J~. ~ of the City of Petaluma, California A RESOLUTION APPROVING A REVISION TO THE DEVELOPMENT PLAN FOR LAKEVIL'LE SQUARE APARTMENTS LOCATED AT ELY BOULEVARD SOUTH (FUTURE EXTENSION) AND FRATES ROAD - ASSESSOR'S PARCEL NO. 17-040-12 WHEREAS, by Ordinance No. 1564 N.C.S., the area represented by Assessor's Parcei No. 17-040-12 was rezoned to Planned Unit Development; and WHEREAS, by action taken on February 14, 1984, the Planning Commission recommended revision of the revised final unit development plan in said Planned Unit Zone as follows: Motion introduced by Commissioner .Popp, seconded by Commissioner Head that the Commission recommend to the City Council th;at applicant's request: (l) to reduce the size of clubliouse not preclude interior redesign of office facilities or sauna areas, (2) that the laundry room be attached to building 40, (3) that proposed PUD development plari revision for location and setbacks of buildings 13, 15, 35a, 35b, and 44 and 45 be approved subject to the following conditions: NOW, THEREF'ORE, BE IT RESOLVED that the revised unit development plan on. file . in the Office of the Community Development and Planning is hereby approved as recommended as the final Unit Development Plan pursuant to Section 1~9A-504 of Zoning Ordinance No . 1072 N. C. S.,~ as amended; and BE IT FURTHER RESOLVED .that the City Council hereby adopts the following findings: 1. The plan clearly- :results in a~more desirable use of land and a better physical environment than would be possible under any single. zoning district or combination of zoning districts . 2. The P. U. D. District is .proposed on property which has a suitable . relationship to one (.1) or more thoroughfares; and that said thoroughfares are adequate to carry an-y additional traffic generated by ~ the development. . 3. The plan for the proposed development. .presents a unified and organized arrangement of building_s and service facilities_ which are appropriate in relation to adjacent or nearby properties ancl that adequate landscaping and/or screening is included if necessary to insure compatibility. Reso. 84-34 NCS Page 1 of 2 4. The natural and scenie qualities of the site are proteeted, with adequate availa;ble public and private spaces designated on the Unit Development Plan. 5. The development of the subject property,, ,in the manner proposed by the applicant., will not be detrimental to the public welfare, will be in the best interests of the City and will be in keeping with the general intent and spirit~ of the zoning regulation of the Gity of Petaluma, with the Petaluma G~eneral P.lan, and with the Environmental Design Plan adopted by the City. BE IT FURTHER RESOLVED T.HAT the City Council hereby approves the development plan, subject to the following conditions: 1. All original conditioiis- of approval as contained in Council P.esolution No. 9959 N.C.S: November Z, 1983, are hereby incorporated by reference except as amended below. 2. Original condition 26a shall b.e amended to ,exemp.t buildings 35a and 35b from 13 foot minimum setback from curb line of parking area. 3. The applicant slia°ll w'ithin thirty (30) days•~after SPARC approval submit to the Community Development and Planning D.epartment sepia prints of the following- plans , which reflect al-1 conditioris of approval of the project (PUD Rezoning. and SPARC Review,) which can be reflected on the plans and/or maps: Site DeveYopment Plan and Master Site Landscape Plan showing entire project,, specific plans for Ely Bou•levard/Frates Road' and building elevations.
