S. of the City of Petalurna, California RES.OLUTION DENYING APPEAL OF PLANNING COMMISSION APPROVAL OF A USE PERMIT TO ALLOW EXPANSION AND RELATED SITE INIPROVEMENTS TO BOULEVARD B04VL, 1100 PETALUMA BOULEVARD SOUTH WHEREAS, on February 26, 1985, the Planning Commission granted a Use Permit to Boulevard Bowl, allowing a 21, 000± expansion and related site improvements at 1100 Petaluma Boulevard South (AP No. 008~471-18), and, WHEREAS, thereafter on March 8, 1985 an appeal of said action was filed to the City Council, the matter being heard on April 1 and 15, 1985; WHEREAS, both written and oral evidence was duly presented at said hearing ; NOW, THEREFORE, BE IT RE50LVED the City Council hereby denies the filed appeal and, BE IT FURTHER RESOLVED the City Council makes the following findings with regard to the denial of the appeal: 1. The proposed struc.ture and use, as conditionali.y approved, conforms to the requirements and intent of the_ Petaluma Zoning Ordinance and General Plan/EDP. 2. The proposed use, as conditionally approved, will not under any circumstances' constitute a nuisance or be detrimental to the public wel'fare of t~he community. ~ 3. Reloca~tion of, the existing coin shop within the p-roposed building does not comstitute an expansion, extension or movement of this pre-existing non-conforming use. BE IT FURTHER RESOLV~;D that based upon the he~einabove findings, the app:eal is hereby deriied, and the Use Permit is granted to Boulevard Bowl. 1 Reso No 85-109 N.C_S_ for 21, 000± expansion and rel.ated site improvements per the revised site plan received by the Plannin~ Department, subject to the following conditions of approval: 1, Each ingress/egress driveway to Petaluma Boulevard will be widened and improved to accommodate two-way traffic to the satisfaction of the City Engineer. 2. The easternmost ingress/egress to Petaluma Boulevard shall be further removed form the adjacent driveway to the Veterans' Memorial Building to the satisfaction of the City Engineer. 3. All parking area shall be lighted to City standards. Low level lightin~ is to be utilized on the east, west and south side of the building to prevent disturbance to neighbors and possibl.e crime, subject to approval by the Petaluma Police Department. The design of all exterior lighting is subject to SPARC approval. 4. All exterior doors shall remain closed (i.e. doors shall not be propped open for ventilation or other purposes) . No public doorways shall be located on the building's western [elevation] side (access to screen nursery area and doors for exit only excepted) . The building design shall be mod.ified to provide an "L" shaped exitway on the weste.rn side with a wall from floor to roofline to block noise and light. 5. A soils and grading/draina.ge report shall be prepared by the applicant and be subject to approval by the City Engineer prior to issuance of building permits . 6. From the Fire Marshal: a. Addition shall be equipped with an approved automatic fire sprinkler system in accordance with Section 10.309A o£ the Uniform Fire Code .( See attached ). Z Reso No. 85-109 N.C.S. b. Two on-site hydrants shall be provided. Located. as marked on site plan , at N. E, and S. E, corners of building . c. Fire flow 1,500 GPM required from two hydrants (750 GPM each) at 20 psi minimum residual pressure uniform. d. Building code maximum allowable square footage is 27,000 square feet with three side vard setbacks. Building would be rec{uired to be completely protected by fire sprinkler system in order to accommodate 43 , 070 square feet area. " 7. Al.l existing and future roof or ~round mounted mechanical equipment shall be fully architecturally screened along with having noise deadening and/or absorption material included to prevent excessive noise. Any and all noise abatement shall meet City requirements as specified in Article 22, Section 22301 of the City Performance Standards. Any screening shall also be subject to review if/or when it blocks the vie~~ of a.djacent neighbors. Approval subject to review of SPARC. 8. Barriers shall be constructed to prohibit in its entirety vehicular access or trespassing to a.ny and. all unimproved portions of the site. The barriers shall allow for gates so that th.e present practice of cutting grass and weeds for fire prevention purposes can be continued. The barriers shall be maintained in good working order. and gates secured at all times to discourage loiterin~ and to maximize crime prevention, except for periods o.f maintenance. Design subject to SPARC approval. 9. All areas used for driveways and parking shall be fully paved, paving to be repaired where deteriorated. The edge of all paving shall be curbed per SPARC standards. 