ReSOlUfi1Q~1 N®84-15 3 _N. ~. ~. of the City of Petaluma, California A RESOLUTION .APPROVING THE DEVELOPMENT PLAN FOR SPRING MEADOW SUBDIVISION, "PHASE IV LOCATED IN THE VICINITY OF ELY BOULEVARD NORTH AND CAULEIELD LANE WHEREAS, by Ordinance No. 1582 N.C.S. , a portion of Assessor's Parcel No. 136-060-41 was rezoned to Planned Unit Development; and WHEREAS, by action taken on June 1:2, .1984., the Planning Commission recommended adoption of the final unit development plan in said Planned Unit Zone, . • NOW, THEREFORE, BE IT RESOLVED that the final unit development plan on file in the Office of Community Development and Planning is hereby approved pursuant to Section 19A-504 of Zoning Ordinance No. 1072 N.C.S. , as amended; and, BE IT FURTHER RESOLVED the City Council hereby adopts the Findings of the Planning Commission as its findings as set out hereinafter: 1. The Development Plan clearly results in a more desirable use of land and a better physical environment than would be possible under any single district or combination of zoning districts. 2. The PUD District is proposed on property which has a suitable .relationship to Ely Boulevard and Caulfield Lane, which are Reso. 84-153 NCS Page 1 of 5 ,adequate to carry any additional traffic generated by the . Development. 3. The development =plan presents a unified. and organized arrangement of buildings and service facilities which are appropriate in relation to adjacent properties, and adequate landscaping is proposed. 4. The natural and scenic qualities of the site are protected, with adequate available public and private spaces designated on the Development Plan. 5. The development of the subject property, in the manner proposed by the applicant., will not be detrimental to the public welfare, will be in the best interests of the City and will be in keeping with the genes al intent and spirit of the zoning regulation of the City of Petaluma, with the Petaluma General Plan, and with the Envi ronmental Design Plan. BE IT FURTHER RESOLVED that the City Council hereby approves the development plan subject to the conditions of approval set out hereinafter. r nn ~il-innc• 1. Documents will be generated, recorded and made available to buyers which will include references regarding development standards which shall likewise become conditions of zoning approval, including: Reso. 84-153 NCS Page 2 of 5 a. Maximum principal and acres"sort' building heights per City Zoning Ordinance R1-Singe Family Residential Zoning District. b. Rebuilding and/or replacement of originally approved structures., including fencing, shall ,conform to approved unit development. plan. c. Garage conversions are permitted subject to the regulations of the City Zoning Ordinance. d. Home occupations are permitted subject to the regulations of the Petaluma -City Zoning Ordinance and provisions of the project CG&R's. e. Accessory structures, including accessory dwellings and building addfions, are permitted' subject to the regulations of the `Petaluma City Zoning Ordinance for accessory structures and building . additions to R-1 zoning standards and as described herein. Any such tructures or additions shall be compatible with existing house design and be subject to review by. SPARC and, any architectural review' committee established by the project CC&R's. f. Building. ~ setbacks for principal buildings shall be not less than the following: Front: 20 feet or setback defined on the development map . Rear: 20 feet. :Side: 15 feet aggregate., not less than 5 feet on one side or 10 feet for attached units with the opposite side at 0 feet. Noise mitigation measures to reduce interior CNEL levels from exterior sources to 40 dba or lower yin bedroom areas and 45 dba or lower in all other interior living areas. shall be incorporated into housing design. 3. Elevations of, housing models, .overall .model distribution plan, tree planting/landscaping and fencing plans shall be subject to SPARC review and be consistent with plans for `Phase III. 4. Revised sepia prints of the final approved development plan/landscaping plan reflecting all conditions. of approval shall be submitted to the. Community Development and .Planning Department within sixty days after Council approval of the revised development plan.. Any .subsequent substitution or redistribution of model's within th`e parameters herein described shall be accompanied by revised sepia prints of the development and landscape plans. 5. Developer requested one-story model substitutions shall be limited to not .more than twenty percent of the total dwellings in each unit, i,.e. , Phases III or IV with no deletion of two story units.
