RESOLUTION ESTABLISHING SALARY AND' SUPPLEMENTAL WAGE
BENEFITS FOR MANAGEMENT EMPLOYEES, UNITS 8 AND 9
WHEREAS, fhe City Manager, -pursuant to - '
Section 28, City of Petaluma City Charter, is required
and. empowered to-make a recommendation to the City
Council on matters related. to employees' compensation;
and, _
WHEREAS, the City Manager has reviewed the
attached Exhibit "A" and Exhibit "B" and recommends
approval thereof,
NOW, THEREFORE, BE IT RESOLVED that. the
salary and, supplemental wage benefits as specified
in these attachments for Management Personnel are
approved and shall become effective July 1, 1984.
BE IT FURTHER RESOLVED that it is City
Council policy that ninety (90) days notice. is required
by either party (City Council and City ,Manager) prior
to termination of services between said parties..

This compensation plan shall be for a one (1) year term for the fiscal
year commencing- July 1, 1984, tlirough 7u~ne 30, 1985,

Section 3 , Compensation. for Clothing Loss
T,he~ Gty Manager-- is authorized to provide compensation to City
employees for loss or damage to their clothing which occurs during the
course of carrying out an official' duty. A req-nest for compensation
hereunder shall 'be- submitted in wri`tng,,.. in :detail., to the City Manager
via. the department head concerned:.. The amount of compensation, if
any,. shall be at the discretion of the City 'Manager.
Section 4,. Vacation., Payment at Termination
Employees who. terminate employment shall be paid in a lump sum for
all accrued vacation leave earned prior to the. .effective date of
termination not to exceed two (2) years accumulation...

Section 5. Sick .Leave..,: Payment of
In the event- of the death. or -retrem"eri~t of ari employee who has
completed ten. (10) or more years of continuous service with th;e City,
the employee should be paid or shall. receive to his benefit fifty
percent (:50$) of his ,accumulated but .unused sick. leave not to exceed
480 hours.
Section 6. Deferr,.ed Compensation
The City of Petaluma. shall make available to the members of this unit,

During the period of t°his Memorandum. of Und,e.rstanding, the City shall
pay any premium. increases beyond the current City .contributions as
listed. below., No increase in t°he dollar amount of the employee

Section 9. Lfe_ Insurance
A. Group Life. T,,he City shall: provide, at no cost:. to the employee,
group; term hfe insurance coverage in the principle .amount of

B . Mana ;emen,t Life:'. Insurance shall be in; the amount of one and
one-half , :1~~ times their annual, 'salary rounded to the nearest
even .dollar., i. e., $12,000, $13,000, etc.. not to exceed $100,000.
Section 10 , Long,-Term Disability
The City shall provide. along-term disability plan., premium 'to be paid
by the City..
LEAVE
Section 11. Vacation
A. Amounts.. All ;regular employees,.of the City of Petaluma, after
working one full year are entitled to the equivalent of eighty (80)
hours of vacation with pay in the. year following the year in
which vacation. is earned .
All. regular employees of the Gty of; Petaluma,. after five. (5)
years of continuous service- with the City, anal begrnning with the
sixth year, shall b_ e entitled to~ the equivalent of one hundred
twenty (12'0) houtrs of vacation per year.
After ten (10) years .of continuous service with the City, eight
(8) hours of vacation shall be added. for` each year of continuous
service to a 'maxrrmum of one hundred sixty (160) hours of
vacation .
Section 12. Sick Leave
A. Accrual. Sick leave- shall accrue to all full-time employees at the
rate of eight. hours for each ,month of continuous service. No
employee shall accumulate more sick -leave in any year than
provided .:

opinion the relationship of tle~ sick or disabled person to the
employee warrants such use of sick leave.
C. Relationship to. Workers Compensation. Benefits shall be. payable
in situations where. .employee :absence is due to industrial injury
as provided in California State Workers' Compensation Law. The
amount of. disability payments paid to the injured employee shall

