RESOLUTION .APPROVING LANGUAGE MODIFICATIONS
TO THE HOME RELOCATION POLICIES
ADOPTED BY RESOLUTION 84-61 NCS
AS REQUIRED BY THE SONOMA COUNTY
AUTHORITY AND HUD
WHEREAS, on April 2, 1984, the City Council adopted Resolution No.
84-6 I N . C . S . adopting a Voluntary Home Relocation Program and Phasing
Plan for Homes located in City Floodway Areas; and,
WHEREAS, the Sonoma County Housing Authority and HUD have
requested certain language modifications to said program;
NOW, THEREFORE BE IT RESOLVED that the City Council hereby
adopts the policies, dated July 2, 1984, and entitled "Exhibit A- Home
Relocation Policies for Homeowners" attached hereto and incorporated herein
by reference, as requested by the Sonoma County Housing Authority and
HUD.

I. Pro gram Objectives
A.. To assist owners of developed. resid'ental property in the .floodway
zone generally in they Linda D;el Mar and Madison Square
Subdivisions to~ voluntarily relocate their single-.family homes out of
the floodway zone'..
B . To relieve direct and irid~rect hardship on owners and. tenants of
resd'ential'°property within and'. adjacent: to the floodway zone who
by vir.tue~ of° the location of their -;property ;may be subjected to
' flooding hazards but wlq would,. be benefited. by certain
improvements to the .Petaluma Rivver ehanrrel made possible by City
. .
acquisition of additional right-of-way along: the river through the

facilitate possible future . channel improvements generally as

' improvements and home: -relocations until a sufficient number of

'permit river channel- improvements as referred to above.
II. Prog ram. Policies
A. ~ To designate, ,project priority phases as shown on- the attached
exhibit A, as~ follows:

B . To 'ridiVdually consult with each property _owner by successive
phase to apprise him/her of tle. full. scope of the 'program: 'its
operating procedures., costs and benefits;., problems -and
opportunities.
C, ,To formulate with each property owner who wishes; to, voluntarily
participate- a letter of understanding ~ "which. .outlines .clearly the
responsibilities of the City .and. the property owner, and any third
parties- which may be involved e.,g,, mortgage lender, property
owner' (if :non-city acquired lot is to be utilized') involved 'in the
relocation .
D . T:o ,extend: home relocation assistance to those property owners who
wish to seek an alternative relocation site (other than lots
provided by City) .

III. Program Procedures.;
City Owned. Lots:.
A. City =financial. partcpat-ion for 'relocat'ion . to City acquired lots in
the: 'M'adison Manor subdivision she'll include:
1. Pur'cha"se of new lot in Madison Manor
2. Installation of new street.,, sidewalk,. underground utilities and'
other public improvements pier City subdivision standards .
3 0 „ :Removal of construction ;debris, fini h 'g-raging,, installation. of
-basic yard' landscaping, driveways; sidewalks, rear a"nd side
' yard fencing. to current acceptable fandards.. i.e., equivalent
. to typical single=family su~bdv'son.
4. Physically moving 'house ,and 'garage to- new lot or build
'equiva'lent repTa'cement garage..
5. Installation of new foundation, utility :hookups, -and repair of
any ,damage. "~to ..home: or .gar,age caused by , ;the move,. ,e. g . ,.
cracked plaster,. broken. win°dows, cracked chimney etc...
6, Moving. sel'ecaed' household .goods „to a secure storage area .and. .
then to the relocated :house when it is ready fore occupancy';.
7. 'Securing, necessary title reports and securing. insurance on
homes during move and. repair ,period.. All costs of escrow,,
recording, fees, an"d related costs': shall be paid: b,y City. .
8;. Cap abandoned.. utilities and clear debris. from old lots.
9. Provision ,of up to $4-, 5'b0 pier :home for owner occupied units

2. Contribution toward physically- 'movin'g '-house and garage to
new site. equal. to average. cost.. of moving. home and. garage. to
new lot.. in. Madison: Manor Subdivision (or actual cost. if
lower) . 'Waive :any administrative.. fees for said lots located in

3. Contribution to replacement .foundation, utility Hookups and
repair of .damage- caused by ,move' ~in amount equal to average
cost of such,. improvements ,for home relocated to Madison
Manor sub'divi'sion ..

equah to the average. cost a of moving: 'household; goods to home

5.. Securing necessary title reports: ,All costs of escrow,.

