S. of the City of Petaluma, California A RESOLUTION APPROVING THE U;NIT DEVELOPMENT PLAN FOR CAPRI CREEK, A 52-UNIT ATTACHED SINGLE=FAMILY SUBDIVISION NORTH MCDOWELL BOULEVARD, SOUTH OF THE ROYAL OAK MOBILEHOME PARK WHEREAS, by Ordinance No. 1607 N. C. S. , Assessor's Parcel Number 137-060-30 has been rezoned to Planned Unit Development; and WHEREAS, by action taken on December 11, 1984, the Planning Commission considered the unit development plan for 52 single-far.~ily units in said Planned Unit District; and WHEREAS, The City Council finds that the requirements of California Environmental Quality Act Guidelines Section 15083 have been satisfied and hereby incorporates by r.eference the Negative Declaration approved by Resolution No. 85-55 N. C. S. NOW, THEREFORE, BE IT RESOLVED that the unit development plaxi is hereby approved pursuant to Section 19A504 of Zoning Ox-dinance No. 1072 N. C. S. , as amended; and, BE IT FURTHER RESOLVED that the City Council hereby adopts the following findings: 1. The plan clearly results in a more desirable use of land and a better physical environment than would be possible under any single zoning district or combination of zoning districts. 2. The PUD District is proposed on property which has a suitable .'relationship to one (1) or mor.e thoroughfares; and; that said thoroughfares are adequate to carry any addi'tional traffic generated by the development. 3. The plan for the proposed development presents a unified and organized arrangement of buildings and service facilities which are appropriate ~in relation to adjacent or nearby properties and that 1 fteso::85=65 NCS 1 of. 5 incl. exhibit , ~ adequate landscaping and/or screening is included if necessary to insure compatibility. 4. The natural and scenic qualities of the site are protected, witn adequate available public and private spaces designed on the Unit Development Plan. 5. The development of the subject property, in the manner proposed by the applicant, will not be detrimental to the public welfare, will be in the best interests of the City and will be in keeping with the general intent and spirit of the zoning regulation of the City of Petaluma, the Petaluma General Plan, and with the Environmerital Design Plan adopteu by the City. BE IT FURTHER RESOLVED that the City Council approves the development plan subject to the following conditions : CONDITIONS: 1. Building Type IV located along Maria Drive shall be redesigned to substitute a four-plex and a duplex for the eight-unit building subject to the approval of the Community Development and Planning Department. 2. The multi-use area shall be re-located along Capri Parkway. 3. Paving materials used for parking cut-outs and the so-called "soft pathways" along the private streets shall be subject to the approval of SPARC . 4. The sidewalk along Capri Parkway shall be redesigned to undulate through the adjacent landscaped areas to establish a more inforr~~al pathway as well as provide landscaped areas (and particularly trees) closer to the street. In addition, contrasting paving stones or textured concrete shall be used to demarcate crosswalks on privat~ streets subject to the approval of SPARC. 2 r~:eso. 85-65 NCS 2 of 5 including exhibits 5. The design and materials of the play structure in the multi-use area shall be subject to approval of SPARC. 6. Building architecture, exterior materials and colors shall be subject to approval of SPARC. 7. Landscaping and ixrigation design and materials shall be subject to approval of SPARC . 8. The project CC & R's shall include the following provisions: l. Garage conversions are prohibited. 2. No recreational vehicles, boat trailers or disabled vehicles are permitted in private open parking areas or common parking areas, except temporarily in areas expressly designated oz~ approved unit development plan or driveways and then not to exceed 48 hours. 3. Home occupations permitted subject to the regulations of the Petaluma City Zoning Ordinance and provisions of the CC & R's. 4. All landscaping and irrigation systems in the public right-of-way and in common parking or yard areas shall be maintained by a homeowners association, and shall be designed and maintained to standards acceptable to the City of Petaluma. 9. The CC & R's shall be approved by City staff prior to approval of the Final M ap . 10. The project shall pay flood mitigation fees subject to the provisions of the Petaluma Municipal Code. lI. The project sponsor shall be required to pay 1ow and moderate incorne housing in-lieu fees of an amount to be determined according to the schedule established by City Council Resolution No. 84-199 N. C. S. , or make alternative arrangements to meet the low and moderate income 3 Reso. 85-65 NCS 3 of 5 inclluding e~ibits housing provision requirements of the Housing Element subject to approval of the City and prior to approval of the Final Map . 12.
