S. of the City of Petalurna, California RESOLUTION APPROVING TEN.TATIVE SUBDIVISION MAP FOR SPRING MEADOWS UNIT 1-A SUBDIVISiON WHEREAS, N1cBai1 Company as owner(s) and Subdivider(s) has filed with this Council a tentative map proposing to subdivide land within this City to be known as Spring Meadows Unit I-A, and have paid all required filing fees; and, WHEREAS, the City Engineer, the Director of Planning, the Sonoma County Water Agency, and the Planning Commission have examined and reviewed the same as required by law and all reports, recommendations, and comments thereon have been forwarded to an:d consi;dered by this Council at its meeting held on Februar,y 19, 1985. NOW, THEREFORE, BE :IT RESOLVED that this' Council hereby finds ~"as follows : 1. The proposed subdivision, together with provisions for its design and improvement, is consistent with the General Plan: 2. The proposed subdivision is compatible with the objectives, policies, general land uses, and programs specified in said General Plan. 3. The site is physically suitable for the type of development proposed. 4. The site is physically suitable for the proposed density of development. 5. The design of the Subdi~-ision and the propo.sed improvements therefor will not cause substantial environmental damage., and no substantial or avoidable injury will occur to fish or wildlife or their habitat. Reso. 85-051 NCS Page 1 of 4 6. The design of the Subdivision and the type of improvements will not cause serious public health problems. 7. The design of the Subdivision and the type of improvements proposed will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. 8. The discharge of waste from the proposed subdivision into the existing community sewer system will not result in violation of the existing requirements prescribed by the Regional Water Quality Control Board. BE IT FURTHER RESOLVED, that the City Council finds that the requirements of California Environmental Quality Act Guidelines Section 15083 have been satisfied by a previously certified Environmental Impact Report for the east of Ely area. BE IT FURTHER RESOLVED, based on the findings set forth above, that the above referenced tentative map be and the same is hereby approved as diagrammed in and subject to the conditions set forth below: r,,,, ,a;+;,,,, ~ . 1. The project sponsor shall be required to pay low and moderate income housing in-lieu fees of an amount to be determined according to the schedule established by City Council Resolution No. 84-199 N,C.S., or make alternative arrangements to meet the low and moderate income housing provision required of the housing element subject to approval of the City and prior to approval of the Final Map . 2. The developer shall comply with all conditions of the City Engineer as set forth in the attached letter. (Exhibit A) . 3. The developer shall pay required storm drainage impact fees under Section 17.30 prior to recordation of the final subdivision map. Reso. 85-051 NCS Page 2 of 4 4. Any residential architecture and associated site improvements shall be subject to design review by the Site Plan and Architectural Review Committee . 5. Construction of dwelling units shall not occur until after new Municipal Airport runway becomes functional and air traffic no longer uses the existing Sky Ranch air strip . 6. Noise mitigation shall be incorporated in home construction per the EIR including : a. Roof eaves shall extend a minimum of two feet from exterior walls. This helps reduce direct noise impact on window surfaces from overhead aircraft. b. Bedroom windows shall be kept to a minimum size. c. Sliding glass doors shall not be used in bedrooms unless noise requirements can be met. d. All exterior walls and the ceiling shall be adequately insulated. e. Soundtraps shall be included on all ventilation ducts. f. Double pane glass shall be used on all windows . 7. The CC&R's shall contain a statement informing owners that the airport will be located in close proximity. 8. Full side and rear yard fencing to be installed. If fencing exists, it must be repaired to as-new condition. 9. Drainage to be provided to Garfield - yard and foundation drains to be provided and be subject to approval by tlie City Engineer.