be ~ded;ucted from salary payable to the employee while on sick
.leave., During .the: first three (•3.) calendar days of absence, fore
industrial' :d'isablity, employees wilh be compensated. at~ their full
rake of .pay without deduction, from, sick leave. unless they are
hospitalized;. Absences resulting. in immediate hospitalization or
absences eontiniing beyond the third day shall be charged
agaimst t'he employee at the rate of: one-half (1 / 2) day for each
da_y of absence credited: or compensated by .workers' compensation
insuramce;. provided the City receives. all .compensation paid by
workers' compensation payments only,, without City payment. for
salary at rio loss of suck ,cave. Sick leave for industrial injury
shall not be, allowed for a disability resulting from sickness;
self-inflicted. injury or willful misconduct.
All .employees receiving' full salaries in -lieu of temporary disability
payments pursuant to• Se'ction 48:50. Labor Code are entitled to
accumulate sick- ,cave during such. -periods. of disability .
Secton 13;, Bereavement Leave
In the ,event of the death. of an employee's spouse, .mother,
step-mother, mother-in-law, father., step-father,, father-in-law,
brother, sister,, child•,. 'including an adopted elld; grandchild and
grandparent; an employee who attends the funeral shall be .granted
time off work with pay,. The amount of time: off. -work with pay shall
be only that: which. is required to attend the funeral and- make
necessary funeral arrangements; but, in. no event shall it exceed three
(3) working, days. These three (3) days shall not be chargeable to
sick `leave . .An ,:additional two (2) days r.equre.d for necessary funeral
arrangements may, be charged to the. employees sick leave and any
additional time beyond. these two days may be charged to accumulated
vacation.:or leave without: pay . Such bereavement leave shall riot be
accruable from, =fiscal year to fiscal year, nor shall it have any
monetary "value if unused .
Section. l4. Holidays

Section 15., Military ,Leave
Military ;leave shall :be arranged in accordance with the. prov"isions of
State law.. All emp oyees en itled to military leave .shall- give. the
appointing. power an opportunity within the limits of military
regulations to determine when such leave shall be taken..
.Section 16. Leave, of Absence without. Pay
The City. Manager ma,y grant a permanent or probationary. employee
leave of absence without pay or seniority for a period not to exceed
three (3`) months.. .Goo.d cause 'being shown by a written request, the
City Manager may .extend: .the leave of absence without pay for an
additional period not to exceed. six: (6) months . No such leave shall be
granted. ,exceptt .upon written request of~ the employee setting forth the
reason. for the, request, and the approval will be in writing . Upon
expiration of a reg-ularly~ approved leave or within a, reasonable period
of time after notice to return. 'to duty, the. employee shall be reinstated
in the position held.. at the time leave- was. granted. Failure on the
part of an employee .on leave tb report promptly gat its. expiration, or
within -a reasonable t"ime after notice to return to duty, shall be cause
for discharge.
.Section 17. Jury Leave
Every classified 'emplo:yee of: the City who is called or required to
serve as a trial' juror shall be entitled. to absent himself from his
duties with the City . during th e ,period . of such service or while
necessarily being present in court as a result. of such call. Under
such. circumstances., the errmployee shall be paid the difference between
his full salary ;and any payment received by him,. except travel pay,
for such du,ty..
Section 18... Admini's,trafive ,Leave
Members of this unit are :eligible for 'adrrinistratve leave. Days may
be granted by the City Manager upon written request, not to exceed
ten .(TO'.) days ;per ;Fiscal Year.

Section 1. Term,:
This. compensation :plan shall be .for a one ('1,) year term, for the fiscal

Section 3. Compensation for Clothing, Loss
The City Manager is authorized to provide, compensation to City
employees for loss, or damage to their clothing. which. occurs during the
course of carrying out an official duty. A request for compensation
hereunder 's1a11 be submitted in writing, in detail,, to .the City' .Manager
-via the department head concerned. The amount of ,compensation.; f~
any; shall be ;at the discretion of •the City, .Manager.

Section 12. Vacation
A. Amounts. A11 regular employees •of the City' of Petaluma., after
workn,g: one full year are entitled' to the equivalent of eighty (80)
:hours of vacation with pay in the year following the year in
which vacation is earned..
All regular employees of the: City of Petaluma,. .after five (5)
years of •continuous service with the City., and beginning with the
sixth year, shall :be entitled- to the equivalent of one hundred
twenty (120) hours of vacation per year.
After ten (10) years of continuous service with the City, eight
(8) hours of vacation shall e, added' for each year of continuous
service fo a maximum of one hundred sixty (160) hours of
vacation .
B . Scheduling... The dimes during a calendar year in which an
employee .may take- .his vacation shall be determined, by the
department head with due respect for the wishes of the erriployee
and particular regard for the needs of the service:. If the.
r-equirements of the service- are such. than an .'employee cannot
take part or all of his annual vacation .in a particular calendar
year,, such vacation shall be taken during the following calendar
year.
C . Deferral . Any eligible employee with -the consent of the head of
" his department and the Personnel Office may defer five (S)
working days of his annual vacation to the succeeding calendar
year subject to other provisions of thin. rule. A written report of
each deferred vacation signed by t`he. appropriate department head
and. •the Personnel Officer noting the detalsr shall be kept on file
with the Personnel Officer. Vacation time accumulated in excess
of two years shall be lost. In the event. one or more municipal

holidays fall' within an annual. vacation, leave,, su'eh .holidays shall
not be charged as vacation.. leave and. vacation leave shall be
extended accordingly.
D. Fire B'at'talion Chiefs' Vacation shall. be- computed as follows:

