RESOLUTION APPROVING TH.E DEVELOPMENT PLAN FOR
PETALUMA EGUMENICAL PROJECT-S LOCATED IN THE
VICINITY OF LINDBERG LANE AND KRESKY COURT
WHEREAS, by Ordinance .No. 1605 N.C.S., Assessor's Parcel No.s
007-471-36,37 and 38 were rezoned to P.U..D. °(Planned Unit Development);
an d
WHEREAS, by action taken on February 12, 1985, the Planning
Commission recommended adoption of the final unit development plan in said
Planned Unit District; ~
NOW, THEREFORE, BE IT RESOLVED that the final unit development
plan on file in the Office of Community Development and Planning is
hereby approved pursuant to Section 19A-504 of Zoning Ordinance No. 1072
N. C. S. , as amended; and,
BE IT FURTHER RESOLVED that the City council hereby adopts the
findings of the Planriing Commission as its findings as stated hereinafter:
a) Said plan clearly results in a more desirable use of land and a better
physical environment than would be possible under any single zoning
district or combination of zoning distriets.
b) P. U. D. District is pr-oposed on property which has a suitable
relationship to one (1) or more thoroughfares; and that said
thoroughfares are adeqiiate to carry any additional traffic generated
by the development.
c) The plan for the proposed development presents a unified and
organized arrangement of buildings and service facilities which are
appropriate in relation to adjacent or nearby properties and that
adequate landscaping and/or screening is included if necessary to
insure compatibility.
d) The natural and scenic qualities of the site are protected, with
adequate available public and private spaces designated on the Unit
Development Plan .
e) The development of the subject property, in the manner proposed by
the applicant, will not be detrimental to the public welfare, will be in
the best interests of the City and will be in .keeping with the general
intent and spirit of the zoning regulation of th City of Petaluma, with
the Petaluma General Plan, and with the Environmental Design Pl~an
adopted by the City.

BE IT FURTHER RESOLVED THAT THE City Council hereby approves
the development glan; _ subject to the conditions hereinafter set out as
follows:
1. The site plan:, landscape plan, and building :elevations are subject to
review and eon•d'it'ional approval by SPAR"C-. These plans, once
approved by` SPARC,; shall become the PUD development plan for the
project site.
2. The large pine tree: existing near the pr.oject ;site's northern property
line shall be retained .unle5s recrioval is~ unavoidable due to possible
hazards as determined by the Director of Community Development.
3. The remainder of larid along Kresky C`ourt shall be either merged with
an adjacent property~ by a lot line adjustment :or replanted, irrigated,
provided with access through the project site by a locked gate, and
maintained by the property owner.
4: The arcades (.coy:ered walkways) shall meet the requirements of the
Chief Building Insp.ec:tor.
5. Mailboxes are subject to approval by the Post; Office.
6. T.he three pa~rcels contained in the project site shall be merged prior
to issuance of a building permit.
