ESTABLISHING' AMOU.NT AND SCOPE: OF . CC~MP=REHENSIVF GFNERAL
LIABILITY INSURANCE COVERAGE REQUIRED FOR ISSUANCE OF
A FILM PERMIT P-URSUANT T~ ORDINA;NCE NO'. ~Z N.C.S.
(~CHAPTER 13.40' O:F THE PFTALUMA MUNICIPAL CODE)
BE IT RESOLVED that the following insurance requirements are her.eby
established pursuant to Section T3.40.120 of' the Petal~uma Municipal Code:
A. Insurance Coverage Required for Hazardous Filming Activities.
Coverage for filming activities invol~ving helicopters, aircraft,
motor veh'icle crashes, open .flame; explosives, and other
pyrotechnical effects or hazardous activities shall be provided by
a Comprehensive General Liability Insurance Policy as described
in Section C below. The minimum policy limit shall be one million
dollars ($1,000,000.00) combined s'ingle Timit for bodily injury
Iiability and property damage liability. Coverage in excess o.f the
million dollar minimum may be required in the amount determined
by the City Manager commensurate with, the risk to persons and
property involved.
B.. Insurance Coverage Required for Non-Hazardous Filming
Activities .
Coverage for all other f.ilming actiVities not specified in
Section A. above shall be provided by a Comprehensive General
• Liability Insurance Poliey as described in Section C below with
minimum policy limits as follows : One million dollars
($1,000,000.00) combined single limit for bodily injury and
proper.ty damage liability. '
C. Scope of Insurance Coverage. '

for.ms. issued. The permit applicant shall also maintain worker's

compensation and employer liability insurance in accor~.ance
with California law.
Any deductible or sel£ insurance retention in excess of
$1,000 per occurrence must be declared to and approved by the
City Manager, and at the option of the City Manager the in-
surer shall either reduce or eliminate such deduction or
self insured retention in respect to the City of Petaluma,
its officials and employees; or the applicant shall procure a
bond. guaranteeing payment of losses for related investiga-
tion, claims administration and defense expenses.
The film permit applicant's policy or policies are to
contain or be endorsed to contain the following provisions
and any additional coverage as required by the City Mana~er:
1., General Liability and Auto Liability Coverages .
a. City, its officials, employees and volunteers are
to be covered as insureds as respect liability
arising out of the applicant's activities under the
permit. The coverage shall contain no special
limitations on the scope of protection afforded to
the City, its officials, employees or volunteers.
b. The applicant's insurance coverage shall be
primary insurance as respects the City, its
officials, employees and volunteers. Any insurance
or self insurance maintained by the City shall be
in excess of the applicant's insurance and shall
not contribute with it.
c. Any failure to comply with reporting pro-
visions of the policy shall not affect
coverage provided to the City, its officials,
employees or volunteers .
2. Workers' Compensation and Employer Liability
Coverage . The employer shall agree to waive
all rights of subrogation against the City, its
officials, employees or volunteers for losses
arising from activities relating to the permit.
3. All Coverages.
Each insurance policy required by this cl.ause
shall be endorsed to state that coverage shall
not be suspended, voided, canceled, reduced
in coverage or in limit,, except after thirty
(30) days prior written notice by Certified

The permit applicant may, request a wai~er af fhe insurance coverage
requirements specified above . The City Ivfanager inay grant such a waiver
upon making a determination that the insurance coverage maintained by the
permit applicant is commensurate with the risk to persons and property
involved in the planned filming activity.
BE IT FURTHER RESC~LVED that this Resolution shall become effective

on the effective date of the Petaluma Film Ordinance.

