RfSOLUTION RATIFYING MEMORANDUM OF IJNDERSTANDLNG~ EXECUTED. BY THE
DULY AUTHORIZED REPRESENTATIVES OF THE CITY OF'PETALIlMA AND THE
PETALUMA PEACE OFFICERS' ASSOCIATION FOR EMPLOYEES IN UN;IT 6
WHEREAS, the City, through .its du1,y authorized representatives,
and the Petal.uma Peac~e 0:ff-icers' Association through its duly authorized
repres,entatives,~have concluded their mut"ual obligation to meet and confer
in good faith with respect to terms and cond.itions of employment for the
employees in Unit 6, in aceordance with the Meyers-Milias Brown Act and
the City's Employer-Employee Relations Rules and Regulations (Resolution
No. 5512 N.C.S.).; and,
WHEREAS,: the daly authori~zed representatives of the City and
the Petaluma Peace~.0'fficers' Association, have executed a Memorandum of
Understanding (dated November 1, 1'983~) pursuan,t to Section 15, Resolu-
tion No. 5512 N.G.S-. an'd recommend its approval by the City Council; and,
4JHEREAS, -the City Manager,''pursuan.t to Section 28, City of
Petaluma City Charter, and as the City,'s Municipal EmployEes Relations
Officer (Resolut.ion No..5375 N.C.S.) is requ~ired "and empowered to make
a recommendation to the City Council on matters related to employees'
compensation; and,
WHEREAS, the City Manager, has reviewed and concurs with said
Memorandum of Understanding for Unit 6, and does recommend that the City
Council ratify said Memorandum of Understanding.
NOW;.THEREFORE, Bf IT RESOLI/ED that said Memorandum of
Understanding, being i.n the best inte;rest of the City, is ratified and
the terms and cond:i~tions of said Miemorandum of Understanding (as attached)
shall be effective November 1, ]983 throagh June 30, 1985.

This document.represents the final and complete agreement resulting
from Mee~t and Confer sessions between t'h,e ~City of Petaluma and the
Petaluma Peace Officers' Assoc'iation, Unit 6..
Representatives o:f the City and Unit:6 acknowledge that they have
fulfi'lled their mutual and respect"i~e o;bligations to Meet and Confer
under the Meyers-Milias-Brown Act. As a result, the parties have
come to a mutual understanding whi.ch the`representatives of the Cit,y
and Unit 6, who have the approval of their members, agree to recor~nend
for acceptanc~ and approval of the City Council of the~City of Petaluma.
The parties affix their sig:natures as constituting mutual acceptance
and recommendation of this Memorandum of Understanding to commence the
day following approval by the City Council.
Section l. Term of Agreement
This Memorandum of U'nderstanding shall commence NoVember 1, 1983, and
shall continue through June 3Q, 1985..
Section 2. Servability
The part.ies~will commenc,e meeti:ng and conferring for 1985-86 fiscal year,
not later than the end of April 1985, and will endeavor to reach an
agreement, i`n a written Memorandum of Understanding for submission to the
City Council for its deter,mina,tion, prior to the adoption by the City of
its Final Budget for the subsequent Fiscal Year.
Section 3. Workweek
A work week shall consist of forty (40) hours worked in one week, based
upon a fifty-two (52) week year. An on-duty wo,rk day may consist of
eight (8) hours per day i:n each of five (5) 24-hour days, or ten (10)
hours per day in each of four (4) 24-hour days. The 6ity solely determines

for example, scheduling, rescheduling, shi'fts, watches, assignments,
holidays and other matters re:lated thereto.

Section 5. O~ertime
The City shall compensa.te each er*ip.loyee governed by this memorandum
at the rate of time and one-half for approved overtime. (Off duty
training ti°me conducted "in-house" shall. be compensated as overtime.)
An employee may receive overtime in the form of comperrsahle time off
in accordance with a'pproved policy. Time and one-haTf sha11 not apply
to off duty court time. Overtime of fifteen minutes shall be paid to
the nearest quarter hour.
Section 6. Court Time Payments
The City will, compensate a minimum of t~~o (2) hours at time and one-half
for each officer for c:ourt appearances on h.is own time; additionally,
time and one-half (1-1/2) shall be comPensated fo;r all hours actually
worked in court beyond such two (2) hours.
An employee receiving fu.l'1 salary while not worki'~ng, pnrsuant to Labor
Code Section 4850, sha11 not be granted further. compensation for court
time unless this eourt:ti'me (including all related professional activities)
exceed the number of hours in the regular work day (eight (8) or ten (10),
depending uPon his or fier schedule) in one day or 40 ~hours in one week;
if such court ti'me and related professional activit-ies exceed eight (8)
or ten (T0) hours in one day (whichever is applicable or 40 hours in one
week) the employee shall be compensated for such addi°tional time at the
applicable overtime rate.