Any elgibae employee with he consent of the head of his
department and ,the; Personnel Officer may defer 2..33 shifts of his
annual vacation. to the succeedng~ calendar- year, subject to the
other provisons . of this rule.. A written -report. of each deferred.
vacation signed by the. appropriate department head and the
Personnel `Officer noting the. details shall.. be kept o n .file with the
Personnel Officer. .
The times. during the calendar year in which an. employee may
take his vacation shall. b'e determined, by the department head with
due" respect for the wishes of the employee and particular regard
.for f~he needs of the service. If the requirements of the service.
are such that an employee. cannot take part :or all of his. annual
vacation in a .particular calendar year',. .such'. vacation shall be

Section 13. Sick Leave
A. General. Sick. leave with pay shah be granted, to all probationary
and` permanent emp ogees within .the .,competitive service. Sick
leave shall not be considered as a right which an employee may
use a't hi's discretion., but shall be allowed only in ease of
necessity 'or actual personal sickness, disability,,. or as allowed by
th'e compensation plan . •
B : .. A:ccruaL. Sick leave • hall. accrue: to all full-time.. employees at .the
rate of ei'gh_t hours. for each month of continuous service . Fire
Battalion .Chiefs shall accrue at 12.0 ~hqu~rs per month. No
emp'l'oyee shafil accumulate more sick leave in any year than
provided.
C . Notification Procedures . In order to receive compen_ cation while
` °absent on sick leave, the employee shall notify h'is immediate
superior or' the Personnel Office prior to or within four hours
after this time set for beginning his. daily `duties as may be
specified by the head of his department.., When absence is for
more than.. three: days/shifts dust-'ion, the employee may be

required .to file a physician's certificate with the Personnel Office
stating the cause of the absence..
D . Fami'l; Sick .Leave:. Leave of :absence up to four working
days' shifts with pay per fiscal year may be granted to an
employee in the. :event of serious illness or injury in the
employee's immediate family and will be: charged against sick
leave. The immediate family shall consist of the spouse, children,
parents, brothers, sisters, or other individuals whose relationship
to the :employee is that of a ..legal dependent. In such case, the.
appointing power shall .grant. such sick leave only when in his
opinion the: ,relationship. of the sick or disabled person to the
employee wa_ grants such use of sick .leave .
E. Relationship to Workers Compensation.. Benefits shall be payable
in situations where ,employee absence .is due to industrial injury
as provided in Calif~orna State Workers' .Compensation Law. The
amount of disability payments paid to the injured employee .shall
be deducted from salary :payable to the employee while on sick
leave. During;. the first. three. (3') calendar days of absence for
industrial dsab'.ility, employees will be compensated at their full
rate of pay without deduction from sick leave unless they are
hospitalized. Absences resulting in immediate hospitalization or
absences contin~tzirig beyond the third day shall be charged
against the employee at -the rate of one-half (l / 2) day for each
day of absence credited or~ compensated by workers' compensation
insurance, pro.Vided the .City .receives a11. compensation paid by
workers! compensation payments only,, without City payment for
salary . at no loss of nick leave. Sick_ leave for industrial injury
shall not be allowed for a disability resulting from. sickness,
self=inflicted injury or willful misconduct..
All employees receiving full. salaries in lieu of temporary disability
payments . pursuant. to Section 48.5.0 Labor' Code. are entitled to
accumulate sick leave during such periods of disability.
Section 14. :Bereavement Leave
~In the. event of the. death of an employee's s,pouse,;: mother.,
step-,mother, .mother-in-law, father,, step-father, father-in-law.,
brother, sister, child, including an adopted child, grandchild .and
grandparent, an employee who attends the funeral shall be granted
time. off. work with pay. The amoun of time off work with ~ pay shall
be~ onl'y that, which is required to attend, the funeral and' make
necessary funeral arrangements, but in no, even"t. shall it exceed three
(3) working days . These three (3) days shall not be chargeable to
sick leave°. An additional two {2) days required for necessary funeral
arrangement's may be charged to the empl'oyee'•s~ .sick leave and any
additional. time beyond these. two days may be charged to accumulated
vacation or leave without pay. Such bereavement leave .shall. not be
accruable from fiscal. year to fiscal year, nor shall it have any
monetary value ;if unused.

