S. of the City of Petalurna, California ~EB 19 1985 ~ ~ A RESOLUTION APPROVING THE UN'IT' D;EVELOPMENT PLAN , FOR THE SOUSA S'U:B'DIVISION, ~ A 3b UNIT .CUSTOM HOME SIN:GLE-FAMILY SUBDIVISION, LOCATED IN THE VICINITY OF MAGNOLIA AVENUE, SCHUMAN LANE, ELM DRIVE AND PAULA LANE WHEREAS, by Ordinance No. 1606 N. C. S.. , Assessor's Parcel Numbers 6-401-02, 05 and 06 and 6-411-01 have been rezoned to Planned Unit Development; and WHEREAS, by action taken on Jariuar.y 22., 1.9'85', the 'Planning Commissio:~ considered and forwarded a recommendation to: the City Council on the revised unit development_ plan .for 36 single-family •; units in said' PT~inneel Unit District; and ' ' WHEREAS:, The City Council finds that the requirements of California Environmental Quality Act Guidelines Section 15~083 have been satisfied and hereby incorporates by ~reference the direction to prepare a Notice of Determination based on the previously .cer'tified EI-R approved by Resolution No. 7974 N.C.S. No~ember 7, 1977. and 'Reso. 85-50 NC$ February 19, 1985. NOW, THEREFORE, BE IT RESOLV-ED that the unit development plan is hereby approved pursuant to 5ection 19A504 bf . Zoning Ordinance No. 1072 N. C. S. , as amended; and, BE IT FURTHER RE50LVED that the City Council hereby adopts the following .findings,: 1. The plan clearly results in a more desirable use of land and a better. physical environm`ent t'han would be possible under any single zoning district or combination of zoning dis"triets. 2. T.he PUD District is proposed on property which has a suitable relationship to one (1)' or more thoroughfares; and that saici thoroughfares are adequate to carry any additional traffic generated by the development. The plan for the proposed development presents a unified and. organized arrangement of buildings and service facilities which are appropriate in relation to adjacer_t or nearby t~roperties a.nd that adequate landscapin~ and/or screening is includ.ed if necessary to insure compatibility. 4. The natural and scenic qualities of the site are protected, with adequate available public and private spaces d.esigned on the tlnit Development Plan. 5. The development of the subject property, in the manner proposed by the applicant, will not be detrimental to the public welfare, will be in the best interests of the City and will be in keeping with the general intent and spirit of the zoning regulation of the City of Petaluma, the Petaluma General;, Plan, and with the Environmental Design Plan adopted by the City. ~ BE IT FURTHER RESOLVED that the City Council approves the development plan subject to the following conditions : CONDITIONS: 1. The project sponsor shall be required to pay low and moderate income housing in-lieu fees of an amount to be determined according to the schedule established by City Council Resolution No. 84-199 N. C. S. , or make alternative arrangements to meet the low and moderate income housing provision requirements of. the Housin~ Element subject to approval of the City and prior to approval of the Final Map . 2. The proposed Improvement Standards shall be adopted in-principal as part of the proposed PUD unit d.evelopment plan; however, they shall also be subject to the approval of SPARC, at which time revisions mav be suggested. A copy of the final approved Imp.rovement Standards, with any required revisions shall then be submitted to the Community Development and Planning Department prior to approval of. the Final n~ap . Pa~e 2 of 5 Reso. 85-63 NCS Including Exhibit A i 3. The project CC & R's shall be approved by City staff prior to the approval of the Final Map. 4. Prior to Final Map approval of Phases II & III, the developer shall employ, subject to City approval, a certified arborist, horticulturalist or £orester to prepare a comprehensive survey of the Eucalyptus grove to include, but not be limited to, a plan for. pruning and removal of trees, and a long-term plan for phasing-in replacement species. The plan shal.l be subject to staff approval, and become part of the development standards of the PUD . 5. The CC&R's for. those properties in the p,rove shall be amended prior to Final N1ap approval to include lanUuage ad.vising prospective property owners of the nature of the Eucalyptus trees, the need for regular maintenance and requirements of the "grove ;plan" regarding removal and replacement of trees . r 6. The CC&R's shall be amended prior to Final Map approval. to establish regulations by which the Sousa Subd.ivision Improvement Committee is authorized to require its approva] for the removal by a property owner of any existing tree in the grove not already desi~nated for. removal in order to construct a home on the lot or by the "grove plan" , and. to monitor compliance with the plan developed for the maintenance and reforestation of the grove. 7, Roof and yard drains to be tied into storm drain system . 8. Stop signs to be installed at Elm/Birch intersection sul~ject to approval Traffic Committee . 9. An outside consultant will be retained to verify adequate draina~e system capacity to insure minimum run-off to adjacent parcels subject to staff review and Council approval prior to final map.
