' of the City of ~Petaluma, California RESOLUTION UPHOLDING APPEAL OF PLANNING COMMISSION DENIAL UF A USE PERMIT 'PO ALLOW EXPANSION, CONVENIEN.GE MARKET AND RELATED SITE IMPROVEMENTS TO TH~E PROPERTY LOCF,TED AT 715 PETALUMA BOULEVARD NORTH WHEREAS, on April 9, 1985, the Planning Commission denied a Use Permit to John D. IViilliken for an expansion, 1,700± square foot convenience market, and related site improvements at 715 Petaluma• Boizlevard North (AP No's 006-092-17) , and, WHEREAS, thereafter on April 12, 1985 an appeal of~ said action was filed to the City Council, the mat"ter being heard on May 6, 1985; WHEREAS, both written and oral evidence was duly presented at said hearing ; NOW, THEREFORE, BE IT FtESOLVED the City Council hereby upholds the filed appeal and, . BE IT FURTHER RESOLVEI~ the City Council makes the following findings with regard to the issuance of the use permit: ~ I. The proposed structure and use, subject to the conditions of approval, conforms to the intent and requirer.ients of the Zoning Ordinance, the General Plan, and EDP. 2. This project will not constitute a nuisance or be detrimental to the public welfare of ~the community due to tlie mitigation measures incorporated ,in the conditions of approval. BE IT FUR'I'HER RESOLVED that based upon the hereinabove findings, the appeal is hereby upheld and the Use Perrnit is granted for addition of a 1, 700+ square foot' convenience market and related site improvements per the revised site plan received by the Planning Department, subject to the following conditions of approval: Reso No 85-131B N.C.S. r~n ~i+inn c • 1. This project site and landscaping plan is subject to SPARC review and conditional approval. 2. Prior to issuance of a building permit, the two parcels shall be merged . 3. All mechanical equipment shall conform to Zoning Ordinance Article 22 (Performance Standards) , especially with regard to noise and vibration . 4. Prior to occupancy of the new addition, Cherry Street shall be widened and improved from the existing driveway to Petaluma Boulevard to the satisfaction of the City Engineer. 5. Prior to occupancy of the new addition, Petaluma Boulevard shall be restriped and otherwise improved to provide a central left hand turn lane to t he satisfaction of the City Engineer. Prior to installation, a striping plan for the new lane prepared by a traffic engineer or consultan t, or civil eng ineer shall be submitted to, and approved by, the City Engineer. 6. Cherry Street shall be so widened to create enough space to allow drivers to turn right without having to wait for a left turn vehicle. 7. This use permit may be recalled to the Planning Commission for review at any time due to complaints regarding traffic congestion, noise generation, or other potentially obnoxious operating characteristics. At such times, the Commission may repeal the use permit or add/modify conditions of approval. 8. All trash bins and/or garbage ~.cans shall be f.ull.y contained and screened. 10. There shall be no inside or outsid"e seating for the consuinption of food on the premises . - ~ ~~ ~ ~ - - - 11. The angled parking ~ space near the office~entrance shall be eliminated or reserved for loading, subject to SPARG approval. 12. The addition to the eXisting nonconforming buil~ding shall be physically detached as aliowed by the Uniform Building Code. A revised site plan depicting this change shall be prepared for SPARC review. 13. The convenience market shall be closed between the hours of 2:00 AM and 6:00 A1bI. 14.
