RESOLUTION ADOPTING IN LIEU FEE. SCHEDULE
FOR IMPLEMENTATION OF HOUSING ELEMENT
REQUIREMENTS FOR VERY LOW, LO4V AND
MODERATE INCOME HOUSING
WHEREAS, the Housing Element of the Petaluma General Plan, adopted
December 6, 1982, by Resolution No. 9620 N.C.S. sets forth goals, policies
and implementation programs to achieve an adequate supply of housing for
all groups; and,
WHEREAS, Program 2 of the. policy for such . implementation provides
that developers of planned residential developments with 16 units or more
be required to achieve. said housing objectives, by one of several methods,
including the following, "an in lieu fee related to the cost of providing
housing . The primary purpose of the fee is to write down land costs or
acquire housing fee development of low and moderate income housing in
Petaluma."; and,
WHEREAS, it is the desire of the City Council to establish a schedule
of in .'lieu fees for those developers who choose to make an in lieu fee
payment, instead of using any of the alternative methods provided under
Program 2 of the Housing Policy as stated,, in Resolution No. 9620 N.C.S.;

NOW,. THEREFORE, BE IT RESOLVED that' the. following schedule of in
lieu fees be adopted in order to implement that part of Program 2 of the
Housing Element Policy dealing with an in lieu 'fee schedule:

BE IT FURTHER. RESOLVED that said in lieu fees shall be collected on
behalf of the City of Petaluma. at the time the escrow is closed on the sale
of each lot or residential unit. A recordable agreement shall be entered into
between the City and the develop er who wishes to use this schedule. The
agreement shall also designate th e estimated value, of the lot and home for
those developments which will sell lots prior to home construction.
