S. . .ti of the City of Petaluma, California RESOLUTION UPHOLDING AN APPEAL ~OF THE DECISION OF THE PLANNING COMMISSION DENYLNG A CONDITTQNAL. USE PERMIT FOR DAVID ZEDRICK TQ O,PERATE A. S'ERVIGE" STATION AT 50'1 PETALUMA 'BOU'LEVARD NORTH, WHEREAS, the Planning Commission on July 10, 1984 did deny the application for a conditional use permit for David Zedrick to operate Rose City Gas, a service station at 501 Petaluma Boulevard .North; and, WHEREAS, David Zedrick., P.O. Box 407, Santa Rosa, made a timely appeal to the City Council °pursuant to the provisions of Ordinance No. 1072 N . C . S . , as amended; and, WHEREAS, the City Council considered the record submitted by the Planning Commission, as well as written and oral. evidence submitted by the appellant and City staff at a hearing held on September 4, 1984. NOW, THEREFORE., B'E it resolved that the Council finds that (1) the proposed use, subject to the conditions listed below, conforms to the requirements and intent of the Zoning Ordinance :and the Petaluma General Plan and Environmental Design Plan; and, (2) that the use does not constitute a nuisance rior will it be detrimental to the public welfare of th Community . BE IT FURTHER RESOLVED. that this Council does hereby .uphold the appeal of David Zedrick :and approve ~ a use, permit for Rose City Gas at 501-- Petaluma Boulevard North- subject to the following conditions: 1. The .free-standing pole sign near the corner shall be removed. It may be replaced with a single monument s°gn ..which meets the sign • f ordinance, i.e. , does not exceed. five feet'• in height, and twenty square feet in size. 2. A six-foot high wooden fence shall be constructed along the west and north property line. Design and materials shall be approved by SPARC . Reso. 84-2,13 NCS 1 of 2 .: o 3. The unused 22-foot tall light poles at _ the southwest and northwest corners of the property shall be removed. 4. The "grassy area" shown on the site plan shall be relandscaped and served by a city approved irrigation system,, subject to the approval of SPARC. 5. There shall be no storage or sale- of .vehicles on the site; no outdoor auto repair or storage or permanent display of tires, motor oil or other products related to the business; and' no parking lot vendors (i.e. no sales of "laser art", velvet paintings, tools, pottery, etc. ) 6. A sign permit shall be required for any new sign. 7. The restroom building in the northwest corner of the property shall be refurbished subject to the approval of SPARC. 8. All asphalt pavement on the property shall. be patched and sealed subject to the approval of the staff . 9. A curbed, landscaped .island shall be created .at the southeast corner of the property ,(nearest the intersection of ..Kent and Petaluma Blvd. No.) and shall be ., designed to effectively, close ~ the nearby 23=foot driveway subject .to approval -of _SPARC.. • ~ ` 10.
