HomeMy WebLinkAboutResolutions 84-173A N.C.S. 08/06/1984~i~S~Oll.l~lOf~ T~1+~.84-173 . ~. ~. of tl~o City of ~~talurna, California RESOLUTION ACCEPTING PROPOSAL FOR SPECIAL ASSESSMENT PROCEEDINGS FOR Assessment District No. 16 NS, Redwood Business Park The City Council of the City of Petaluma resolves: G & W McDowell Associates, a general partnership, Benny Friedman, Rosemary Friedman and Joseph Friedman ("the developer") is to undertake the construction of the following described public improvement: The construction of Redwood Way including clearing and grubbing, grading, the installation of roadway base, paving, curbs and gutters, sidewalk, storm drainage facilities, sanitary sewer facilities and appurtenances, domestic water supply system, including fire hydrants as required, street lighting, underground electric and telephone facilities and all other improvements and appurtenances necessary for the public improvements for the Redwood Business Park. The developer proposes to this Council that the City Council undertake special assessment proceedings to acquire these public improvements after their completion, the cost of the acquisition. to be assessed on the property of the developer benefiting from the improvements. This City Council accepts this proposal in principle, subject to the following conditions: 1. That the special assessment proceedings shall be taken under the Municipal Improvement Act of 1913, with improvement bonds to be issued under the Improvement Bond Act of 1915. 2. That the described improvements shall be certified by the Director of Public Works as complete and ready for acceptance before the adoption of the resolution of intention. 3. That the developer shall submit evidence satisfactory A Q Reso No 84-17 N. C. S . ~G~'~ °~ to this Council that the costs proposed to be assessed shall have been actually incurred and paid, and that -the land proposed to be assessed shall be free of mechanics' liens resulting from the construction of the improvements. This resolution shall in no way constitute a guarantee or assurance that the special assessment procee-dings will be completed, the City Council being without jurisdiction to assure the levy of special assessments until conducting a public hearing as required. by the Municipal Improvement Act of 1913.
