A RESOLUTION APPROVING A REVISED UNIT DEVELOPMENT PLAN
FOR .OAK CREEK APARTMENTS
LOCATED AT THE END OF GRAYLAWN AVENUE
(A.P. NO. 019-010-0'2)
WHEREAS; by Ordinance No. 1573 N . C.. S.. , a portion (1? . 56 acres )
of Assessor's Parcel No. 019-010-02 was ~r-.ezoned . to Planned Unit
Development .
NOW, THEREFORE, BE IT I'.ESOLVED that the unit development
plan previously approved for the project by .City Council Resolution No.
9628 N.C.S. is. hereby amended to permit open residential occupancy of the
apartments and the addition of thirty-eight parking spaces as described in
the. Planning Commission minutes of May 22, 1984 pursuant to Section
19A-504 of Zoning Ordinance No. 1072 N.C.S. , as amended; and,
BE IT FURTHER RESOLVED that the City Council hereby adopts
the findings of the Planning. Commission as its findings as set our
hereinafter:
1. The Development Plan clearly .results in a more desirable use of
land and a better physical envro`nmerit than would be possible
under any single district or combination. of zoning districts.
2. The PUD District is proposed on property which has a suitable
relationship to one (1) or more thoroughfares; and said are
adequate to carry any additional traffic generated by the
development .

3. The plan for the proposed development presents a unified and
organized arrangement of buildings and service facilities which
are appropriate in :relation to adjacent properties., and adequate.
landscaping- is :included to insure compatibility.
4. - The natural -and scenic qualities of the "site are. protected with
adequate available public and private spaces designated on the
Unit Development Plan.
5. The development of the subject property, in the manner proposed
by the applicant, will not be detrimental to the public welfare,
will be in the .best interests of the City and will be in keeping
wi"th the general' in"tent and spirit of the. zoning regulation of the
City of Petaluma", °with the Petaluma General Plan., and with the
Envi ronmental Design Plan.
BE IT FURTHER RESOLVED that the City Council hereby
approves the amended. Development Plan subject to the conditions set out
hereinafter
1. Parking area revisions shall be-subject to SPARC review.
2. Project applicant shall install within 120 days of commencement of
open occupancy a children's play area .including play apparatus
and open lawn. area subject to approval b.y SPARC.
3. All conditions of approval as" .stated in resolution save those
specifically revised herein shall remain in force.

BE IT FURTHER RESOLVED that the City Council finds that the
requirements of the California Environmental Quality Act Guidelines,
Section 15083 have been satisfied and -hereby incorporates by reference the
Negative Declaration adopted by Council Resolution. No. 9483 N.C.S. on
June 21, 1982. ~ -
