DERING THE ANNEXATION OF CERTAIN TERRITORY INTO THE CITY OF PETALUMA AND MAKING REQUIRED FINDINGS (LACUMBRE ANNEXATION) WHEREAS, a request for the proposed annexation of certain territory to the City has been considered by the City Council: and was forwarded to LAFCO by Council Resolution No. 9631 N . C . S . ; and WHEREAS, the proposed annexation has been submitted to LAFCO in the manner prescribed by law and LAFCO has consented to said annexation; and WHEREAS, the City Council has held a public hearing as required by law, considered written protests, and has considered all required and relevant information pertaining to said annexation at the hearing on July 18, 1983; and, WHEREAS, said annexation is in compliance with LAFCO Resolution No. 798, dated April 14, 1983; and, WHEREAS., the City Council finds that written protest representing 7.47 percent of the value of the annexation area was filed and not withdrawn; and, WHEREAS, the City Council finds that a majority protest as defined in Government Code Section 35225 has therefore not been filed. ~` Reso. 9852 NCS Page 1 of 5 NOW, THEREFORE, BE IT RESOLVED: 1. The City Council hereby •` orders ~ the ~ annexation of certain property to the City .of Petaluma, .more particularly °d'eseribed as. follows: '~ • As fully.set• forth on the attached ..Exhibit - subject to the following condition: When and if an access road connecting the :proposed annexation area with Western Avenue is' constructed, the City shall acquire such road and 500 feet of Western Avenue in each direction from its inter- section with such road pursuant to Section 1810 of the California Streets and Highways Code. 2. And directs the City Clerk to'carry out provisions of Government Code Section 353'50. Under .the power and auEhority conferred upon this Council by the: :Charter of„said City.
