S. of the :City of Petaluma,- California J~UL 16 1984 ~ ~ A P~ESQLUTION OF THE: CITY CQ~UNCIL; OF TIIE CITY OF PETALUMA APPROVING AND AUTHORIZING' THE EXECUTION OF A JOINT EXERCISE OF POWERS AGREEMENT 'TO CREATE THE SONOM~A COUNTY HOME FIN?;1VCIN.G A;UT.HORITY; APPOINTING ONE MEM-BER TO THE: GOVERNING BOARD OF SUCH< AUTHORITY; ,ANDASSIGNING ALLOCATION OF MORTGAGE REVENUE BONDS BE IT RESOLVED BY THE City Council 'of the City, California, that WHEREAS, pursuant to the provisions of. Article 1 (commencing with Section 6500) of Chapter 5 of Div'is'ion . 7 of Title h of the Government Code of the State of California., two or more public eri"tities may enter into a joint exercise of powers agreement to carry out. the powers common to each entity ; WHEREAS, the County of Sonoma (.the "County") , and the Cities of Healdsburg, Rohnert Park, Petaluma and, Santa Rosa (the "Cities") are each empowered by Part 5 (commencing with Section. '52000) of Division 31 of the Health and Safety Code of the State of California ' (the "Act") to issue revenue bonds for the purpose of financing the construction, acquisition and rehabilitation of .homes for the benefit of the residents thereof; WHEREAS, the County and each of the Cities have each adopted or will adopt an ordinance establishing a home mortgage finance program pursuant to the Act; WHEREAS, under the Costa-Marks Housing Bond Allocation Act of .1981 and the Mortgage Subsidy Bond .Act of 1980,. capacity to issue such bonds has been allocated to the .City of Petaluma by the Mortgage Bond Allocation Committee, created by the Costa-Marks Housing Bond Allocation Act of 1981, 'and such :capacity may be assigned to an authority created by such a joint powers agreement; and WHEREAS., this City Council has found and determined, and hereby finds and determines., that it .is in :the best interests. of Petaluma that . Petaluma enter into a joint exercise of powers agreement with the County and the other Cities creating the Sonoma County Home Financing Authority ('the "Authority") to exercise their respective powers. pursuant to the .Act and for the Authority to proceed pursuant to -the Act' for the purpose of. financing home mortgages with respect to property within the boundaries of the County and the Cities .. NOW, THEREFORE, IT IS ORDERED as follows: 1. Tlie recitals herein contained are true and correct., and this City Council so finds. 2. The form of agreement, dated as of July 15,,, 198:4., entitled "Joint Exercise of Powers Agreement Among the. Coun:fy of Sonoma and the Cities of Healdsb:urg, Rohnert- Park., Petaluma. and Santa. Rosa Creating the Sonoma County Home Financing Authority, " submitted to this City Council, and the terms and conditions thereof are hereby approved. The City Clerk is _~- .Reno No 84-1s6 N.C.S. directed to file a copy of said form of agreement in the office of the City Clerk, the Mayor and the City Manager. are authorized and directed to execute and the City Clerk is authorized and directed to attest their signatures, affix the corporate seal and to deliver an agreement in substantially said form with such additions thereto or changes therein as such officers may require or approve, such ,approval to be conclusively evidenced by the execution and delivery thereof.. 3. Pursuant to Section 7 of said agreement,, the City- Council hereby appoints each of the `persons listed below to serve a three-year. term as a member or alternate. of the governing board of the Authority: T1ame ~ Address Member: John L. Scharer, City Manager P.O. Box 61, Petaluma, CA 94953 First Alternate: Juelle-Ann Boyer, Finance Officer same Second Alternate: Gene Beatty, Asst City Manager same 4. The City of Petaluma hereby assigns its allocation of qualified mortgage bonds made to it by the Mortgage Bond Allocation Committee to the Sonoma County Home Financing Authority, such assignment to become effective upon the effective date of such agreement. 5. This Resolution shall take effect immediately upon adoption. Under the power and authority conferred -upon this,Council by the. Charter of said City. I hereby certify the. foregoing Resolution was introduced and adopted by the Apove as to Council of the.