When a Poliee Officer is.assigned to pe:rform the duties of a Sergeant for
a period of four (4) hours or more by ~the Chief of Rolice or a Cientenant
or the Watch Sergeant of the.preceeding s'hift when the Chief or Lieutenant
is not on duty, he sha1T be pai~d at~S,tep, I of the Sergeant salary ciassifi-
cation. If the Wa`tc.h Sergeant of t:he preceeding shift, the Chief, or
Lieutenant is unavailable,due to urnforeseen circumstances and it is
necessary for an officer to perform the func.tions of a Sergeant, the
Ghief or Lieutenant may grant s:ubsequent a'pproval during his next normal
work shift.
Any o.vertime performed by a Police Officer while he:or she is entitled
to pay at the Ser.geant rate, shal.l be compens'ated at one and one-half
(1-1/2) times the applicable Sergeant rate of pay.
Section 9. F'reld Traininq 0fficer
Police Offi`cers who are designated Field Training Off`icers sha11 receive SX
above their normal ,salary for any pay period in which they spend at least
40 compensable working hours field training a new police officer assigned
to them. ~
Section 10. Communications Dispatcher-Clerk Trainin
Any Cominunications Dispa,tcher-Clerk who is assi'gned to train a newly
hired Communieations Dispa~tcher-Clerk shall be paid 5% above his/her
regular salary rate, based o,n all hours spent perfo.rming such
training, not to exceed twelve (12) calendar weeks-per Trainee.
Section 11. Sergeant Promotions
Upon promotion to Sergeant, Police Officers' in Step V of the salary scale
shall be placed in Step II,of the Sergeant salary scale.
All other Officers promoted to Sergeant sha1T be placed in Step I of the
Sergeant salary scale.
Sect'ion 12. Compensatorv.'Time Off
An employee may receive, in lieu of being pa°id'for overtime, compensatory
time off at~a mutually agreeable time between the City and the employee.
Suc~h; compensa°tory time off may be accrued; up. to a ma:ximum of thirty (30)
hours for those emp:loyees i~n sworn classificat;ions and twenty-fou,r (24)
hours for those employees in non-sworn classi;"fica.tions. Amounts earned
in excess of that wil] be;paid. Such compensatory time off shall be
used for personal activities only.
Compensa.tory t-i;me sha11 not accrue when an emp]'oyee is assigned to work
for any other employee who-i5 taking compensatory time off.
Section 13. ~Polic:e.Edu'cation Incentive Pay Proqram
A. This Program encou~rages employees in sperific classifications to
acquire and to maintain educational achievement.
B. Ed"ucati~on,al incenti~ve pay is provided for qualified employees in the
c1assification and for the amount as specified below:

3. An employee who reaches, for ~the f-irst t,ime, salary Step III of
his/her classification, and who ha~s an Intermediate P.O.S.7.
Certifi'ca,te qr Advanced P.O.S.T. Certi:ficate, sha11 qualify to
receive incentive pay commencing with the next full pay period.
Section 14. Uniform/Clothi~nc~. Allowance Program:
A.11 emp~oyees sha11 comply with the uniform/'clothin9 reguirements and
procedures as establish,ed and administered by the Police Chief.
The llniform/Clothing A`1'lowance Program s:ha.ll be paid for the term of
th.is Memorandum with full annual amount to be paid in December of each
year, us~ng the employee's salary rate as effective on July 1 of that year.
A. The amount of 1-l/2% of the annual salary of the top step Police
Officer per year for the classifications of Police Officer, Police
Officer (Investigator), Youth Service Officer, Police Sergeant and
Police Sergeant (Investigator).
6. The ar~ount of 1-1/4q of the annual salary of the top step Animal Control
Officer per year fo'r the classifications of Parking Enforcement Officer,
Animal Control Officer, Assistant Animal Control Officer, Community
Service Officer and Property Technician.
Employees hired on or after July l, and.prior to December 1, of each
fiscal year shall be paid a full annual payment amount on or before December 5,
of that.year. Employees hired on or after December 1, and prior to June 30,
of the fiscal year, shall be paid the full annual payment amount on or
before July of the following fiscal year..
An employee who terminates from City servi!ce,or is released from City service
shall only recei've a prorata annuaT amo:unt:~ An~employee who sq sepa:rates
from City service after any payment has been made shall return tha:t portion
of the allowance determined•by the last day in City service and the end of
the fiscal year. Any employee on leave of absenee 'without pay or leave
status i:n excess of thirty (30) calendar days shall recei~e a prorata amount
for the fiscal year.
Section 15. Health Insurance
A. The Ci,ty shall. pay,, during the term of this Memorandum of Understanding
the followi~n;g; insurance premium amounts towards the medical-hosPita]
insurance coverage programs provided by the City of Peta]uma.

