HomeMy WebLinkAboutResolutions 85-064 N.C.S. 03/04/1985- _^ . l~esolution No. 8 5-6 4~, ~, S. of the City of Petaluma, CaTifornia RESOLUTION APPROVING TENTATI.VE S:U"BDIVISION MAP FOR THE SOUSA SUBDIVISION WHEREAS, Jonas Sousa as owner(s) and Suhdivider(s) has filecl with this Council a tentative map pr.oposing to subd:ivide land within this City to be known as the Sousa Subdivision, and have paid all required. filing fees; and, ~ WHEREAS, the City Enginee.r, the Director of Planning, the Sonoma County Water Agency, and the Planning Commission have examined and reviewed the same as required by law and all reports, recommendations, and comments thereon have been forwarded to and considered by this Council at its meeting held on February 19, 1985. NOW, THEREFORE, BE IT RESOLVED that this Council hereby finds as follows : 1. The ~roposed. subclivision, together with provisions for its desip;n and improvement, is consistent with the General Plan. 2. The proposecl subdiv~ision is compatihle ,with the objectives, pol~icies, general land uses, and programs specified in said General Plan. 3. The site is physically suitable f.or the type of development proposed. 4. The site is physically suitable for the proposed density of development . 5. The design of the Subdivision and the proposed improvements therefor will not cause substantial environmental damage, and no substantial or 'f4 avoidable injury will occur to fish or wildlife or their habitat . 6. The .design ~f the Subdivision and the type of improvements will not cause serious public health problems. •Reso. No. 85-64 N.C.S. , , ~ 7. The design of the Subdivision and the type of improvements proposed will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision . ~. The discharge of waste from the proposed subdivision into the existing community sewer system will not result in violation of the existinQ requirements prescribed. by the Re~ional Water Quality Control Board. BE IT FURTHER RESQLVED, that the Engineer's conditions as set _forth below ~hall be satisfied: E1. Three existing houses are shown on the tentative map. F,xisting sanitaxy sewer and water service to these build.ings shall be shown . If service is provided by septic tanks and wells, they shall be shown along with a note statin~ their disposition (e.g., to be abandoned or removed) per Petaluma I~Runicipal Code §15.08.2?.0 Cross-Connections - Premises with additional water and §20.36.060 Sarzitary Sewer Facilities. E2. The tentative map shall be revised to reflect the existing 4?," diamete.r storm drain in Magnolia Ave. and the proposecl 21" diameter RCP connection . E3 . Storm drainage calculations will be r. equired at the time the final map is submitted verifying the adequacy of the system and the elepth of flow in the gutters. Additional storm drainage improvements (such as gutter channelization) may be reauir.ed to insure the storm water will be contained before it crosses Elm St . E4. The developer shall comply with the Petaluma Municipal Code Section 20.36.030. "20.36.030 - On and/or off-site ~rading and drainage. The subdivider shall p.rovide on-site grading and on-site and/or off-site drainage, all of which shall take into consideration the d.rainage pattern of adjacent property and shall treat upstream areas, where appropriate, as though fully iznprovecl. For those residential projects which drain into the Petaluma River above the Washington Street Bridge and which cause an increase of normal runoff in excess of two acre feet, the subdivider shall provide on or off-site detention areas to accommodate such run-off . " The tentative map does not. indicate on or off-site drainage areas. The developer shall pay in-lieu-of fees as calculatec~ in Chapter 17.30 of the Petaluma Municipal Code. E5. The proposed 12" diameter water main from MaPnolia Ave. to Schuman Lane through the proposed development shall be built with the fir. st phase. E6. Fire flow calculations shall be required at the time the final map is submitted to verify adequate protection . E7. All houses constructed above elevation 160 feet shall have a water pressure system installed for each unit to maintain adequate house pressure. The pump for each lot must not be attached to any pipe directly connected to the water main or service pipe. Such pumpin~ or boosting of pressure shall be done from a sump, cistern or storage tank which may be served by, but not directly connected with the water system distribution facilities, i. e. , that is there must be an air gap between the pump and the water meter. The City will not own, maintain or accept responsibility for the private pressure system on each lot over. contour 160 feet. E8. All publicly owned and maintained sanitary sewers and water mains located on private property shall be contained in its own 10' paved d.edicated easement. E9. A soils report for this project shall be submitted with. the .final map and the date it was prepared stated. on the tentative map. (This report must be less than two years old. ) . ~ .. E10. A tempo.rary turn-around shall be provided at the end of. the portion of Blossom Court constructed in Phase 1 to provide emergency vehicle access. E11. The proposed location of the sanitary sewer appears to be uphill of several lots and must be relocated to avoid excessive depth. E12. A curb inlet at the northwest corner of. L,ot 7, Phase 1 is requir. ed. E13. Preliminary landscape plan has not been included. E14. The present width and grade of adjacent or. abutting roac~s and their status (public or private), shall be shown bn .the tentative map. BE IT FURTHER RESnLVED, that the C'ity Council finds that the requirements of Calif.ornia Environmental Quality Act Guiclelines Section 15083 have been satisfied and hereby incorporates by refe.rence the findings of the Notice of Determiriation based on the previously certified EIP. for the project as approved by Resolutions No. 7974 and 85-50 N.C.S. BE IT FURTHER RESOLVED, based on the findings set forth above, that the above ref.erenced tentative map be and the same is hereby approved as diagrammed in the attached Exhibi.t A. 85-U64 ccreso Under, the power and authority conferred upon this Council •by the Charter of said City.