Section 17.. Leave of Absence. wthout.,,Pay

Section 21. G'r'ievance' .Procedure
A. Purpose of Rule
(1) To' p omote impr9ved employer-employee relations by
establishing; gar"evance procedures on, matters for which
appeal or 'hearing is not provided by other regulations.
(2) To afford employees individually or through qualified
employee organization a sgstematic~ means of obtaining further
consideration of problems ~ after every reasonable effort has
failed to resolve them through discussions.
(3) To provide that grievances shall be settled as near as
-possible to the: point of origin.
(:'4`) To provide that appeals .shall be con~d~ucted as informally as

C. Informal Grievance P.r.ocedure. An employee. who hays a problem or
complaint s'hou.ld first `try to get it .settle'd' `through discussion
with hips immediate ,supervisor without undue .delay., If, after' this
.discussion, he does not believe the problem has been
satisfactorily resolved, he shall have the right to discuss it with
his supervisor's ;imme`diate supervisor, if any, in the
admin`s;trative service.. E-very effort should b.e: made to find an
acceptable' solution by informal means at the lower possible level
of sugervs.on. If the employee is not. in a=greement with the
decision reached. by discussion, he' shall then have the right to
file a formal appeal in writing within -ten (10) calendar days after
receiving the informal decision. of `his immed-rate superior. l~n
informal appeal shall not be taken above the appointing power.
D . Formal Grievance Procedure (levels of review through chain of
command
{ 1) First level of -review. The appeal hall be presented in
writing to the employees immediate .supervisor, who shall
r.en~der his decision and' ~ eominents in writing and return them
to the. employee within five? (5) calendar days after- receiving
the appeal. If the employee does not agree with his
• supervisor's decision., or if no, answer has been received
within :five (5,} calendar days , the employee may ,present the
appeal- in, writing to lii5 supervsor.'s .immediate superior.
Failure: of the employee to take :further action. within-five (5 )
calendar . days after receipt of the written decision. of his
supervisor; or within a total of fifteen (15) calendar days if
no d'ecis'ion is rendered:, will constitute a dropping of the
.appeal,,
(2) • Further .level or levels of review' as .appropriate. The
supervisor receiving the appeal shall review it,. render this
decision :and comments in, writing,, and return. them to the
employee within. five (5) calendar days after receiving the
appeal. If the .employee does. not` agree with 'the decision , or
if no .answer has been received within five (b) calendar
days,, he may .present. the appeal in writing to the
dep,artrrment: head. Failure of the employee to take further
ae aon within -five (5) calendar days of€er receipt of the
decision or within a total ~of fifteen ~(15) calendar days if not
decision. is rendered, will constitute a dropping of the
appeal.
(3.) `Department Review. The. department head receiving the
appeal of his designated representative, should discuss the.
gri'evan'ce with the employee, his representative., if any,, and
with other :appropriate persons:=. The department head shall
render' .his decision and comments in writing, and return
them to the employee within five. (5) calendar days .after
receiving the appeal. If the employee does not agree with
fhe~ decision reached, or if no answer .has been received
within five (5) calendar days after receipt. of the decision or
within a 'to;tal of fifteen (15) calendar days if no decision is
rendered., will 'constitute a dropping of the appeal.
(4) City Manager. The City Manager receiving t'he appeal or is
designated, representative should discuss the grievance with
the. employee;: his representative, if any; and with other
appropriate person.. The City .Manager may designate a fact
finding committee., officer not in the normal line of
supervision, or Personnel Board to advise- him concerning
the appeal.: The City Manager shall r-ender a decision in
writing to the employee within twenty (20) calendar days
after receiving the appeal.
(5) Conduct of Grievance Procedure.
(a) The time Timits specified above may be extended, to a
definite date. by mutal agreement of the employee. and
the reviewer concerned:
(b) T:he employee may request the assistance. of another
person of his own choosing in preparing, and presenting
his appeal at any level of review.
(c) The employee. and. his representative may be privileged
°to use a reasonable. amount of work time as determined
by the appropriate department. head in conferring about
and presenting the appeal.
(d.). Employees shall be assured freedom from reprisal for
using the ~grieyance procedures.
