TO: Honorable Mayor and Members of the City Council through City Manager FROM: Dan St. J .ASCE — Director, Public Works and Utilities Larry Zimmer, P.E. — Capital Improvements Division Manager SUBJECT: Resolution Accepting Completion of the Recycled Water Pump Station Upgrades Project It is recommended that the City Council adopt the attached resolution accepting completion of the Recycled Water Pump Station Upgrades Project. BACKGROUND The City of Petaluma's recycled water system was constructed in 1981 and modified in 2009 with the completion of the Ellis Creek Water Recycling Facility (ECWRF) to continue recycling secondary treated wastewater on golf courses and agricultural properties. During the dry -weather season from May 1 to October 31, the City is restricted from discharging into the Petaluma River and must recycle. The system had consisted of four pump stations and 12 miles of pipelines which delivered water to over 1,000 acres of land. The system conveyed secondary treated wastewater from the oxidation ponds at Lakeville Highway to irrigate of vineyards, golf courses and agricultural lands. In 2013, staff installed a temporary connection to allow the ECWRF tertiary filters to provide treated waste water to recycled water users and to retire two of the old secondary effluent pump stations adjacent to the aerated ponds. Previously, tertiary water was only used at the ECWRF as "number 3" water for plant processing and site irrigation. The project has assisted in the expansion of recycled water use within Petaluma City limits including an increase in the amount of "potable water offset" credits for uses on City parks, schools and open space while improving delivery reliability. The subject project included operational controls to better regulate flows and pressures in the recycled water distribution system, replacing the temporary connection with a full sized permanent connection, and added a small pump and meter to the tertiary water pump station. The project location is shown on Attachment 2. Agenda Review: City Attorney Finance Director City Manager,_ Bids were opened on January 23, 2013. On February 4, 2013, the City Council awarded the construction contract to Pacific Infrastructure Corporation of Concord, CA, in the amount of $1,189,000. Construction was successfully completed in May 2014. The proposed action meets Council Goal: "Plan for and implement priority capital projects as funding permits". The final construction contract cost is $1,334,030.61, which includes change orders totaling $145,030.61 which represents 12% of the initial contract award. Change orders included: extra work due to unknown and unmarked utilities; additional excavation at the mainline connection near Booster Pump Station #1; constructing owner directed improvements to the Adobe Creek and Rooster Run turnouts; and additional improvements to the Tertiary Recycled Water Pump Station, Urban Recycled Water Pipeline, Booster Pump Station 92 on Browns Lane, and turnouts to agricultural customers. FINANCIAL IMPACTS Recycled Water Pump Station Upgrades Project, Project Number C66400902, approved budget is $2,339,000 which included design, construction management, and contingency for unforeseen conditions. Following the acceptance of the project, the City Cleric will file a Notice of Completion with the Sonoma County Recorder and the Finance Division will release the contract retention account to the contractor within 60 days. Location Map 1) Attachment 1 RESOLUTION ACCEPTING COMPLETION OF THE RECYCLED WATER PUMP STATION UPGRADES PROJECT WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable laws, the City of Petaluma solicited bids for the Recyled Water Pump Station Upgrades ("Project"); and WHEREAS, bids for the Project were opened on January 23, 2013 in accordance with California Public Contract Code Section 4104.5 and other applicable laws at which time the City received 4 bids; and WHEREAS, by Resolution No. 2013-009 N.C.S. adopted February 4, 2013, the City Council of the City of Petaluma found the bid of $1,189,000 for the Project to be the lowest responsive bid; awarded the Project to Pacific Infrastructure Corporation in the amount of $1,189,000 conditioned on Pacific Infrastructure's timely executing the Project contract and submitting all required documents; and authorized and directed the City Manager to sign the Project contract on behalf of the City upon such timely submission and to execute on behalf of the City any amendments to the Project contract that are necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the City; and WHEREAS, the following change orders (CO) affecting the Project amount have been approved: CO No. 1: Unmarked Utilities, Excavation at Booster Pump Station #1 $ 39,132.61 CO No. 2: Turnouts at Rooster Run and Adobe Creek Golf Courses $ 51,624.00 CO No. 3: Additional improvements at 3 Water Pump Station $ 18,359.00 CO No. 4: Additional improvements at Urban Recycled Water Pipeline $ 16,077.00 CO No. 5: Additional improvement at Booster Pump Station #2 $ 15,800.00 CO No. 6: Additional improvements at Recycled Water Turnouts $ 4,038.00 Total Change Orders: $145,030.61; and WHEREAS, the final contract amount as amended including final quantities and all change orders is $1,334,030.61; and WHEREAS, City staff has inspected the Project and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: The contract entitled Recycled Water Pump Station Upgrades Project, City Project Number 066400902 with a final contract amount of $1,334,030.61, is accepted as complete subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. Staff is hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the Project contract, the Petaluma City Charter, California Public Contract Code Section 7107 and applicable law.
