Jam. ` of the City of Petaluma, California AUTHORIZING MAYOR OR CITY MANAGER TO SIGN AGREEMENT WITH' SONOMA COUNTY RELEASING IMPOUNDED PROPERTY TAXE$ ~ E P 1 '7 1984 ~ ~_ WHEREAS, the Auditor-. of Sonoma County and the Board of Supervisors under authority of Government Code Section 2.6906.1 have impounded property taxes in the amount of $.48, 299.00 for the City of Petaluma and Petaluma Redevelopment Agency due to pending claims by several utilities before the State Board of Equalization, and WHEREAS, the City and Redevelopment Agency, will reserve amounts for these impounds after receiving the. funds from the Auditor of Sonoma County, ' ' NOW, THEREFORE, BE IT P,ESOLVED that the Mayor or City Manager be authorized to sign such agreement, a copy of which is attached. AGREEMENT THIS AGREEMENT is made on between the Board of Supervisors of ("County") and the City Council of ("City"). the County the City of_ 1984, of Sonoma Petaluma R E C I T A L S A. Pending before the State Board of Equalization are applications for changed assessments by several_ pub]_ic utilities and these applications have a direct impact on County, as County is the recipient of the tax proceeds paid by the utilities. R. Under authority of Government Code Section 26906.1, the Auditor and the Board of Supervisors of County maY impound ad valorem taxes subject to dispute and the County impounded the amount of $44,151.00 for the City of Peta.1_uma and $4,148.00 for the Petaluma Redevelopment Agency .for the 1983-84 tax year only, which amounts would have been distributed to the City and the Redevelopment Agency ii no impounds were made. IN CONSIDERATION of the above, and the promises set fortis below, the parties agree as follows: 1. County will release to City the amount impounded on behalf of City of Petaluma and the Petaluma Redevelopment Agency. 2. Should County incur liability for refund of taxes, City shall contribute to that liability based upon the. following ratio: Amount of ad valorem taxation distributed to City for the. tax year for which the refund is to be made divided by the amount of ad valorem taxation received by the County during that tax year. 3. Should City not. make said contribut?.on upon demand, County may withhold from future distributions of_ ad valorem taxation the amount necessary to recover the liability described in the preceding paragraph. 4. This Agreement does not affect the right of County to impound funds for any tax dispute other than as specified in Paragraph .A above. 1 c 5. This Agreement is binding upon the successors and assigns of the parties.
