S. of trle City of Petaluma; Ga~liforna RESOLUTION APPROVING TENTATIVE SUBDIVISION MAP FOR_ WILLOW CREEK BUSINESS PARK ~ SUB'DIVISION WHEREAS, Sonoma. Financial Corporation as owner(s) and Subdivider (s) have filed with this Council a tentative map proposing to subdivide land within this City to be known as Willow Creek Business Park Subdivision, and have paid all required filing fees; and, WHEREAS,. the City Engineer, the Director of PTanring, the Sonoma County Water Agency, and the Planning Commission have examined and reviewed the same as required by law and all reports, recommendations, and comments thereon have been forwarded to •and considered ,by this Council at its meeting held on October ~~~, 2 9 , 19.8 4 , • WHEREAS the City Council adopted a Negative Declaration in 19.81 for a subdivision of substantially similar size,, location, layrout and potential environmental impacts; NOW, THEREFORE, BE' IT RESOLVED ~ that' "this Council hereby finds as follows 1. The proposed subdivision.., together with provisions for its design and improvement, is consistent with the General Plan. 2. The proposed subdivision is compatible with the objectives, policies, general land uses, and programs sped-fied. in; said General Plan. 3. The site i`s pliysically suitable for the type of development proposed. 4. The site -is physically suitable for the proposed density of development 5. The design of the Subdivision and the proposed improvements therefor will not. cause substantial environmental damage, and no substantial or avoidable -injury' will occur to fish or wildlife or their habitat . The design of the Subdivision and the type: of. improvements proposed will :not conflict. with easements, acq:ured~ by the ~ public at large, for access through 'or 'use of property within the proposed subdivision. 8. The discharge of -waste from the proposed subdivision into the existing community sewer system will riot result in violation of the existing requir.ements::prescrbed by the .:Regional, Water ,Quality Control Board. BE IT FURTHER RESOLVED, based on th'e fi-ridings set forth above, that the above referenced tentative map be, and the same is: hereby approved as diagrammed in and': sub'j:ect to the conditions set. forth below: 1. The tentative map shall b:e r.evsed to 'meet. the concerns and conditions of the Fire Marshal, ;including turn radius: at McDowell. and Roger Road planter island :to accommodate C=50 design vehicle.. 2.. A grading; and drainage plan shall be. submitted to and approved by the City Engineer, Said. plans. stallinclude measures for bank stabilization along Willow Creek: which shall also be subject to approval by the Water Agency.. 3. The Willow Creek improvements including a maintenance roadway, are subject to approval ;by the 'Water Agency:, `City Staff and Department of Fish and Game. Said improvements may include, where required, reve'getation . of the stream bank and a temporary chain link fence around the drip-line of all off-site trees on the north western bank, o.f Willow Creek for protection during channelzaton. 4. A hydrology study shall be provided which shows to the satisfaction of the City Staff and. 'Sonoma County Vdater Agency that the proposed stream mpr-ovements will .not cause adverse effects or' exacerbate flooding conditions either up-or downstream from. the project site. R.e~so; 84-2T9 NCS Page 2 of; 5 5. Design 'guidelines subject` to SP_A,RC approval shall be prepared for this subdivision and recorded concurrently with, the CC&R's. 6. A master landscape plan shall be submitted to S'P,ARC for review and approval. prior to :final map. approval. Said plan shall contain ;provisions for .th'e vegetation of -Willow Creek .as may be required by Condition 3, above, e~erg.reen tree screening°. a1'ong Willow Creek on all lots abutting, the.. creek, and coordinated landscape treatment for all street front yar:'d areas. Vegetation along Willow Creek. shall be installed. concurrently with. other public improvements. 7. An mprgved "maintenance easement shall, be provided along Willow Creek to the satisfaction of: th'e ;Sonoma County Water Agency. 8. A ten foot wide pub-lic ;utility easement shall: be provided along all street frontages. All: utilities steal°1 be placed underground. 9. No Certificate of Occupancy shall be given :for a building unless all public improvements in the, phase egntaining said" building are first completed and dedicated' o the; City.. All, pubic improvements shall. be completed no later than. Unit II' of development. - 10. The conditions,, covenants and 'res'trictions drafted for the park shall be subject -to approval by the Community Development and Planning Department and. the. City A. ttorney prio"r to Final `Map. approval. Such approved and record"ab`1e CC&`R''s shall b:e forwarded. by the Director .of ;Planning to the City Engineer for- recordation prior to issuance of bu'il'ding permits'. Changes 'to the propo"sed' CC.&R's which. -shall 'be - in°corporated therein prior to staff approval shah include- provisions for City approval .of ;development standards allowable uses,.. and any future changes thereto,, and perpetual maintenance of all landscaped areas. 11. The: project shall be subject to the pavement of storm. drainage impact fees as' provided in Resolution No. 9'565 N. C,,. All building, pad elevations shall meet 'City Floodway and Floodplan Combining District. ;regulations which require finished floor levels to be at least 12 inches above the baser flood elevations. 13 . During the cour e of ~ development,, i'f archaeological materials are found, all work in the vicinity of the find(s): shall be stopped and a qualified archaeologist contacted to evaluate the .materials and' make recommendations for mitigation as deemed°'riecessary. 14. In the event any ,grading or improvements extend. within the 101 Freeway right-of-way, grading plans sh'alL `also be submitted to GalTrans for approval. 15. The bus pull-out and shelter shall be subject. to design approval by City Staff -and 'SPARC'. 16. Street names sh-a11 tie subject to approval by the. Street Naming Committee,. Street yard; wetback lines shall. be shown on the tentative map for each parcel at a minimum, of twenty---five (2'5) feet except for the McDowell Boulevard frontage of Parcel .5, 1?. Turnarounds .for fire trucks ar-e• required at the ends of stubbed streets shown in Phase II to the approval. of the; City Engineer and the Fire. Marshal. 18. A copy and sepia original of 'the revised tentative _map satisfactorily depicting changes required herein shall' be submitted- to the Director of. C'ommu_nitg Development within. 6.0 ,days after Council approval of the `tentative' :map•. 19, The newly approved Redwood Wayshould line up with Redwood Way on this project:. 20, The tentative• map shall be revised to reflect 'the improvements shown on the approved plans entitled "North McDowell Extension" and Redwood. Business Park.. 4 ReSia_ 84-'2.79' NCS Pane 4 'of 5 21. The existing signal at the intersection of Petaluma Blvd. North and North McDowell Blvd. shall be modified to five phase operation. 22. On the typical half street section for Old Redwood Highway the newly paved section should include from the gutter to the centerline.
