S: - of the City of Petaluma, CaTifornia RESOLUTION OF 'INTENTI'ON" WHEREAS, the, publi:c i,nterest~ and _cbnvenierice require- _ • . : _ ~ . the acquisition and corrst"ructi~on of` publ,ie offstreet parking- fac:ilities within the City of Petaluma ("City" hereafter), described on Exhibit A, attached hereto and made a part hereof. NOW, THEREE'ORE, BE IT RESOLVED~BY THE City Council of the City of Petaluma, Coiznty of Sonoma, State of California, as follows: . . 1. It is the intention.of the City CounciT to order the acquisitions and improvements set forth in Exhibit A.attached hereto to be made in the City of Petal:uma in an~Assessment District designated Assessment District No.. 14, all pursuant to the Municipal~Imp.rovement Act of 1913. The exterior boundaries of Assessment District No. 14 are her.eby specified and described to be as shown on that certain map now on.file in the office of the Clerk of the City of Petaluma entitl-ed "Proposed Boundaries, ~ Downtown Parking FaciT.ities, Assessment District No. 14, City of Petaluma, California." . ~ 2. The public interest and convenience require said acc~:isitions and construction of the improvements. 3. Assessment Di;s.trict N'o. 14 is the District to benefit by said acquisitions and improvements. The expense of.such acquisitions and improvements is he~reby made chargeable upon said District; provided that all public st.reets, alleys, easements and ways and all publicly owned property in Assessment District No. 14 in use i-n the.performance of a public funetion shaTl be omitted from said assessment hereafter to be made to pay the cost and expenses of said acqu_is'itions and,improvements. 4. The Clerk is hereby directed: (:1) to endorse his certificate evidencing the date and adoption of this Resolution of Intention on the original and copy of the.map of Assessment District No. 14; (2) to file the originaT of'such map in his office; and (3) within f:ifteen (15) days a-fter the adoption of ~ ~~ Reso. 84-78 ~CS Page l of 3 ; ~; . °,; . . • , , ,- % :. , .» the Re~solution Preliminarily Adopting, Confirming and Approving Engineer's Rep.ort and Appointing Ti~me and P1ace for'Hearing of Protests to Propo:sed Improve.ments and in no event later than ' fifteen (15) days pr.ior to such hea~ring, to file a cop.y of such map so endorsed in the r.ecords of the County.Recorder, County of Sonoma, State of California: 5. Notice i;s hereb:y given that serial bond's (the "Bonds") to represent unpaid"assessments, arid bea_r inter.est at the rate of not to exceed twe;lve percent (12%) per.annum., will be issued hereurider in the manner provided by Divi.sion 10 of the Streets and Highways Code, the Improvemerit Bond Act of 1915, and the last i:nstallment of such bonds shall mature in not to exceed thirty-nine (39.) years from the~sec'ond day of July next succeedirig ten (I0) months from thei:r date_ 6. Pursuant~to~ Section 8650.1 of the Cali,fornia Streets and Highways Code, the City Council may, but shall not be required to, dete~rmine. to: iSsue the 'Bonds, so that the principal amount of the.Borid"s maturing each year shall.be othe~r than an amount equal to an even a~n"nual propo:r.tion of the aggregate princip,al amount'~of the Bonds. 7. Pursuant to Part 16 of Division l0 of said Streets and Highways Code, the City Council intends to include in said proceedings an amount to c.reate a special reserve fund for the bonds to be issued in said proceedings to represent unpaid assessments. 8. It is the intention of the City.Council that the a:lternate.procedure for collectirig assessments and advance reti,rement of bonds as set forth in-Pa-rt 11.1, Division 10 of the~Ca~lifo;rnia Streets and Highways Code shall apply to the Bo:nd's . ~ 9.
