S. of the City of Petaluma, California A RESOLUTION E'STABLISHING POLICIES FOR = EXTENSION OF . WATER SERVICE; FOR DOMESTIC USE OUTS'IDE OF THE GORPORAT-E LIMITS OF THE CITY :OF PETALUMA AND REPEALING RESOLUTION 6617 N.C..S. WHEREAS, the City of Petaluma recognizes the need to provide residential service ,to per.sons currently res'iding outside of the corporate limits of the City but within its Sphere of Influence. In addition, other limited service may be provided at the discretion of the City Council where contamination of groundwater supplies immediately threatens residents health and welfare in areas outside of the City's Sphere of Influence. WHEREA5, by offe policy to: (1) oppose urban premature parcelization and water service as a means of than providing a eonvenience of the corporate limits-; and, ring such opportunities it remains the City's development in unincorporated areas ,( 2) limit development of agricultural lands, (3) offer meeting immediate human health needs rather for future parcelization or development outside WHEREAS, certain areas have been identified as urban service areas on the Cit,y's adopted sphere of influence, wherein the provision of water service for less than~ urban densities is currently provided or will likely be provided, which are not planned as potential annexation areas. NOW, THEREFORE BE IT RESOLVED THAT: I. Applications for outside water seryiee shall be considered and will be approved only when the following circumstances eXist: A. AREP,S WITHTN T~HE AD,OPTED SP.HERE OF TNELUENCE 1,. The -water is to be used: 1)- for dwellirigs in existence on the date of :tliis resolution or 2), for dwelling units ap;proved for construction on parcels created prior to the date of this r.esolution or 3) for proposed land division for residential devel'opment which meets all City Development review standar.ds and does not exceed a density of one (l) dwelling unit per two ( 2) acres . 2. The water main from which service is to be derived is in place across ,tlie full frontage of the parcel(s) requesting service ~or i's; if deemed neeessary by the City Engineer, extended across •the f,izll froritage of said parcel(s) , constructed to standar.ds acceptable to the City of Petaluma and dedicated to the Cit,y for- public use. B. AREAS OUT5IDE OF THE ADOPTED SPHERE OF INFLUENCE 1. A clear health, hazard exists. 2. Need is demonstrated by evidemce of contamination or exhaustion of existing residential supply clearly stated in a letter from County Health Department with documentation by an indepencl.ent laboratory and civil engineer. 3. Service .is to be provided to dwellings in existence on the date of the adoption of this resolution or for dwellings for which building permits have been issued prior to the date of adoption of this resolution . II. Applications for outside water service within the sphere of influence shall be reviewed and conditionaily approVed or denied by the Director of Public Works and the Director of Community Development and Planning in accord with the policies and conditions herein set forth. For areas outside the sphere of influence where a clear residential health hazard exists, requests shall be reviewed on a case-by-case 'basis by the Cit,y Council. III. Every outside water service approval shall be subject to the following conditions and any other conditions the Director of Public Works and Director of Community IDevelopment and Planning deem necessary to protect and promote the interests of the City of Petaluma and which shall be agreed to in writing, by the applicant, prior to approval. 1. For properties within the sphere of influence annexation impact fees, as established by the City Council, shall be paid prior to the installation of the water meter and where it is deemed by the Director of Public Works and Engineering and the Community Development and Planning Director that immediate. annexation is feasible, annexation shall become a conclit'ion of aggroval. ' 2. Any "bootleg° tap to an approved outside water .service line shali cause the discontinuance of service. 3. °`Outside" `rate to be establis'hed by City Council resolution, which reflects the current -ra~te for metered, domestic water service as .per Pe,taluma IVlunicipal Code Section 15.1b.040 and an additional fee for service outside City limits. An agreement shall be executed between the property owner and the City, to ru.n wi;tli the -1and, which commits present and future ,property owners to the construction of, or payment for frontage improuements (i.e., one-half street, curb, gutter, :sid'ewalk, w;ater, lines: for domestic use and fire proteetion;, sewer and storm dr.ainage facilities to City Standards) , at the option of' the City at such time as the property is subdivided, annexed or abutting properties construct similar improvements.. 5. Water service requested for lands lying within the sphere of influence proposed for s:ubdivision must meet City Development Standards per condition #4 above and have direct abutting access to an improved public street designed to meet City Standards. 6. Maximum size service shall be limited to 3/4 inch service. IV. Resolution 6617 NCS regarding outside City limit water connection policy is hereby repealed in its entirety.
