RE50LUTION GRANT:ING CERTAI~N MODIFICATION TO THE
REQUIREMENTS IMPOSED BY THE SUB`DIVISTON ORDINANCE
OF THIS CITY RELATING TO THE FOSTER PARCEL MAP
LOCATED AT 14 LAUREL AVENUE, PETALUMA
WHEREAS, Robert T. Foster has requested certain modifications to the
requirements of the Subdivision Ordinance; and,
WHEREAS, the Planning Commission held a hearing on the 13th day of
September, 1983, on the request for modificatiom, with respect. to Lots 1 and
2 of the proposed Foster Parcel Map, located at 14 Laurel Avenue, Petaluma
eonsisting of the following :
Lot 1: Reduce minimum lot frontage from 65 feet to 45 feet.
Lot 2: (a) Reduce the minimum width of the driveway access
strip for the flag lot from 30 feet to 23 feet; (b)
Increase the maximum length of the flag lot access
strip from 125 feet to 155 feet.
WHEREAS, the Planning Commission has recommended to this Council that
the modifications be approved;
NOW, THEREFORE, BE IT RESOLVED that the modifications above
des'cribed are hereby granted pursuant to the authority of Chapter 20.40 of
the Petaluma Municipal Code; and,
BE IT FURTHER RESOLVED that the Council finds:
1. That there are special circumstances or conditions affecting said
property;
2. That the modification was necessary for the preservation and
enjoyment of a substantial property right of the. petitioner;

3. That the granting of the modification will not be detrimental to the
- public welfare or safety, or injurious to, other -property, in the territory in
which said property is situated.
4. The modification herein granted substan,tially carries out the
objective of the subdivision requirements as to light, air and public health,
safety, convenience and general welfare.
5. The modification constitutes a minor alteration in land use limitations
and is exempt from the California Environmental Quality Act under Section
15105 of its guidelines.
