S. of the City of Petaluma, California A RESOLUTION APPROVING REVI.SIONS TO THE UNIT DEVELOPMENT PLAN FOR CREEKVIEW COMMGNS SUBDIVISION LOCATED ON MONROE STREET (FUTURE) AT ELY BLVD , NOR'I'H WHEREAS, by Ord'inance No. 1493 N.C.S., Creekview Commons Subdivision was rezoned to Planned Unit Development and, WHEREAS, by action taken on March 26, 1985, the Planning Commission recommended conclitional adoption of a revised final unit development plan for said subdivision to incorporate/revise development standards. NOW, THEREFORE; BE' IT RESOLVED that the unit development plan previously approved for the project by City Council Resolution No. 9314 N. C. S. is hereby amended to permit revision . to development plan as described in the Planning Commission minutes of March 26, 1985; BE IT FURTHER RESO:L;VED; ,that the City ,_Cou.ncil hereby adopts . the findin.gs of the Planning Commission as its findings as set out hereinafter: Firidings: 1. The Development Plans clearly result in a more desirable use of land and, a better physical environment that would be possible unde-r any single: district or combination of zoning districts. 2. The PUD District is proposed on property which has a suitable relatioriship to a thoroughfare; and said thoroughfare is adequate to ~ carry any additional traffic generated by the d~velopment. 3. 'Phe plans for the development present a unified and organized arrangement of buildings and service facilities which are appr.opriate in 1 Reso No 85-116 N.C.S. relation to adjacent properties, and adequate landscaping is included. to insure compatibility. 4. The natural and scenic qualities of the site are protected with adequate available public and private spaces designed on the Unit Development Plan. 5. The development of the subject property, in the manner proposed by the applicant, will not be detrimental to the public welfare, will be in the best interests of the City and will be in keeping with the ~eneral intent and spirit of the zoning regulations of the City of Petaluma, with the Petaluma C'~eneral Plan, and the Environmental Design Plan. BE IT FURTHER RESOLVED that the City Council hereby approves the revised unit development plan subject to the conditions of approval set out hereinafter . CREF.KVIEW COMMONS Conditions : l. All original conditions of approval of the existin~; PtTD unit development plans, Resolution 9314 N.C.S., shall be re-adopted as part of this development plan amendment. 2. Home occupations shall not be allowed, per the adopted CC & R's. 3. EYterior alterations to structures or fences shall not be permitted without prior consideration and approval of. the Homeowners Architectural Committee, as required by the CC & R's, and b~j SPARC. 4. Garage conversions are prohibited, as set forth within the CC & R's. 5. Any other questions concerning land use re~ulation shall be ~overned by the City Zoning Ordinance as long as it does not expressly conflict with the project CC & R's or the adopted PUD unit development plan . 2 Reso No 85- 116 N.C.S. 6. Landscape and elevation drawings suliject to review and approval by SPARC. ' ' BE IT FURTHER RESOLVED that the City -Council finds that the requirements of the California Environmental QuaTity .Aet Guidelines have been met and hereby incorporates by reference the previously prepared env-ironmental documentation for the project. reso. creekview. commons reso3 Under the power and authority conferred upon this Council. by the Charter of said City.
