S. ~ of the City of Petaluma, Calif.ornia A RESOLUTION APPROVING THE U:NIT D.EVELOPMENT PLAN FOR TRANS-WEST DEVELOPMENT;, A" 10-.UNIT ~ MEDICAL OFFIGE CONDOMINIUM SUBDIVISION IN' T'HE VICIN'ITY OF E. WASHINGTON STREET EAST OF S. MCDOWELL` WHEREAS, by Ordinarice rN;o. 160~ N. C:'S. , Asse`ssor's `._ Parcel Number 149-122-40 has been rezoned to Planned Unit Development; and WHEREAS, by action taken ~on Jariuary 8,, 1985, the Planning Commission considered and forwarded a recommendation ~to .;the; City Council on the unit development plan for 10 professional office uriits in said Planned Unit District; and WHEREAS, The City Council finds that the r,eqtairements of California Environmental Quality Act Guidelines Section 15083 have been satisfied and hereby incorporates by reference the Negative Deelaration approved by Resolution No. ~5-34 N. C. S. NOW, THEREFORE, BE IT RESOLVED that the unit deveiopment plan is hereby approved p,ursuant to Section 19A504 of Zoning Ordinance No. 1072 N. C. S. , as amended; and, BE IT FURTHER RESOLVED that the City Council hereby adopts the following findings; 1. The plan clearly results in a more desirable use of land and a better physical environment than would be possible under any single zoning district or combination of zoning districts. 2.. The PUD .'District is proposed on :pr,oper~ty w.hich has a suitable relationsYiip to, one (1) or more thorou~ghfares; and that said thoroughfares ar-.e adequate to carry any addi.ti.onal traffic generated by the development. 3. Th,e plan for the pro,posed develo.pment presents a unified and ~ or;gani'zed arrangeriient' of buildings and service facilities whieh are ~1. ~: ~~ Reso. 85 J4•d~' NCS 1 of 3 appropriate in. re`lation to adjacent; or. nearby properties and that adequate landscapirng and/or screenxn.g- is inclu'ded if necessary to insure, compatibility. 4. The natural and scenic qualities of tlie site are protected, with adequate available public and private spaces design'ed on the Unit Development Plan,. 5. The development of the sub.ject property, in .t•he manner proposed by the applicant, will not be detrimental to the public welfare, will be in the best interests of t'he Ci~ty and will be in keeping with the general intent and spirit of tlie z,oning r.egulation of the City of Petaluma, the Petaluma 'General Plan, and, with the -Environmental: Design Plan adopted by the City. BE IT FURTHER RESOLVED that trie City Co.uncil approves the development plan subject to the following conditionss 1. Conditioris, coveri:ants and r.estrictions sliall be prepared and shall be subject to .review 'and approval by the Community Development and Planning Department an,d the City Attbrney prior to Final Map approval'. 2. The applicant shall provide a perpetual maintenance plan for the maintenanee of all_ landscaping-, irrigation, fencing; and paving within the common area subject to appr_oval of :appr-opriate City staff prior to Final Map :approval. 3. The exist'ing site 'improvements, ~ including;: fences, pa•rking spaces, pathways, lan'dseaping, trash bin enelosures and circulation patter.ns shall be sub:ject to review by the S'ite :Plan and. Architectural Review Gommittee (5PAR"C) arid approval as to n eeded up.grading and/or improvements pursuant to Zoning Ordinance Section 26-401, prior to final map approval.~ ~~ Reso;, 8;5;-4~O~NCS 2 o"f 3 , `:r• 4. Appropriate sig-ning and. pavernent marking shall }~e installed to clearly identify the east side driveway as "ENTER ONLY" as originally designed, to the satisfaction of the City' Engineer. 5. The project will provide adequate handicap accessibility to the units in accordance with City and State law,s,,- prior to.~final map approval. 6. The project will provide _separ.ate . mefering and billing systems for provision of water :and power services, ,subject to review and approval of the City BuiYding 'Inspector-, -.prior ~'to final map approval. Tize project will comply with all applicable Building/Fire Code regulations. 7. The project shall comp'ly with all site' impr.ovements as required by the Site Plan and Architectural Review .Gommittee ( SPARC ). 8.
