CITY OF PETALUMA PLANNING COMMISSION
APPROVING SITE PLAN AND ARCHITECTURAL REVIEW FOR ARCHITECTURAL
PLANS AND FINAL PUD DEVELOPMENT STANDARDS ALONG WITH
CONDITIONS OF APPROVAL (EXHIBIT 1), FOR THE
YARBERRY RESIDENTIAL DEVELOPMENT
LOCATED AT 870 WOOD SORREL DRIVE

WHEREAS, Rick Rosenbaum, on behalf of Ryder Homes, submitted an application for Site
Plan and Architectural Review for architectural plans and final PUD development standards for
the Yarberry Residential Development located at 870 Wood Sorrel Drive; and,
WHEREAS, a Mitigated Negative Declaration (MND) was adopted by the City Council on
September 14, 2009 (Resolution No. 2009-136 N.C.S.) and there has been no substantial changes
to the project or the circumstance under which the MND was adopted. The MND adequately
described the potential environmental impacts of the project. No further environmental review
is required; and,
WHEREAS, a Tentative Subdivision Map (TSM) was conditionally approved by the City
Council on September 14, 2009 (Resolution No. 2009-149 N.C.S.) and conditions of approval of
TSM are incorporated herein by reference; and,
WHEREAS, the proposed PUD Development Standards reflect the applicable conditions
of TSM approval; and,
WHEREAS, on February 25, 2014, at a duly noticed public hearing the Planning
Commission adopted Resolution No. 2014-01, approving landscape plans for the Yarberry
Residential Development, including fencing and mailbox structures; and,
WHEREAS, on May 27, 2014, the Planning Commission held a duly noticed public hearing
to consider the proposed project. A copy of the notice was published in the Argus -Courier and
mailed to residents and occupants within 500 feet of the site in compliance with state and local
law.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission hereby approves Site
Plan and Architectural Review for architectural plans and final PUD development standards for
the Yorberry Residential Development located at 870 Wood Sorrel Drive based on the following
findings:
1. The project includes an appropriate use of quality materials and is in harmony and
proportionate in overall design because the applicant proposed a mix of stucco,
horizontal and board and batten siding with a lifetime composition roofing material.
Materials and colors and architectural elements are intended to reflect the
architectural styles being represented.
2. The architectural styles are appropriate for the project in question, and compatible

with the overall character of the neighborhood because the project includes 1 -story
and 2 -story homes and a mix of architectural styles and colors that are compatible
with the overall character of the nearby residential development.
3. The siting of the structures on the property is appropriate and considers the siting of
other structures in the immediate neighborhood because surrounding development
has been developed as PUDs with varying setbacks and house orientations. The
project has also been approved with staggered setbacks intended to maximize
setbacks from existing development and protect privacy.
4. The bulk, height, and color of the proposed structures are consistent with the bulk,
height, and color of other structures in the immediate neighborhood because the
project incorporates a variety of architectural styles, heights that comply with the
height limits established by the Implementing Zoning Ordinance and 8 color schemes
that are compatible with existing residences in the neighborhood.
5. Landscaping complies with City standards and is in keeping with the character or
design of the site and preserves existing trees as confirmed by the Planning
Commission through adoption of Resolution No. 2014-01.
6. Ingress, egress, internal circulation for bicycles and automobiles, off-street
automobiles and bicycle parking facilities and pedestrian ways are designed to
promote safety and convenience and conform to approved City standards as
confirmed by the City Council through adoption of Tentative Map Resolution No.
2009-149 N.C.S.

Exhibit A
1. This Site Plan and Architectural Review authorizes the construction of 21 new residential
units and associated infrastructure and landscape improvements as shown on Plans
dated April 10, 2014, for the property located at 870 Wood Sorrel Drive, APN 137-061-022.
2. All applicable conditions of approval made a part of the Tentative Subdivision Map
Resolution 2009-149, Mitigation Measures included as Exhibit A in Resolution 2009-136, and
conditions of approval of the Landscape Plan SPAR Resolution 2014-01 are incorporated
herein by reference.
3. Before issuance of any development permit, the applicant shall revise the site plan or
other first sheet of the office and job site copies of the Building Permit plans to list these
conditions of approval and conditions of approval of the Tentative Subdivision Map -
Resolution 2009-149 , Mitigation Measures -Resolution 2009-136, and conditions of
approval of the Landscape Plan SPAR Resolution 2014-01.
4. Plans submitted for building permit review shall be in substantial conformance with plans
submitted for Architectural Review, date stamped April 10, 2014, as modified by
conditions of approval.
5. Final Greenpoint checklist shall be submitted with the building permit application that
demonstrates 96 points have been achieved. Greenpoints checklist shall include the
following water reduction and hot water distribution measures:
a. Insulate all hot water pipes
b. Use of high efficiency fixtures
C. Use of energy star dishwashers
d. Hydrozoning of plants
e. Mulching all planter beds to 3 inches or greater
f. No invasive species
g. Turf in small percentage of landscaping area
h. Low flow drip irrigation systems
i. SMART weather based controllers
High efficiency tankless water heater
6. The project shall be subject to all applicable development impacts and other City fees.
7. Prior to Issuance of Building Permits, all applicable school fees shall be paid and proof of
payment submitted with building permit.
8. The applicant shall defend, indemnify and hold harmless the City and its officials, boards,
commissions, agents, officers and employees ("Indemnitees") from any claim, action or

proceeding against Indemnitees to attack, set aside, void or annul any of the approvals
of the project. The applicant's duty to defend, indemnify and hold harmless in
accordance with this condition shall apply to any and all claims, actions or proceedings
brought concerning the project, not just such claims, actions or proceedings brought
within the time period provided for in applicable State and/or local statutes. The City
shall promptly notify the applicant of any such claim, action or proceeding concerning
the project. The City shall cooperate fully in the defense. Nothing contained in this
condition shall prohibit the City from participating in the defense of any claim, action, or
proceeding, and if the City chooses to do so, applicant shall reimburse City for attorneys'
fees and costs incurred by the City.