1. CONTRIICNRL 1111BILITY COVERA6E
(A) The definition of ineidental contract is extended to include any
oral or written contract or agreement relating to the conduct of the
named insured'a business.
(B) TAe insurance afforded with respect to liability assumed under an
incide~al contract is suDject, to the following additional exclusions:
(1) to bodily injury orpropertr d~ma~afor wfiich the insured has
~assumeE IiaDility under any incidenial contnct, if such injury or
damage occurred prior to the execution of the incidental contract;
(2) if the inwred is an architect, engineer or surveyor, to bodily
injury or property d~mate arising out oi the rendering of or the
failure to render professional services by such insured, including
(a) the preparation or appropal of maps, drawings, opinions,
reports, surveys, change orders, designs or specifications, and
(D) supervisory, inspection or engineering services;
(3) if the indemnitee ot the insured is an arcAitect, engineer or
surveyor, to the IiaDility of the indemnitee, his agents or employees,
arising out of
(a) the preparotion or approval o( or the failure to prepare or
approve maps, drawings; opinions, reports, surveys, change or-
ders, designs or specifications, or

(b) the giving ot or the failure to give directions or instructions
by the indemnitee, his agents or employees, provided such giv-
ing or failure to give is the primary cause of the Aodily injury
or property damage;
(4) to any oDligation'for which the insured may be held liable in an
action on a contract by a thitd party beneficiary for bodily injury
,ror property damage arising out of a project for a pubtic authority;
but this exclusion does not apply to an action by the public authori-
ty or any other person or organization engaged in tbe project;
,(5) to bodily injury or property damage arising out of construc-
tion or demolition bperations, within 50 feet of any railroad prop-
,eriy, and affecting any railroad bridge or trestle, tracks, road
beds, tunnel, underpass or crossing; but this exclusion dces not

IIAIITS OF lII1BIlITY
The limit of, liab~lity 1or Premises Medical Payments Coverage is 51.000
each person unless otherwise stated in the schedule of th~s endcrsement.
'The limit of liab~t~ty appl~cable to "each person" is the limit ot the compa
ny's liability tor all medical apense for bodily injury to any one person as
the result ot any one accident: bul subject to the above Drovision respect
ing "each person", the total IiaD~lity ot the company under Prem~ses Medi
cal Payments Coverage for all medical eipense tor bodilr injurr to two or
more persons as t~e resull of any one acddent shall not ezceed the Iimlt
o~ Dodily injury liability stated m the pol~cy as applicable to "each acur•
rence".
When more than one medical paymenls coverage afbrded ~y the po~~cy
applies to the loss. the company shall not be t~able ior more than the
amount ot the highest appl~cable limit of liability.
IIODITIONAL DEFINITIONS
When used herein:
"insured premises" means all premises owned by or rented to lhe named
insured with respect to which the named insured is attorded coverage tor
bodily injury liabil~ty under this policy, and inclbdes the ways immediately
adjoining on land:
"medical e:pense" means ezpenses for necessary med~cal, surgical. ~ ray
and dental services, including prosthetic devices, and necessary ambu
lance, Aosp~tal, professional nursing and funeral services.
IIDDITIONRL CONDITION
Medical Reports; Prooi and Payment of Claim
As soon as pract~cable the ~njured person or someone on his behalt shall
give to the companr written proot of da~m, under oath if required, "and
shall, a11er each request from the company, execute authorization Co enable
the company to oDtain med~cal reports and copies of records. The injured

person shall submit to pAysical e:am~nat~on by physicians selected by the
cumpany when a~d as often as ihe company may reasonably require. ihe
company may pay the injured person or anyperson ororgan~zat~on render
ing the seivices and ihe payment shall~reduce the amounl payable nere
under for such ~n~ury. Payment hereunder shall not conshtute an adm~s
sion oi liability o( any person or, except hereunder, of ihe company.

VII.INCIDENTAI MEDICAI MALPRACTICE UABILITY COVERAGE ~
The definition ot bodily injury is amended to incluCelncidental Medical
Malpractice Injury. ~ .
InCidenial Medical Malpra~uce lnjury means injury arising out o( the
iendering of or'failure to render, during ihepolicy period; ihe tollowing .

be performed at the place of disablement.

$300 for transportat~on expense ~ncurred by you be~
cause oi the total thett of a covered auto of the private
passenger type We will pay _only for those covered

tion expenses inCUrred during,the period beginning 48
