APARTiv1ENTS FRATES ROAD AND ELY BOULEVARD WHEREAS, by Ordinance No. ' 1564 N.C.S., Assessor's Parcel No. 17-040-12 was r.ezoned to R.U.D., (Planned 'Unit Development); and, WHEREAS, by acfion `taken on September 27, 1983, the Planning Commission recommended adop,tion of the final unit dev.elopment plan in saici Planned Unit District: NOW, THEREFORE:, BE IT RESOLVED that the final unit development plan on file in the Office of Community Development and Planning is hereby approved pursuant to Section 19 A-504 of Zoning Ordinance No. 1072 N. C. S. , as amended; and, BE IT FURTHER RESOLVED that the City Council hereby adopts the findings of the Planning Commission as its findings as stated hereinafter: FTNTITNC:.S 1. Said .plan clearly results in a more desirable use of land and a better physical environment than would be possible under any single zoning distric"t or combination of districts. 2. That the Pl'anned Unit District is proposed on property which has a;suitable relationship to one (1) or more thorough- fares; and fhat said thorough_fares are adequate to carry any additional traffic generated by the development. 3. That the plan for the proposed development presents a unified and organized arrangement of the buildings and service facilities which are appropriate in reTation to adjacent or nearby properties and tha,t, adequate landscaping and/or screening is included if necessary to insure compatibility. 4. That the natural and scenic 'qualities of the site are protecfed with adequate available public and private spaces designated on the Unit Development Plan.. 5. That the development of the subject property, in the manner proposed by the applican•t, will. not be detrimental to the public welfare, will be iiz the best interests of the City and w'ill~ be in keeping with ,the: general intent and spirit of the zoning regulations of the City of Petaluma, with the Petaluma General~ Plan, and with any :applicabTe Environmental Design Plaiis adopted by the City. The requirements outlined in the Fire Marshal's September 9, 1983, memo: A., Fire hydrant shall be installed on a 300 foot spacing. B. Access driveways sha11 conform to Fire Department ~ specifications, C. Roof covering shall be fire retardant. D. Access and water sha11 be provided for fire protection during construction period,. E. Approved fire alarm systems shall be- installed. Annunciator panel shall be located as required by Fire Department .response routes. ~ F. Submit 82" x 11" site drawirig to Fire Marshal's office per Fire Department specifications. 2. ~ All drairi'ag'e impro~ements shall be subject to approval of and be in conformance with the • standards of the Sonoma County Water Agency. 3. A bus pullout ar.ea with minimum dimensions of 10 feet in width and 40 feet in length shall be proVided as part of the arterial street improvements, (Frates Road and Ely Blvd. ) at each .project entrance, to: the satisf'action of the City Trarrsit Coordinator. Bus pullout areas will be required, at the discretion of the City, on the opposite side of the street from those requir.ed above to accommodate bus traffic in the opposite direction. 4. Project design will be modified when necessary to incorporate recommendations from •the Mosquito Abatement District. 5. The project shall be subj.ect to review= by the Site Plan and Architectural Review Committee prior fo issuance of the first building permit. 13. The project developer .:shall execute a biriding agreement, prior to issuanee of first certificate of• occupancy, with the City of Petaluma whieh commits the developer and any future owner(s); of the project to .provision of five percent of the total number of units in . the projeet for rental to very low income households,, and fifteen ;percent of the total number of units in the project for rental to low income households for twenty years. The mix of units .so committed shall match the overall mix (as defin`ed by number'~ of bedrooms) ,in the: overall project. The definition of very :low an`d low income households shall be 50$ and 80 a respectively of the County median income established by the U. S~,. D,epartment Housing and Urban Development annual median i~ncome estimates for Sonoma County. 14. One percent of the units in the project shall be designed specifically for households which include handicapped members . One-third of the handicapped units must accommodate wheelchair bourid ind'ividuals. 