C: s. of the City of Petaluma, California A RESOLUTION APPROVING THE ISSUANCE OF A NEGATIVE DECLARATION PURSUANT TO .THE CALIFORNIA ENVIRONMENTAL QUALITY ACT FOR .AMENDMENTS TO THE GENERAL PLAN/EI~IVIRONMENTAL DESIGN PLAN LAND USE ELEMENT (WASHINGTON STREET/VALLEJO, NO. MC DOWELL BLVD. AT SUNRISE PARK) WHEREAS, the Planning Commission has recommended the issuance of a Negative Declaration pursuant to the California Environmental Quality Act (CEQA) for the following General Plan/Environmental Design Plan Land Use Amendments listed in City Council Resolution ~No;~y~,~~ N.C.S. and referenced as follows.: 1. Harmon Maria ement Co, - (Washington Street/Vallejo Street) General Plan :.Environmental Design Plan Land Use Element amendment from Urban Low Residential Density to Central Urban Commercial designation for A.P. Nos. 0,0?-052=21 and 29. 2. Leonard Ja and T. Develo merit Co. - (North McDowell Boulevard Sunrise Park General Plan:/Environmental Design Plan. Land Use Element amendment from Office Commercial to Planned" Residential on A.P. Nos. 137-060-29 and 30 (up to future frontage road leaving 200 feet Commercial Office designation fronting on No. McDowell) . NOW, THEREFORE, BE IT RESOLVED that the issuance of a Negative Declaration pursuant to the California Environmental Quality Act for above listed items is hereby approved, based on the following findings: Harmon Management Co. 1. No significant environmental effects will result from the General Plan / EDP amendment . 2. The use is consistent with the General Plan and Zoning Map designations of commercial for the area. 3. The proposed drive-though order station is located far enough -.away from the abutting residences and a sound wall will be _ constructed to significantly .reduce the potential for future noise disturbances. Reso. 84-149 NCB Page 1 of 2 4. The potential for excessive on-and-off site litter accumulation will be mitigated as a condition of use permit approval. 5. East Washington and 'Vallejo Streets. are adequate in design to accommodate the future traffic and traffic movements generated by the use, and driveways have been offset to prevent conflict with Carl's Market. Leonard Jay and T. ' Development Co. • 1. Detailed ,environmental analysis will be conducted in conjunction with review of an=y specific development project implemented subsequent to .the proposed amendments. 2.. No significant .environmental impacts have been identified for the project which cannot be mitigated during subsequent development. and authority conferred upon this :Council.by the Charter of said City.
