S. .~ of the City .of Petaluma, California RESOLUTION APPROVIN.G 'THE~'~TENTATIVE MAP FOR CASA~ TDEL. .ORO 3- 6, A 150 ~SINGLE-FAMILY UNITS LOCATED A-T :SARTORI DRIVE, :FRA,TES ROAD AND ~ LA-KEVILLE HIGH;WAY (A.P. NO..017-0-40-44) WHEREAS,, Leonard Jay and T Deve'lopmerit~, Inc. as owner and subdivider, has filed with this Council a tentative , map to subdivide land within this City to be known as Casa Del Oro 3- 6 Subdivision, and has paid all required filing fees; ,and, - . WHEREAS, the Gity Erigineer, the Directo"r of Planning, and the Planning Commission have examined and reviewed the same as required by law and all reports, recommendations, and comments thereon have been forwarded to and considered by this Couneil at its meeting held on February 19, 1985; NOW, THEREFORE, BE IT RESOLVED that this Council hereby finds as follows : 1. The prop.osed subdivision, together witli provisions for its design and improvement, is consistent with the General Plan.. 2. The proposed subdivision is compatible with the objectives, policies, general land uses, and pr.ograms specified in said General Plan. 3. The site is physically s.uitable for the type of development proposed. 4. The site is phy;sically suitable for the proposed density of development . . 5. The design of the ;subd'ivision and the proposed improvements therefoY• will not cause sub,staritial environmental darnage, and no substantial or avoidable inj,ury will' occur to fish'or wildlife or their habitat. 6,. The design of ,the <subdivision and the type of improvements will not cause serious public health problems . ~ BE IT FURTHER RESQLVED, based on the findings set forth above, that the above referred to tentative map, be and the same is hereby approved, subjeet to tYie conditions set f~rth below and incorporated herein as follows : RESO. 85-54 NCS 1 of 3 . •1'. o ~ • ~a' -. 1. The tentative map is subject to review by SPARC . All SPARC conditions of approval for the PUD plan which affects the tentative map shall also be incorporated in the tentative map prior to final map submittal . 2. The project shall conform to the conditions of approval contained in the enclosed letter from the Engineering Department. 3. Fire . hydrants shall be located as required by the Fire Marshal. 4. The applicant shall provide for perpetual maintenance of all landscaped areas not contained on private property and the Frates Road sound wall to the satisfaction of the Directors of Community Development and Parks and Recreation and subject to final approval by the City Council. Perpetual maintenance may be accommodated through a maintenance assessment district, the formation of which r~ust be ratified by the City Council prior to final map approval. 5. A ten-foot public utility easement shall be provided along both sides of all street right-of-ways . 6. The sound wall along Frates Ruad shall be coordinated with the design plans for the sound wall treatment at the Sartori Drive terminous and City well site. Said wall shall be constructed by the applicant. Said wall shall have an effective height of eighf feet along all private lots. The wall design at the corner at Cerro Arroyo Drive is subject to SPARC approval. 7. The project sponsor shall be required to pay low and moderate income hausing in-lieu fees of an amount to be determined according to the schedule established by City Council Resolution No. 84-199 N. C. S. , or make alternative arrangements to meet the low and moderate income housing provision requirements of the Housing Element subject to approval of the City and prior to approval of the Final Map. 8. An additional ten (10) feet minimum set back shall be added to the landscaped area between Frates Road and the abutting sound wall. This area shall be dedicated to the City but may be used for a public utility easement. A landscape/irrigation plan for said area featuring heavy tree planting is subject to SPARC approval. 9. The tentative map shall be revised to reflect private drives versus public streets. A joint access easement and maintenance responsibility agreement shall be recorded for all properties relying on private drives for access. Said easements and agreements are subject to approval by City staff prior to final map recordation. 10. The phasing plan shall be modified so that street access from Frates Road is completed prior to initial occupancy of Phase 4. 11. One 80-foot long (minimum) bus pull-out with curbs shall be installed along Frates Road immediately southwest of Cerro Arroyo Drive to the satisfaction of the City Transit Coordinator. A lot line adjustment shall be performed so that the existing house is not located on a property 1ine. = . , BE IT FURTHER RESOLVED, that~ the City Council finds that the requirements of Californ.ia Env~ironmental Quality Act Guidelines have been satisfied by Resolution No. 85-52 N.
