ADOPTING A C.ONFLICT OF INTEREST CODE FOR
EMPLOYEES AN, ~D OFFICIALS OF THE CITY OF PETALUMA
AND REPEALING RESOLUTION NO, 887U NCS
WHEREAS, Sections 87300-87302 of the California Government Code
(The Political Reform Act of 1974) require local agencies to adopt a Conflict
of Interest Code for employees and city officials who may be involved in
business activities which could create a conflict of interest with their public
responsibilities; and,
WHEREAS, the California Fair Political Practices Commission has
adopted advisory guidelines designated as California Administrative Code
Section 18730 which, if adopted by reference by a local agency along with
supporting designations will constitute an adequate Conflict of Interest
Code;
NOW, THEREFORE, B:E IT RESOLVED that Section 18730 of the
California Administrative Code is hereby adopted and incorporated by
reference herein as the Conflict of Interest Code for the City of Petalurna;
and,
BE IT FURTHER RESOLVED that the documents designated Appendix A
and B attached hereto and incorporated herein by reference are hereby
adopted as the appropriate designation of employees and officials and of
disclosure categories for said persons pursuant to said Conflict of Interest
Code; and,
BE IT FURTHER RESOLVED that as stated in Section 82011 of the
Government Code, the Fair Political Practices Commission is the Code
reviewing body for the City Council; the City Couricil is the Code reviewing
body for the remainder of Cit"y Officials and employees, and the City Clerk
shall retain all original documents required to be filed with the City Council
as required by law; and,
BE IT FURTHER RESOLVED that the City Manager may , designate
employees to be immediately subject to. the disclosure requirements of this;
Code upon a change of circumstances or assigriment: ~~as described • in

Council or the Commission, as appropriate, witliin ninety {90) days after
such change is effective;, and,
BE IT FURTHER RESOLVED that Resolution No. 8870 N.C.S. which
pre.vioitsly adopted the Gonflict of Interest Gode for city employees and
officials is hereby repealed,.

that are of sueh scope. that the Consizltant is required to comply with the
d:isclbsure requirements d'eseribed in these categories . Such determination
sfiall iiiclude a description of: the eonsultant's duties and, based upon that
description a statement of the extent of disclosure reqirements. The City
Manager s.hall forward a copy of fhis determina~tion, to the City Council.
Notliing herein excuses anp such consultant from any other provision of

APPENDIX B
G,eneral Provisions
When a designated employee is required to disclose investments and
sources of income, he./ she need only disclose. investments in business ~
entities and, sources of income which do business in the jur-isdiction, plan to
do business -in the jurisdiction or have done business in the jurisdiction
within the past two years. In addition to other activities, a business entity
is doing business witYiin the jurisdiction if it owns ;real property within the
jurisdiction. When a design'ated employee is~ required to disclose interests
in real property, he need only disclose real ,pr.operty which is located in
w'hole or in part within or no more . than two miles outside the boundaries of
the jurisdiction or within two miles of ariy land o.wned or used by the local
government agency. The employee's owned, principal residence need not be
disciosed, unless it is a part of a parcel of income property (e. g. , a
duplex) .
Designated employees shall disclose their financial interests pursuant to
the appropriate disclosure category as indicated in Appendix A. Employees
holding more than one position may file gne disclosure statement covering all
categories designated for all pos'itions held.
Disclosure -Categories ~
Category 1: All investments and sources of income.
Category 2: All interests in real property.
Category 3: All 'investments, interests in. real property and sources
of iricome subjeet to the r.egulatory, permit or licensing
authority of the department:°
Categor_y 4: Investrnents in business 'entit'ies and sources of income
which engage in larid develo.pm'ent, construction or the
acquisition or sale of real property.
Categary 5; Interests in real property located w'ithin two miles of
~ - ariy land owned or used by the City.
