Resolution No. 9598 N. C..S.
of the City of Fe#aluma, California
ADOPTING AN AMENDMENT TO T,HE GENERAL PLAN/
EDP/LAND USE ELEMENT TO DESIGNATE
LAKEVILLE SQUARE APARTMENTS RESIDEN'PIAL URBAN MEDIUM DENSITY
(FRATES ROAD :ELY BOULEVARD SOUTH (AP 17-040-12)
WHEREAS, the City Planning Commission has reviewed a proposed
amendment to the General Plan and its Environmental Design Plan Land Use
Element and ..has held a hearing thereon and after , said ,hearing finds the,
proposed amendment should be adopted; and,
WHEREAS, the City ,Planning Commission ,filed with ''the City Clerk its
report as set forth in' its minutes of. August 9, 1983 (File 8.84) ,
recommending adoption ~'of said proposed amendment to the 'General Plan and
its Environmental Design Plan Land Use Element;- and,
WHEREAS, the City Council has reviewed- 'the proposed amendment to the
General Plan and. its .Environmental Design Plan Element, consistent. with the
Planning. Commission's recommendations ;and ~ has held; - a hearing thereon on
September 6, 1983 .and after said hearing finds that adoption of the proposed
amendment of the property located at A.P. No. 17-040-12 from Planned
Residential (7 units /acre) to. Residential Urban Medium Density (15 units /acre.)
is in keeping with fhe public necessity, convenience and general. welfare of
the City; and,
WHEREAS, an Environmental Impact Report prepared for this project and
certified and approved. by the City Council on September 6, 1983 identified
certain mitigable significant impacts as noted in the Final Lakeville Square
.Apartments .Environmental 'Impact Report; and,
WHEREAS, the California Environmental Quality Act requires adoption of
certain findings when a project with significant impacts is approved by a
public ag-ency; and,
WHEREAS, the City Council hereby finds- that changes or alterations
have.. been :or will be incorporated into -the project design which avoid or
substantial°ly .lessen the significant environmental, effects as identified in the
Final- Environmental Impact Report; and,
WHEREAS, the mitigation measures described in the Final Environmental
Impact Report provide the rationale for the above .finding; and,

WHEREAS, an Environmen al Impac"t Report prepared for this project and
certified and approved by the. City Council on September 6, 1983 identified
certain unavoidable. and irreversible adverse impacts; and,
WHEREAS, the California Environmental Quality Act requires adoption of
a statement of overriding consideration when a project is approved by a
public agency, without mitigation of said impacts; and,
WHEREAS, the City Council hereby finds. that there are overriding
considerations regarding. said impacts and adopts a, statement of overriding
consideration contained herein which addresses said impacts; and,
STATEMENT O;F OVERRIDING CONSIDERATIONS
The following unavoidable irreversible adverse
impacts will occur as a resolut of approval of the
Lakeville Square Apartments project:
1. Conversion of approximately 32 .$ acres of
productive agricultural land to non_agricultural
uses.
2. Density increases near the ~ur-ban separator
which would be in conflict. "with General
Plan/Environmental Design Plan urban
separator policies .
The City Council is willing to accept the above
stated unawoidable,~ irreversible impacts for the
following reasons
1. The project will provide. additional housing
required to accommodate future planned
growth.
2. The project will provide much-needed rental
housing and housing for aow andmoderate
income households.
3. The project will help meet the Housing ,Element
goal of providing a range of housing types for
all. economic segments.
WHEREAS, the California Environmental Quality Act requires findings and
a statement of facts regarding significant effects to be made by any public

agency which approves a project for wliich an Environmental Impact Report
was prepared; and, -
WHEREAS, said findings and statement of facts are included herein
adopted as Listed below: -
The significant effects which„ have been
identified in the- Lakeville Square Apartments
Project Environmental Impact Report and which are
attributable to the proposed General Plan
Environmental Design. Plan Amendment include:
1. Expansion of the developed urban
(non-agricultural) area of the City of Petaluma by
approximately 32.$ acres.
2. Density increases near the urban. separator in
conflict with General Plan/Environmental Design Plan
urban separator policies.
With regard to the above significant effects the
City Council hereby finds that .special. economic and
social considerations make infeasible the mitigation
measures or project alaternatves identified in the
Final Environmental Impact Report.
The facts supporting the above finding are as
follows
1. Expansion of the developed urban area of the
City of Petaluma would also occur with development
of the site under the current residential
deevelopment plan already approved ~ the City .
2. The .project will provide additional housing to
accommodate a larger proportion of future planned
.growth than the previously approved project
thereby reducing the need to develop additional
acreage.

3. The project will provide, rental. Housing to low

NOW, THEREFORE., BE IT RESOLVED. tha`t..the proposed amendment 'to
- the General Plan and its Environmental Design Plan Land Use Element is
- hereby adopted and is hereby ordered incorporated in the General
Plan/Environmental Design .Plan Land Use Element '500 scale' and '2000 scale'
maps on file in the Office of the Community Development and Planning
Department .
