RESOLUTION RATIFYING MEMORANDUM OF UNDERSTANDING EXECUTED BY THE
DULY AUTHORIZED REPRESENTATIVES OF THE CITY OF PETALUMA AND THE
INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS, LOCAL 14.15 FOR THE
EMPLOYEES IN UNIT 7.
WHEREAS, the City, through its duly authorized representatives,
and the International Association of Fire Fighters, Local 1415, through its
duly authorized representatives, have concluded their mutual obligation to
meet and confer in good faith with respect to terms and conditions of
employment for employees in Unit 7, in accordance with the Meyers-Milias-
Brown Act and the City`s Employer-Employee Relations Rules and Regulations
(Resolution No. 5512 N.C.S.); and,
WHEREAS, the duly authorized representatives of the City and
International Association of 'Fire Fighters, Local 14.15 have executed a
Memorandum. of Understanding (dated June 25, 1984) pursuant to Section 15,
Resolution No. 5512 N.C.S. and recommend its approval:~by the City Council;
and,
WHEREAS, the City Manager, pursuant to Section 28, City of Petaluma
City Charter, and as the City's Municipal Employees'' Relations Officer
(Resolution No. 5375 N.C.S.) is required and empowered to make a recommendation
to the City Council on matters related to employees' compensation; and,
WHEREAS, the City Manager has reviewed and concurs with said
Memorandum of Understanding for Unit 7 and does recommend that the City
Council ratify said Memorandum of Understanding.
NOW, THEREFORE, BE IT RESOLVED that said Memorandum of Understanding,
being in the best interest of the City, is ratified and the terms and conditions
of said Memorandum of Understanding (as attached) shall be effective on
July 1, 1984, through June 30, 1985.

PREAMBLE
This document repr-esents the final and complete agreement resulting
from Meet and: Confer essons between the City of B'etaluma and
International Association of: Fire Fighters, Local. No. 1415 (Aetaluma) , Unit
7.
Representatives of the City and Unit T acknowledge that they have
fulfilled. their mutual and. respective obligations 'to I~Yeet and Confer under
the Nieyer-Milas-Brown. Act,. As a result, .the parties have come to a
mutual, understanding which the r.eprese"ntatwes of the City and Unit 7, w-ho
have the- approval of their metribers, ..agree to recommend for acceptance and
approval to' the .City :C'ouncl of .the City .of Petaluma.
'The parties affix. their signatures as constituting metal acceptance and
recommendation of~ this Memorandum of Understanding to become effective
July T, 19$4, upon. acceptance and approval of the City Council.
GENERAL
Section, 1 Term of A;greernent
- This b4'emorandum: ofUnderstanding shal'1 b.e_ for a o_ne (1 ), year term
for the period .commencing July 1, T984, thr..ough June. 30, 1985.
The parties will commence meeting and conferring for a subsequent
'Memorandum of U-nderstariding, .not later than the end of April, 198:5, and'
will endeavor to reach an agreement, .n a written Memorandum of
Understanding -for submission to the. City Council, for its Final Budget for
the subsequent Fiscal' Year:°.
,;Section 2 Work Week.
Duty Shifts :.
The -fire on-,d"ut~y 7 day- work week ;shall be .the average of 56.. Q :hours

per work week :for- all employees,. in this'. Unit;. Individuals within this unit
:may be, -reassi`gne'd' to a 40 hour work' week depending, upon the needs. 'of the
service,. Scheduled shfas. shall begin at 0800 and terminate "twenty-four

Section 3 Living Restrictions
The living .restrict-ion for members of the .City of. Petaluma. Fire
Department shall . be. thirty .(;30 )` minutes, A ;map will be prepared and made
available which illustrates. the extremities of the restriction.

A. Shift •
The members..:of~ the Fire Department:, when called: to: work an overtime,
shift, shall bey pad•~ on, an hour for hour basis 'rounded. to 't.he nearest
quarter, hour. at tike regular. shift. rates tunes 1.;51.. ' An overtime shift. is
defined as. any continuous period of': on'=.d'uty""` ttime exceeding. sixteen.
(.16) consecutive "hours which is not part. of~ the employee's regular
work schedule. 'T'his rate shall be. figured` on th'e regular number of

hour work week.. .~4n employee who :is assigned! to. such, call-back duty
shall receive., at minimum, six hours pay `at this rate. at time and
one-'half'.

