A RESOLUTION .APPROVING THE DEVELOPMENT PLAN
FOR CASA .DEL ORO SUBDIVISION, PHASE II
LOCATED IN THE VICINITY OF
CASA GRA~NDE ROAD AND SARTORI DRIVE
WHEREAS, by Ordinance No. ~ N: C.. S: , Assessor's Parcel
No. 017-040-45 was° rezoned .to Planned Unit, :Dev.elopment,; and
WHEREAS, by action. taken on April 24, 1984, the Planning
Commission recommended adoption of ~the final unit dev.elopment plan in said
Planned Unit Zone,
NOW, THEREFQRE, BE IT RESOLVED that the final unit
development plan on file in the Office of Gommunity Development and
Planning is hereby . approved pursuant to Section 19A-504 of Zoning
Ordinance No. 1072 N. C. S. ,"as amended; and,
BE IT FURTHER RESOLVED the City Council hereby adopts the
Findings of the Planning Commission as its findings as set out hereinafter:
1. The Development Plan clearly results in a more, desirable use of
land and a better physical environment than wou-ld be possible
under any single district or combinatiori of zoning districts.
2. The PUD District is proposed on. property which has a suitable
relationship to Casa Grande Roa'd and Sartori Drive, which are
adequate to carry any add'itional traffic generated by the
Development. ~

3: The developmeri,t plan. presents a unified and organized
a"rrangement of` buildings~ and ..service facilities which are
appropriate in relation to adjacent pro.perties, and adeq,uate
. landscaping is =pr.oposed,.
4. The natural' and~ scenic „'qualiti~es of the site~; are::; .protected, with
adequate avaiTable pizblic .and priva~t'e ~ spaces designated on the.

5.. The. developrnent of the ~ subject property, in the manner. proposed
by the ap.pli'can:f, will riot be~ detrimental t,o the public welfare,
will be in ~ the best interes.ts of the :City and will be in, keeping
with the general' .intent and, sp'iri't of the 'zoning~ regulation o€ the
City -of Peta~luma, with tlie •Petaluma Ge _neral ~ Plan, and with . the
Environmental Design Plan;, _ ~
6. The rezonin~g :is 'required by Zon'ing ,Ordinance' S'e.ction 19:A=100.

approves the development ,plan subject to the: condit'ions of approval set out
hereinafter. ~ '
l, The, PU.D ,d'eyelopment plan, inclu`ding, ~liousing models and
elevatioma, sha~ll be subject to design approval in accordance with.
Section 26-4;01 of~ the Zoning Ordinance. All conditions. of desig-ri_.
review shall 'become condi~tions of the P U. D:; zone~. ~
2. Any chamge's to the. Casa D.el Oro II, site plan or development plan

made pursuant- to these conditions or SPARC' coriditions of

approval, shall be reflected on ;a new dev.elopment plan., a sepia
print and one copy of wfiich sha11 be provided to the Department
of Community Development within thirty (30) working days after
final approval of such change(s).
3. Develo.pment standards for Casa DeT Oro II (e.g., building
~~ setbacks and height regulations-, allowable and conditional uses ,
ae'cessory buildings and/or dwelling uriits, home occupations, and
other such related standards and use's) shall be consistent with
I those applicable to the R-1 6500 Zoning District.

~ 4. If Covenants, Conditions and Restrictions (CC&R's) are developed
for Casa Del Oro II;, development standards no less restrictive
than those applicable to the R-1 6`500 Zoning District shall be
included therein.
5. Complete side and rea~r yard fences the same as those provided in
Casa Del Oro I shall be installed prior to occupancy of the
affected lots. Plarrs for said fences shall be subject fo SPARC
approval prior to the issuance of building .permits.
6. Lawns shall. be provided in all required front• yards and street
side yards of corner lots. Plans depicting said lawn areas shall
be approved by SPAR'C prior to `lawn ins,tallation..
7. The DB-103 (Sonoma Plan) two=bedroom modeFs shall not be
replaced with 3+ bedroom models.. The proposed DB=IOAE
(Farallon) three-bedroom/loft may be substituted for no mor.e than
nine ( 9') previously approved models con~.taining three or more
bedrooms. prqvided that the locafion. and ~DB-100E' model floor plan

i and elevations receive prior SPARC approval. If, ninety days
' from April 25, 1984, the two-bedroom models are not sold, the
two-bedroom models may be replaced with three-bedroom models.
I BE IT FURTHER RESOLVEp that 'fhe City Council finds that the

I requirements of Califo'rnia' .Environinental Quality, , Act ~Guidelines, Section
i 15083 have been " sati`sfied and hereby~ incorporates by reference the
~~ Environmental Impact Report adopted by Council :Resolution No. 8445 N.C.S.
in February 1979.
Under the power and authority conferred upon this Council by the Charter of said City.
