGRICU-LTURAL LEASE WITH MERV ~SARTO:R.I
AND CAROL SARTORI, HUSBA.N'D AND ~IIFE
BE IT RESOLVED. that the Mayor ~r Git~~ A~tanager is hereby
authorized to enter into and execute an agricultural lease by and between
the City of Petaluma and Merv Sartori and Carol Sartori, husband and wife;
and,
BE IT FURTHER RESOLVED said lease ,shall be for a term of one year
commencing on May 1, 1985 and ending on April 31, 1986; and,
BE IT FURTHER R:FSOLVED that said lease is attached hereto as
Exhibit A, and incorporatecl herein by reference.
Under the power and authoiity conferred upon this Council by the Charter of said City.

BY THIS :LEASE, °entered into: on the lst day` of May, 1985,, the CITY
OF' PETALUI~~A, a Ca~li'fornia municipal corporation-,, hereinafter called
Lessor, demises and lets to MERV .SARTORI and. GAR(2L SARTORI, husband
and wife, hereiriafter calTed Lessees, to occupy and use for agricultural
purposes, the real property located in the County of Sonoma, State of
California, described iri Exhibi't A:, attached hereto and i"ncorporated herein
by reference.
The term of this lease sha11 be from °the first dav of. Ma.y, 1985, to the
30th day of April 1986-. .T'he °provisions of the lease shall be binding upon
the heirs, executors, administrators, and assigns, of both I~essor and
Lessees in 1'ike manner ,as up.on the original, par.t'i'es, unless modified by
mutual ag"reement ;in writing., ~
Section 1. Rental. Provisions. Lessees a~ree to pay Lessor, as cash
rent• for the agr-icultural land described. 'in Exhibi`t A, the sum of $350.00
for the period thereof.~ S`aid cash rent shall be paid at the time of the
execution of tliis lease .
Section 2_. Lessees, as a,. m~terial part of the consic~er.ation of the. rent
~f the Lessor under this~ leas,e:, agree to hold Lessor lia=rmless and indemriify
i;t for any loss' or injury suffered on the subject px-operty, including
pers.onal injury and pr.operty d:amage or any th'ird p,er. son,.
Sectiori 3, The, parties hereto spe;c:ifically' agree °that this Agr.eement is
a lease: for a specific period and is not a~cropping agreement.
Section 4..: Lessees agr.ee to remove and relocate the cattle on said
land described 'in th~e Exhibit A attached hereto, up,on demand of Lessor.
Secti~n 5. Lessor and Lessees agree that the subj;ect property is to
be used' for~ agricul`tural p:urposes only and that no perr:lanent improvements
of any kind wh'atsoever shall be ere:cte~d~ bv .L~essees' without the written
consent of Lessor.
Section 6. L'essees agree not to assign this lease or sublet . the
property without first Lessor's written consen~t, Guch assignment or
subletting shall not; 'reiease Lessee froin any obligations .under this lease.
S'ection ?. If', izpon. fhe expir.ation of this lease, Lessees hold over
and fail to vacate said premises, said tenanc•y sliall continue only from
month-to-month, and sha1T not be deeined renewed f.or the term hereof.
- Rent shall be: payable in adyance f~r such holdover tenancy, prorated for
the ter.m. This section shall not be deeme'd Lessor's consent for such
holdover.
Section 8. In the .e~ent tliat ~ legal act=ion is necessar.y to enforce any
provisiori of this lease+, -the prevail'irig party shall: be enfitled to reasonable
attorney's fees anel leg:al costs..
Seetion 9. Any repair-,s, improvements an`d in_stallation made on the
premises by Lessees which are affixed" to the r.ea1`ty shall become the
property of :Lessor upon termination of this Fease.
