FLOOD4VAY AREAS WHEREAS, on Mar`eh. 15, 1982 the City Council authorized a request for Community Development Block Grant. funding to initiate a flood hazard . mitigation .program to p.ermit a voluntary Home Relocation Program to be created;. and, WHEREAS, on Novemb.er 8, 1982 the City heId a neighborhood meeting to discuss the concept of a voluntary Home Relocation Program, and, . WHEREAS, on Decen~b.er 20, 1982 and Novernber 1, 1983 the City Council did again r.equest additional funds from the Community Development Block Grant program to purchase lots in Madison Manor subdivision for home . relocation sites under this program, and, WHEREAS, On February 13, 1984 the City Gouncil reviewed the Draft Home Relocation Program containing the program objectives, policies and procedures for sueh a pr.og.ram, and WHEREAS, on March 14, 1984 the City held a second neighborhood meeting to review said. goals, policies and procedures and received neighborhood input thereto, ~ ` NOW, THEREFORE,. And to seek. review and approval of the Home Relocation `Program objectives, poTicies and procedures as necessary from the U. S. Depar•.tment H, U,.D. , and Sonoma County Housing Authority ,prior to: implementation;. F. To m'inimize or eliminate potential ,legal confli'cts arising from past or future fioods 'between the City and propertp owners voluntarily entering this progr.am, or renter.s residing in flood prone areas. III. Program Procedures City Owned Lot • A. City financial partieipation for relocation to City acquired lots in the Madison I~4anor . subdivision ~shall include: l. Purchase of new lot in Mad'ison Manor 2. Installation of new street, sidewalk, underground utilities and other public improvements per Ci~ty subdivision standards . 3. Removal of construction debr.is., finish .grading, installation of basic yard landscaping, driveways, sidewalks, rear and side yard .fencing to cur.rent aeceptable standards. i.e. , equivalent to typical simgle-family subdiVisiori. 4. Physically moving house and garage to new lot or build equivalent replacement garage-. 5. Installation of new foundation, ,ufility hookups, and repair of any damage to home or garage caused by the move, e.g., cracked plaster, broken windows, cracked chimney etc. 6. Moving selected household goods to a secure storage area and then to the relocated house when it is, ready for occupancy. 7. Securing necessary title reports and securing insurance on homes during move and repair period. 8: Cap abandoned utilities and clear debris from old lots. 9. Per Federal regulafion, provide up to $4,000 relocation and $5.00 moving~ expenses to each ,liome occupied by a renter household at the time the . home relocation is ear.ried out. Provide assistance in reriter reiocation as to finding alternative or temporary housing as needed. 10. Provision of: up : to $4,,500 per home .for owner occupied units to provide for temporary housing during house moving and~ rehabilitation period. City financial participation for relocation to non-City acquired lot shall include: 1. Contribution toward purchase of alter.native site and basic site improvements equal to the a~rerage purchase price of lot in Madison Manor .subdivis'ion plus average per lot cost for provision of public improvements, plus average per lot cost for provision of basic on-site improvements as in part A-3 above. 2. Contribution toward physically , moving house and garage to new site equal to average cos€ of moving home and garage to new lot in Madison Manor Subdi.vision (or actual cost if lower- ). Waive any administrative fees for said lots located in the City. 3. Contribution to replacement foundation, utility hookups and rep.air of damage caused by move iri amount equal to average cost of such improvements for home relocated to Madison Manor subdivision. 4. Contribution toward and moving household goods in amount equal to the a~erage cost, of movin.g household goods to home relocated to the Madison Manb""r' subdivision. 5. Securing necessary title reports, 6. Gapping abandoned utilities and clearing debris from old lot. 7. Per Federal regiilations, provide up to $4, OOD relocation and $500 moving expenses to each home occupied by a renter househoid at the time the home relocation is carried out. _ Pr.ovide assistance in renter relocation as to finding alternative or tempor-ary housing• as needed. 8. Provision~ of up to $4, 500 per _home for owner occupied units to provide for temporary hous'img during house moving and rehabilitation, period. Any or all' of this amount not required for temporary housing purposes shall be available to the owner occupant for use in addi•tional interior or exterior home improvements of a permanent nature. Owner Participation : C. Participation of prop:erty owner for r.elocation to City acquired lot in the Madison' Manor su.bdivision, shall 'include: 1. Provide alter-native hous'ing dur.ing house moving/repair process. Provide for moving of exterior/garden improvements which are desired for new lot, e;g~. ,: sheds, playhouses, swing sets, plants , decorative b'r-ick or rock work etc . which is not covered b"y: A-4 or B-2.above.. 3. Retain ownership of the property until rnove and rehabilitation completed orice final. agreement is execute'd. 4. It is the obligation of the owner to not force a tenant ( s) to vacate a house in order to facilitat:e 'a house relocation where a tenant has occupied the house fo""r a period of at least 90 dags prior' to init'iation of negoti`ations. 5. For reTocations wliich occur to lots not owned by the City it will be the r.esporisibi_lity .of the pr.operty owner to provide for all costs not covered by City agreement including such things as higher: land costs, moving costs, utility costs, site prepara.tion, etc. 6. It will be the~ . responsibili.ty of sueh property owners to secure the :necessary design amd engineering approvals, and permits fr-om the City, or Coitnty agencies as required for any lots not owned or offered by the City under this program. 7. Property owners wishing to relocate to a non City owned lot outside the C'ity will be_, required to negotiate and secure necessary sub.contractors needed to :perform. such work necessary to move and rei~nstall their relocated house, and ma:y be required to~ do so if~ such lot is locatecl inside the City . Relocatiqn Procedur.es ,sha1L proceed as follows: 1. City will conduct basic negoti.ations with all property owners in first phase, on a first-come-firs:t-served voluntary basis after duely, notifyin~ each proper.ty owner of the home relocation opportunity. , 2. City Council shall annually establish ' a.'priority re'location list . ' 'based upon availabTe funds, physical/engineering p"riorities, mix of° relocation types (cit,y lot,, . alternative lots). 'and ease of execution of .individual 1'etfers of agreement. 3. Lot selection (city lots') b,y, prop,erty owrier's will be accon~plished by random drawin:g of names at a public meeting .