Fire R;eeall and Special Recall
Off-duty Fire Department personnel are subject to recall and will be
paid on an overtime basis, {except as set 'forth in "A" and. "B"
above,) , at time and one-•half and hourly rate based. upon the 56 hour
work week.
However,. in no ease will they be paid .less than. two hours when
called .
Further, when fhe, complete recall exceeds two .hours, but does not
extend beyond fifteen. minutes past the. second hour,. the overtime: will
be ;for two hours., When a recall exceeds: two hours. and .fifteen
minutes,. the overtime will be to the nearest half hour (example, two
and one-half hour') .
Shift Continuation
If a member of this: unit is, requested to continue on duty after the;
end of a normal. 2.4-hours shift .and works in excess of 15 minutes,. he
shall; be paid at time .and one-half .for all hours worked based on a
56-hour workweek..
Further, when the completed o_ v.ertime exceeds 15 minutes within the
first hour but does not extend beyond qne hour.,. the overtime shall be
for one .hour. Beginning -with the second' hour overtime shall be paid
to the nearest one-half hour.
M°andated Certification T-raining
All Fire Departr.?ent personnel in this unit shall be compensated at time
and one-half of the employees hourly rate (b'ased. on a 56-hour work
week): for all off duty' time required to maintain department mandated
certifications .
Section. 6 Out of Grade Pay
A member :of' the. unit will be .compensated` fore working; at the :next
hg-her grade. Every assigned shift will. be' compensated at "th`at :next higher
grade at • an additional 5 0` over their regular rate of pay, as long as the.
individual is 'on an acting .list.

Section 7 Uniform Allowance
All. emp'1:oyees shall cornpiy with the uniform,/elotking requirements .and
procedures as established and administered by the Fire Chief'.
The Uniform/Clothing Allowance Program shall be paid in• :the Fiscal
Year of the.. Memorandum of Understandin on or befor.-e Se tember, 5, for

An employee w"ho termiia"tes from Gty' service 'or is released from City
service sh'a11 only .receive. a, pro rata. annual .amoun:t. An employee wh o so
.separates from City service after any payment has been made shall re turn
that portion of .the allowance; determined by th`e. 'ast day in "City service and
the end' of the fiscal year... Any employee. on leave of absence: without pay
or leave ~ status: in excess of thirty (30) calendar days shall: receive a pro
rata amount for. the fiscal. year..
Calculations shall be based on the firefighter salary as of. July 1,
1.984.
Section 8 Compensation for Glotliing Loss
The City :Manager is authorized to provide compensation to City
employees for loss or damage to their clothing which occurs during the
course of carrying out an official duty. A . request for compensation
hereunder shall be submitted in writing.,, in detail, to the City Manager via
the department head concerned. The amount of compensation.; if any, shall
be at the discretion of the City Manager.
This section applies to any member of the Unit whose duties ;are such.
that he is not required to :wear a uniform and is excluded from. receiving a
uniform allowance.
Section 9 Holiday •Pay
The holidays for the :calendar year shall be the total o f eleven (Ll)
the City shall pay .for these holidays no later. than December 10, in lieu of
giving time off .

Section 1'0' Vacation, Payment, at Termination
Employees who terminate emplogment slialT b,e paid in a lump sum for
all. accrued vacation. leave earned prior to, the effective date of termination
not to exceed two' (2) years accumulation
Section 11 Sick Leave Payme_n•t at Retirement
In the event of retirement, an employee. who has completed- ten (10 )
years or more with` -the G"ty shall receive fifty percent (50$) of his
accumulated but unused sick leave but not to exceed 720 hours..
Section 12 Education Reimbursement
The .City shall reimburse employees of" this unit for books and tuition
upon the satisfactory completion of the course. To be eligible for
reimbursemerit~, the ..course must.. be: (..a) fire related course; and. (b)
approved by the Fire Chief'.. Education for the department shall not exceed
the dollars; budgeted, by the City of Petaluma..
INSURANCE
Section 13 Health Insurance
Uiring the period of this. I~lemorandum of Understanding., the City shall
pay :any premium increases beyond the current' City contributions. as listed
below. No increase in the dollar amount: of .the. employee contributions shall

Section. 14, Dental Insurance
Tl.e :City shall provide for a group :dental 'insurance program for City
employees 'and dependents in this Unit:. The City shall pay, during, 19`84-8'5
the period of th'i's memorandum, th'e 'insurance premium in the amount, of
$3`5.5'6 per. employee; per' month.
S"ection 15 Life Insurance
They City shall provide during the period ~of: this Memorandum, at no
cost to the employee, a group term life insurance 'coverage in the principal
amount of $7, 500 per employee..
Section. 16 Long-Term Disability Insurance
Thee City shall pay during, the period o,f this ~ memorandum, the amount
of $17.8'0 per month;, per employee.. This. amount -shall not exceed,
however..., the. total cost of the premium for the: long-term disability
insurance plan..
LEAVES.
Section 18 Vacation
A. Eligibility
The. times during the calendar year in which. ~an employee may take his
vacation shall' be determined by the department head with due resp'eet
for. the wishes of th'e; employee and particular regard for .the needs of
the service,. If the . regiurements o,f the service are such that an.
employee cannot take part or all of his annual vacation in a particular
year:, suc

calendar year., New° emp~loy,ees shall, be allowed, to use their
accumulated" vacation.. prior to December 31 for vacation. in the
succeeding calendar year.

