KESOLUTION OF THE CTTY_ COUNCIL DENYING
APPEAL OF PLANNING COMMISSION DENIAL OF
3M NATIONAL ADVERTISING COMPANY USE PERMIT
WHEREAS, on August 15, 1984, the 3IV1 . Nat-'iornal Advertising Company
applied for a use permit ~allowing a billboard-type. outdoor advertising
,
structure in a NorthWestern Pacific Railroad right-of-way app.roximately 500
feet east of the 101 freew;ay right-of-way; and
WHEREAS, City staff recommended denial of the application and `appeal in
oral testimony and written staff reports.
WHEREAS, the Petaluma Planning Commission held a public hearing on this
matter on January 8, 1985, during which time written and oral evidence was
received and considered by the Planning Commission; and
WHEREAS, after said public hearing, the Planning Commission voted 5 to 2
to deny said application for a use permit; and
WHEREAS, the applicant- filed an appeal of the Planning Commission decision
to the Petaluma City Council; and
WHEREAS, on February 19; 1985 the Gity Council held a public hearing
at which written and oral evidence of the Planning Commission hearing and
decision was received;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Petaluma hereby denies tlie appeal by 3M National Advertising Company of
the Planning Commission decision to deny the application of 3M for a use
permit for the erection of an outdoor advertising structure located
approximately 500 feet easterly of 101 Freeway right-of-way within a
Northwestern Pacific Rail'road right-of-w.ay, subject to the following findings

based upon all written and oral evidence gresented:
1. The proposed sign and sign -:location is contrary to the goals and
policies of the General Plan and Environmental Design Plan because it
would detract from the attractiveness of a City gateway, the Lakeville
Highway corridor.
2. The proposed sign is detrimental to the public health, safety and
general welfare because it would detract from, the attractiveness and
orderliness of the City's appearance and detract the vision of motorists
in a detrimental manner .
3. The proposed sign is located so as to have the advertising thereon
viewed primarily from a main traveled roadwa.y of a landscaped freeway
or the ingress or egress ramps thereto.
4. No Conditional Use Permit may be granted for the proposed outdoor
advertising structure pursuant to Zon'irig, Ordinance Section 26-505,
because it does not conform to the requirements or intent of the
Zoning Ordinance and the Petaluma General or Environmental Design
Plan pursuant to Zoning Ordinance Section 26-5:05.