10. A solid heavy wood fence six feet high shall be installed along the entire western property line from the southernmost portion o.f. residential properties abutting th.e property site to Petaluma Boulevard 3 Reso No. 85-109 N.C.S. right-of-way, except that said fence shall step down to 42 inches height in the northernmost 20 feet of the property. Said fence is subject to SPARC approval. An adjacent solid heavy wood fence six feet high shall be installed along the southernmost portion of the site in an east/west direction that would tie into the proposed fence to be constructed on the western property line and the east/west fence of the residents on the southern property line of the site. Said fences are subject to SPARC approval. ll. A landscape plan shall be prepared for SPARC review. Said plan shall depict heavy screening treatment alon~ the western property line. Plantings shown on the site plan alon~ the southern retaining wall shall be moved. southerly to the break of the grade above the retaining wall. The planting shall be intermittent, not continuous, and shall be of a variety which attain a typical height of 15 to 20 feet when mature in order to obscure a majority of the structure. Southern plantings shall be maintained at a height of 15 feet to 20 feet. 12. All planting shall be rnaintained in gooc~ growing condition . Such maintenance shall include, were appropriate, pruning, mowing, weeding, cleaning of debris and trash, fertilizing and regula.r watering. Whenever necessary, planting shall be replaced with other plant materials to insure continued compliance with applicable landscaping requirements. Required irrigation syster_~-s shall be fully maintained in souna operating condition with heads periodically cleaned and replaced when missing to instire continued regular watering of landscape areas, and health and vitality of landscape materials. 13. At least one security guard shall be retained on the premises Saturday and Sunday mornings between the hours of ?:00 AM and 6:00 AM. A guard will patrol the parking lot and perimeter of the building every half. hour between the hours of 10:00 PM and 6:00 AM. Said guard. shall prohibit whenever possible loitering, littering, exhibitions of speed, drivin~ of unauthorized vehicles on unimproved portions of. the site, a.nd: other undesirable or dilaterious activities on the grounds. This guard(s) is to be in addition to the two guards normally employed 4 Reso No. 85-109 N.C.S. from 8:00 PM to 2:00 AM Fridays and Saturdays. The security situation shall be reviewed at the end of six months . 14. Any expansion to any of. the uses described h.erein or uses shown in the submitted plans are subject to review of this use permit by the Planning Commission. 15. Uses within the "rentable space" portion of the new building shall comply with the re~ulations of the C-H zone district as determined by the Director of Community Development. 16. A minimum 10 foot wide landscaped area shall be provided between the paved portions of the parking lot and Petaluma Boulevard with 20 foot wide area adjacent to each ingress/egress to maintain stacking ability. The property owner shall maintain all landscaping within the public right-of-way. A maintenance agreement with the City shall be recorded with the proper.ty deed for such areas. Landscaping shall be appropriate for a major entrance to the City and be subject to SPARC review . 17. During the course of development, if archaeological materials are found, all work in the vicinity of the find(s) shall be stopped and a. qualified archaeologist contacted to evaluate the materials and make recommendations for mitigation as deemed necessary. 18. This project is subject to SPARC review and conditional approval. All physical exterior modifications to the building or g;rounds required by these conditions of approval shall be shown on the plans to be reviewed. by SPARC. All conditions of approval imposed by SPARC shall become conditions of this use permit. 19. Appropriate texture and/or paint shall be applied to the roof of the present and proposed building so as to reduce glare and/or satisf.y Article 22, Section 22-304 of the City's Performance Standards. 5 Reso No. 85-109 N.C_S. 20. The westernmost eleven compact parking spaces sha11 be eliminated. The westernmost row of parking shall be reoriented at a 45-degree angle with all space gained (12 feet) being added to the landscaped buffer along the western property line. 21. This use permit is subject to .review by the Planning Commission one year from date of occupancy of the expanded facility or at such time as the Commission determines review is necessary in order to preser. ve the peace, safety, and welfare of the neighborhood. At this time, conditions of approval may be added or modified, including review and possible limitation of hours of operation . 22. The rear portion of the building shall not be used .for the purposes of parking cars and/or other vehicles. The existing retaining wall shall remain as the southern most boundary of the present and proposed site. Access to the rear portion of the building shall be chained off from 9:00 PM until 6:00 AM. The chained off portion of the west side is to be located directly south of the doors which are adjacent to the proposed nursery and women's locker room. The chained off portion on the east side is to be located south of the doors which are adjacent to the proposed pro shop and restrooms . 23 . Full frontage improvements ( e.~., subterranean drainage , etc .) are required to the satisfaction of the City Engineer. Any ri~ht-of-way or easements deemed necessary must be dedicated and record.ed prior to issuance of buildin~ permit. 24. Professional review of existin~ mechanical equipment with regard to noise emissions shall be conducted by the applicant and any noise mitigation measures recommended in said review shall be incorporated in the remodel/addition. 25. Any and all trash receptacles are to be contained or housed inside the 6 Reso No. 85-109 N.C.S. . existing or proposed stru.c,tu're.. If these: trash facilities are not enclosed sufficiently to~ preven.t noise frorri trash being dumped, the dumping of trash is to be confined from 8:OD AM to 8:00 PM.
