A RESOLUTION APPROVIN:G THE ISSUANCE OF A NEGATIV~
DECLARATION PURSUANT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT ~FOR- ,A USE PERMIT
ALLOWING AN EXPANS-ION, CONVENIENCE ~MARKET, AND RELATED
SITE IMPROVEMENATS TO THE PROPER'P,Y LOCATED AT
715 PETALUP~IA BOULEVARD NO'RTH
WHEREAS, an initial, stu?dy. has~~•been prepared' for the area and has been
reviewed by the Community D.evelopment and `Planning Department and the
Planning Commission .for the following projeet: ,~
Use permit for AP No,. s 006--092-16 and - 1Z~ allowing ~the addition of a
convenienee market and related site improvemerits; arid~
WHEREAS, the results of this study have determined that approval of this
use permit as conditional'ly ap.proved will not trigger any significant adverse
environmental impacts; and.,
WHEREAS, staff recornmended that a negative decTar.a~tion be issued on the
above project;
NOW, THEREFORE, BE IT :RESOLVED that the issuance of said Negative
Declaration pursuarit to the California Environmental Quality Act is hereby
approved, based upon the following findings: ~
1. The City Couneil has considered any comments received pertaining to
issuance of said Negative Declaration, and finds the responses thereto
to be adequate.
2. No significant adverse impacts are associated with the use _ permit as
conditionaTly approved.
3. Due to tlie developed nature of the existin'g site, the project does not
have the potential to degrade tHe quality of the envir,onment,
substantiaily reduce the habitat of a fish or wildlife species, ~cause .a
fish or wil:dlife population to drop below self sust"aining levels,

threaten to eliminate a plant or animal community, reduce the number
or restrict the range of a rare or en,dangered plant or animal or
eliminate important examples of the major periods of California history
or preliistory.
4. The project, as conditionally approved, does not have the potential to
achieve short-term, to the disadvantage of long-term, environmental
goals.
5. Because the proposal does not include additional phased development,
the project as conditionally approved, does not have impacts which are
individually limited, but cumulatively considerable.
6. The project, as conditionally approved,, does not have environmental
effects which will; cause. substantial adverse effects on human beings
either directly. or `indirect'ly~. ~