6. Capping abandoned utilities and. ~clear_ing'. debris from old lot.
7, Provision qf' up to $4„500 per home for owner .occupied' units
to provide: for temporarg .housing during house moving and
rehabilitation period.. Any or„ a11' of this .amount not required
for temporary housing purposes shall. be available to the
gwner occu-pant for use in additional interior or exterior home
impr..ouements of a permanent .nature.. This .amount .for
;improvements shall be available for .:a perod of 12 months
after the house :has been. moved onto the .new site.
Owner Parficip;ation e
C . Participation of property owner for relocation to City acquired lot
'in the. Madison Manor subdivision . sha1T be on a voluntary basis
only ~and~ shall include,.: '
1. Proxde ...alternative housing during house movin'ga/repair
,process. Owner occupied property may wish to. apply optional
temporary housing allowance to supplementary home'
inRrovements; per A 10' or B 8' above.

2.. Provide: fore moving of exterior/,garden improvements 'which are
desired .for new lot, e, g.. , sheds, playhouses, swing sets:,
plants, decorative brick. or rock. work etc.. which. is not
covered by A-4 or B-2: above.
3: Retain. ownership of the property until move and rehabilitation
completed once- ,final agreement is executed.
4. It is the obligation, of~ the owner to inform. the City
immediately if any tenants occupy the house. The owner
hall not force, ~ a tenant (s) to vacate a house in order to
facilitate a .house -relocation.
5. For, relocations w-hich occur to Pots not owned by the City it
will. be the responsibility of the property owner to provide for
all costs not covered by City agreement, including .such things
as. higher..': land costs, moving' -costs, utility costs, site
preparation., etc;,
6. It ~ will. be the responsibility of such. property owners to
secure the: necessary des'i'gn and engineering, approvals, and
permits from th`e Gity, or County ;agencies as required for
any lots "not• ovine"d- or offered by the City under this
program.
7. P,.ropert•y owners wishing to relocate to a non City owned. lot
outside the City will be ~ requuired . to negotiate and, secure
necessary subcontractors needed to perform such work
necessary- to move and reinstall their relocated house, and
may be. required to .do so if such lot. is located inside• the
Cit=y . ,
D. Relocation Procedures -shall pr-oceed' as follo.ws,:
1. City ~ wi1T conduct basic negotiato"ns. with. all property owners
in first phase on a~ first-come.-first, served voluntary basis
after duely .notifying each property • .owner of the home:
relocation opportunity.
2.. City Council shall annually establish a .priority relocation .list
based upon available funds,, physical/emg-ineerng priorities,
mix of relocation, types (city lot;, alternative lots) and ease of
.execution. 'of individual letters of understanding. •
3. Lot ,selection ("city `lots,) by' .property owners will be
accomplished by random, drawing , of names at a public
meeting:. Owners must specify first and second. choice for
lots in case of first selection- °is unavailable .
Winners of relocations drawings: will b,e -permitted to. review
the: lot; selection of; other winners and will , be permitte'd' to
.revise their lot relocation for a period not to exceed
'fifteen. (15.) calendar days after Elie drawing has been held .

4. Individual letters of understanding for selected properties will
be reduced to final agreements.
5. Escrows for each selected property are opened by the City.
6. City- executes contracts. for variqus aspects of relocation of
homes.. City ahall be ' a third party to oversee contract
` between owners; and contractor for repair and improvements
for selected units within city limits..
7. City shall.. be responsible for final inspection for decent, safe
and sanitary dwelling units for those recipients relocated
within 'th'e city limits . `
E. Formalities
The. Cify and Owner will enter .into an, agreement setting out the
obligations and agreements of each party.