C . Deferral'

Any eligible employee. with the...consent of the head of his department
and the° Per.sonneT Office may defer 2.~5 shifts of his annual vacation. to
the. succeeding ~ calen;dar ye'ar', subj'.ect to the other provisions of this
rule. A written report of each deferred vacation signed by the.
appropriate department head and, the Personnel Office noting the.
details ~sh'all be kept on file with the Personnel, Office..
Section 18 Sick Leave
"A. General
Sick leave with 'pay shall.. be. granted to all. probationary and permanent
employees within the competitive service. .Sick leave" shall :not be
considered' as a right. which an, employee may use at< his discretion., but
shall be allowed, only. in case of; necessity or actual personal sickness,
disability, or• allowed"' by the Memorandum of Understanding,
'B . .Accrual.
Sick. leave for th. e° Fire Department: shall, be accumulated on the basis of
12 :hours per month. 'Fire- Department 40 hour employees shall
accumulate sick leave as other employees ~of the City.
C . Noti_ficatign, Procedures
In order to receive compensation w-bile absent on sick leave:, the
employee shah notify his immediate. superior- or the Personnel Office
prior. to or within four hours after this time set: for .b'eginning his
daily duties . or ~ as may be specified by the heard of his d'epartment.~
When absence 'is for more than three: 'shifts duration., the: employee. may
be required to file a physician's certificate wfh the Personnel Officer
statng• the cause of the absence.
~~ D . Rate. of Usage
The :first day of sick leave will; be charged against the emplgyee's
accrual at the rate of 12 hours. Each successive shift will be charged
at :the rate of one. shift (24 hours)'.;
E. Family Sick Leave
Leaves of absence up to four working shifts with; pay per year may be
granted to employees . in the event- of serious illness or injury in the
employee's immediate family and will be charged a•gains•t. sick leave.

difference between such workrne.n's compensation benefits paid and the

R4atters Subject to Grievance Procedure
Any employee in the competitive service shall have the .ri'ght to appeal
unde
r-- :this- .rule., a decision affecting 'h'is. employment over which his
appointing power has. partial or- complete jurisdiction and for which
appeal is not provided' .b,y other regulations or is not. prohibited .
Informal Grievance. Procedure
An employee who has a problem or complaint should first try to get it
settled: through discussion with his immediate supervisor without undue
delay. If ;: after this discussion, he does not believe. the problem has
been satisfactorily .resolved;, he shall. have the right .to discuss it with
his supervisor's :immediate supervisor, if any,: in the administrative
service,.. Every effort, should be made to find an acceptable solution
by informal means at the; lowers possible level of, supervision. If the
employee is not in agreement with the ~ decision reached by discussion,
he shall t<hen have the right to file a formal appeal in writing within
ten (1) calendar days after receiving the informal decision of his
immediate superior. An informal appeal .shall not be taken above the.
appointing power.
Formal ,Grievance Procedure (levels of review through chain of
command.
1. Frrst level of .review::. T:he appeal .shall b.e presented in writing. to
the employee s immediate supervisor, who hall render- his decision
and comments in writing; and return. them to the employee within
five (5) calendar 'days.- after' receiving the .appeal. If the
employee: does not agree with his supervsor.'s decision., or if no
answer has been ..received within. five {5) calendar days, the
employee may present; the appeal in writing to his supervisor's
immediate superior.. Failure of the employee to take fur-ther
action within. five ('5 )' calendar days after- receipt of the written
decision of his supervisor, or within- a total. of .fifteen (15)
calendar days if no decision is rendered, will constitute a
dropping, of the appeal...

3. Department Reviews The department head receiving the appeal of
his designated representative, should discuss zhe :grievance with
the employee, his representative;. if any, and with other
appropriate persons . The department .head - shall render his
decision and comments in writing , and return Them to the

employee within .:five ("5) calendar days after receiving the appeal.
If the employee does no agree with the decision.: reached, or if no
.answer has been received within five (5") calenrdar-- days, he .may
represent .the appeal .in, writing to .the • City Manager . Failure of
the employee to take further aaton..wi:thn (5') calendar days after
receipt of the deci-lion or within a total. of fifteen (15) calendar
days if no decision is rendered, will'. constitute a dropping of the
appeal.
4. City Manager: The. City Manager receiving the appeal or his
designated representative should discuss the grievance with the
employee, his representative, if any,, and with other appropriate

5. Conduct of Griev;anee Procedure
a. The time limits specified above may be extended to a definite
date by mutal agreement. of the employee and 'the reviewer
concerned.
b . The employee may request; they assistance of another person
of his own choosing in preparing and presenting his appeal.