Effective July 1, 1984
In the event that health insurance premiums are increased under any of
the above medical-hosp'ital insurance coverage programs, the City shall
pay 80% of the increase and the Association members shall pay 20~ of
the increase.
Section 16. Dental Insurance
The City shall pay, duri_ng the term of this Memorandum of Understanding,
$35.56 per employee per month toward the City grou'p dental insurance
coverage program. The City agrees to pay 100q of the premium increase
for fiscal year 1984-85.
Section 17. Life Insurance
The City shaTl provid'e, a;t no cost to the employee, group term life
insurance coverage in the principal amount of $7,500 per employee.
Section 18. Long Term Disability Insurance
The City shall pay effecti-ve November 1, ]:y83, the monthly premium for the
PORAC Long Term Disability Plan for all Police Officers and Sergeants;
provided, howeye:r, that th"e total amount paid 6y the City in connection
with LTD shall not exceed $21.20 Per month for any employee. Effective
July 1, 1984, this amount shall not exceed $25.60.
During the term of this Memorandum of Understanding, the City will pay
$13.OQ Per month toward Long Term Disabi7it'y cover,-age for non-sworn
personnel in Unit 6.

Section 20. Holid;ay-, Floatinq
The City will provide one (l) "Floating Holiday" of eight (8) hours
per emRloye~, per fiscal year for employees assigned to work eight (8)
hours per day, which may be taken by the employee at a time mutually
agreed upon by the employee and the Poliee Chief, consistent with
operational. need~.
The Gity will provide one (l) °Floatin9 Holiday" of ten (10) ten
hours per employee Per fiscal year for employees assigned to work
ten (10) hours per day, which may be taken by the employee at a time
mutually agreed upo.n by the employee and the Police Chief consistent
with operational needs.
The appropriate ho~rs, eight (8) or ten (lA) will be determined by the
hours per day being worked at the time the "Floati..ng Holiday" is taken.
Employees hired between July 1 and December 31 of each fiscal year
will be eligible for a Floating Holiday during tfie course of that fiscal
year. Employees hired on or after January l of each year shall not
be eligible for a Floating Holiday during that fiscal year.
Section 2]. Sick Leave
It is understood that the sick leave provisions
ttnderstandi'ng for this unit provides for acc_rual

Leaves af absence up to four working days wi~th pay per fiscal year may
be granted to emp`loyees in the event of s:eri,ous illness or injury in the
employee's immedi`ate family and will be char9ed against sick leave.
The irr~ediate family s_hall cansist of the spouse, cliildren, parents,
brot'hers, sisters, or other individuals whose relationship to the employee
is tha t of a dependent or near dependent. In each case, the appointing
power sh'all grant such sick leave only when in his opinion, the relationship
of the sick or disabled person to the employee warrants such use of
sick leave. ~ _

, I.n the even:t of retirement, an employ,ee who has completed ten (10) y~ars
'o~r more,with the.City shall receive fifty percent (50%) of his
accumulated but unused sick leave, not to exceed 480 hours.
Section 24. Bereavement Leave
Leaves of ab"sence up to three wor'king days with pay per fiscal year
may be granted to employees in the event of de'ath in the employee's
immediate family. The immediate family shall consist of the sPo~aSe,
children, parents, brothers, sisters, or other individual whose
relationship to the employee is that of a legal dependen~.
Section 25. Retirement
The City of Petaluma agrees to maintain its current Public Employee
Retirement System to provide the 2% at 55 program and all other options
currently in effect for sworn officers.
Section 26. Vacation
All regular employees of the City of Fetaluma, after working one full
year, are entitled to the eguivalent of eighty (80) hours of vacation
with pay in the y,ear following the year in which the vacation is earned.
All regular employees of the City of PetaTuma, after. five (5) years of
continuous.emplo.y,men.t with the City, and tieginni.ng with the sixth years
shall be entitled to.the equivalent of one hundred twenty (120) hours
of vacation per year.
After ten (10) years of conti-nuous service, eight ($) additional hours
of vacati,on shall be added for each additional year of continuous service
to a maximum of 160 hours of vacation.
Vacation accumulated in excess of two years will be lost.
The parties affix their si9natures as constituting mutual acceptance and
recommendation of this Memorandum of Understanding to become effective upon