15. All units in the project shall be d. esigned to achieve maximum interior noise levels from outside sources of noise of 40 dbA in sleeping areas an~cl 45 dbA in other living areas. 16. The noise mitigation measures s,uggested in. the project EIR shall be implemented, subject to: the discretion of the Community Development and Chief Building Inspector. 17. The project sponsor shali ,develop a:fencing plan to help deter tr.espass by project residents through A.P. Nos. 17=040-8, 13;, 14, 15, 16,. 19 and: 20 by offering to the owners of said properties to construct agricultural type open fencing along the Casa Grande side of the Adobe Creek channel or the rear property line of said parcel's . 18. Additional storage areas shall be developed for use by each individual Type D and E:unitc:;: .:subject to the approval of the 'Gommunity Development arnd Pl'annimg Department~ and SPARC. All onsite improvements, e.. g., paved areas and utilities, shall be subjeet to ap,proval of the City Engineer, Community Develo.pment and P.lanriing Department and Chief Building Inspector. 20. Additional .landscape scr-eening shall be included along the interior property line.s of the project' site to the approval of the Community Development and Planning Department and SPARC . 21. The ranch house area of the project shall be specified on the PUD development plan for potential future development of a day care faciTity. 22 , The developer 'shall execute w~ith the City, prior to issuanee of first bui~leling permit., a binding agreement to participate at the discretion of the City, on a prorated basis; in improv,ements: to or provision of the following traffic. mitigation. measures : - Traffic signals, a~t;c ~ Casa Grande and Ely 'Blvd, Ely Blvd and Frates Road, Frates Road and Adobe, Frates and Lakeville . 23. A clau:se sha1T be added to all rentalXlease agreements which prohibits parking of R. V. s in the project for more than 48 hours. ~ 24. A clause shall be added to all r.erital/lease agreements which clearly states that there are agr.icultural operations in the area and that such operation,s can and do, include objectionable aspects, e.g., spray,ing, manure spreading, etc. 25. The developer shall execute with the C'ity of Petaluma a binding agreement, prior to issuance of first building permit, which guarantees that the project would be main:tai "ned for rental only for a miri'i"mum of 20 years. 26. Struetural setbacks shall be as follows: a. Minimum distance between outside wall of, structure and curb line: of parking area sfiall be 1-3 feet. b. Min'imum distance between out"side wa11 of structure and curb line of inter.ior loop str:eet shall be 15 feet. c. M'iizimum distance 'between rear yard fencing and any structure shall be 8 feet. 27. Any future repair or ,replaeement of structures, fencing, landscaping etc. sha11. be in accordance with the approved PUD plan. 28. All r.ental/lease agreements shall contain language indicating that any home occupations conducted shall be subject to provisions of the Ci:ty of Petaluma zoning ordinance, and approval of the project management. 29. At least 70 per.ce,nt of the units in structures 3-6, 28-33, 3$, 41, 46 and 48-51 shall be 'reoriented similarly to structures 34 and 47 so as not . to back up to property bounciaries or arterial streets. 30. The off street parking rafio shall be increased to a minimum of 2, 2 space.s per- unit with roughly equal distribution of. additional spaees throughout the project. 31. T.he developer shall submit a plan. prior to issuance of first certificate of occupancy for routine street and parking lot cleaning to reduce pollutant Ievels and siltation, subject to review and ap.proval of the City Engineer. 32., Specific recommendat'ions contained 'in the soils report for the project prepared by ENGEO Inc. (1,982) shall be carried out in project design and implementation, subject to approv.al of the City Engineer and Chief Building Inspector. 33. Structures sha11 be designed to meet strong ground shaking from earthquakes, subject .to approv:al of the Chief Building Inspector. 3.4. The energy conservation measures :su.ggested in the project ~ EIR shall, when feasible, be, implemented., subject to the discretion of the Cominunity Development and Planning Director and Chief Building Inspector. 35. The developer shall establis~h and maintain a pr.ogram for recyclin-g newspaper, glass a_nd aluminum. for project residents subject to approval of the Community Development and Planning Department.
