S. of the City of Petaluma, California : RESOLUTION RATIFYING MEMORANDUM OF UNDERSTANDING EXECUTED B'Y THE .DULY AUTHO'RIZ'ED REPRESENTATIVES OF THE CITY OF PETALUMA AND T.HE :INTERNA'TIONAL - -_ - ASSOCIATION OF FIRE FIGHTERS, LOCAL 1415 ~~ FOR EMPLOYEES IN UNIT 7. WHEREAS, the City, through .its duly authorized representatives, and the Inter-national Association of Fire Fighters,. Local 1415, through its duly authorized .representatives, have concluded. their mutual obligation to meet and confer in good -faith with respect to terms and conditions of employment for employees in Unit 7, in accordance with the Meyers-Milias- • Brown Act and the Ci-ty's Employer-Employee Relations Rules and Regulations (.Resolution No. 55.12 N.. C . S .) ; and, WHEREAS, the .duly authorized representatives of the City and - International Association of Fire Fighters, Local. 1415. have executed a Memorandum of Understanding (dated June 27, 1983.) .pursuant to Section 15, Resolution No. 5512 N, C . S. and recommend 'ts approval by the City Council; and, WHEREAS, the City .Manager, pursuant to Section 28, City of Petaluma City Charter, and as the City's Municipal Employees' Relations Officer (Resolution. No. 5375 N.C.S.) is required and empowered to make a recommendation to the City Council on matters related to employees' compensation; and, WHEREAS, the City Manager has reviewed anal concurs with said Memorandum of Understanding for Unit 7 and does recommend that the City Council ratify said Memorandum of Understanding. Representatives of the City and Unit 7 acknowledge that they have fulfilled their mutual and respective obligation to Meet and Confer under the Meyer-MiTias--Brown Act, As a result, the-parties have come to a mutual understanding which the repre en'aatives of the,City and Unit. 7, who have the approval of their members, agree to recommend for acceptance and approval to the City Council of the City of Petaluma. The parties affix 'thei'r signatures as cons ituti`;ng mutual .acceptance and recommendation of thi s-. Memorandum of` Understanding to' become effective. July 1, 1983., upon acce;ptanc:e and approval of the City Council. Section 1. Term of Agreement Thies Memorandum of Understa~nd.ing shall be fo;r..a one (1) year term for this fiscal year commencing July 1, 1'98.3,. through June. 30, 1984. The parties will commence meeting and conferring for 1984-85 fiscal year not later than the end of April,. 1984, and wi'T1 endeavor to reach an agreement, in .a written Memorandum of Understanding for submission to the City .Council for its Final Budget for the subsequent fiscal year. Section 2. Work'Week Duty Shifts: ~. . The fire on-duty 7 day work week shall be t'he average of 56.0 hours per fire. on-duty 7 day work week for all employees~in this Unit. Section 3. Livin4 Restriction The living restrict-ion for members of the City of Retaluma Fire Departmen shall be twenty (2:0) minutes. A map wi11''be prepared and made available which illustrates the. extremities of the restriction. The Association shall meet with the Fire Chief to discuss. extending the living restriction to thirty (30) minutes and if agreement is reached`sha11 be effective the date that the Fire Chief shall present a written memorandum to the City Manager and it is approved by the City Manager. Sal ary The monthly salaries of employees in this Unit in the various steps shall be as follows: Fire Captain $1987 $2086 $2190 Firefighter $1557 $1634 $1716 $1802 $189:2 Firefig,'hter/Paramedic $1557 $1.634 $1716 $1802. $1892 Section :5. Overtime The purpo e of this section is to clarify matters relevant to Fire Department overtime. Any `nt_erpre.tation or application relevant to overtime shall be resolved by fhe City Manage,r,~whose determination is final. All requirements and any procedures relating~tb ov.erti.me as basically outlined bel'`ow shall ~be a-s determ ne'd and admi~ni stered by `the City. A. Shift The members of the Fire Departmen ,when called to work an overtime shift, s;hafil be paid on an hour for hour basis rounded to the nea'reSt quarter hour at tfieregular shift rate: times.l',5. An..overti:me shift is defined as any continuous period'of on-Qu y time exceeding sixteen.(16) consecutive houra which is not part. of fhe. emp°loyee's regular .work schedule;, This rate shall be figured on the regular number of hours worked per week as p;er the following formula. 1. ~1onth~ly salary times twelve month's equals annual salary.. 2. An employee who is :assigned to suc-h call-back. duty shall receive, at minimum, six hours pay at this rate at time and one-half. C..Fire Recall and Special Recall Off-duty 'Fi're Department personnel and personnel required to work past. the end- of a shift are subject to recall and will be paid.on an overtime'bass, (except as set forth in "A" and "B" ~, above), at time and one-half and. hourly rate based upon th2 56 hour work 'Hieek. However, in no case will they be paid less than one hour when called. further,. when the complete recall exceeds one hour, bat does not extend 'beyond fi"fteen minutes past the hour., the overtime will be for one hour. l-Jhen a recall exceeds. one hour ,and fifteen . m.nutes,, the overtime will be to the nearest half hour (example, one and one-half hour). Any and-all pr"ior practices, procedures, resolutions or under tandings are hereby supers.ed'ed and repealed. Sectoa.6.. _Out of Grade Pay A Firefighter or Cap ain will be compensated for working at the next fig'her grade upon complet",on of three (3) duty assignment shiffs a~t that next higher grade. Every assigned shift thereafter will be compensated at that -2- ~~' nex.t higher grade at an additional 5% over the Firefighter or ,Captain regular rate o:f pay; as 1`ong as the individual ma'inta~ns continuity . on an acting list. Section 7. Uniform Allowance All employees shall comply with the uniform/clothing requirements and procedures as established and administered by the Fire Chief. The Uniform/Cl~othi:ng Al;lo,wance Program sha°1T 'be paid, in fiscal year 1983- 84, on or before September 5 1.983, for those employees in the classi- fication of Fi`ref'ghter.and Fire.Capta~i'n in the amount of 1% times the annual rate of pay of 'a Step V Firefighter, per year. This. shall be paid on a separate check from the: payroll cheek. Employees hired on or after August 3-l; 1983,, and prior to July 1, 1934, shall be paid the full annual .payment amount on ar before July 5, 1.984. An employee who terminates from City service or is rel~ea`sed from City service shah only receive a pro rata annual amount. An empl°oyee who so separates from City service aftew any payment has been made shall return that portion of the a1lo.warrce determined by the,las.t day in City service and the end of fhe fi'~scaT,year. Any employee on lea e of absence without pay or leave status in excess of thirty (30) calendar days shall receive a pro rata amount for 'fhe fiscal year. Section 8. Health dnsurance The City shall provide for a group medical-hospital insurance coverage program fo'r City employees n-this un'i.t. The City shall pay, during 1982-83, the following insurance premium amounts toward the following medical-hospital insurance coverage programs: Sonoma County .Health. Plan: Health Plan of the'. Redwoods a'nd Kaiser. This amount shall not exceed, however, the total cost of the medical-hospital premiums. Dental Lnsurance The City shall provide for a group dental insurance program for City employees and dependents in this unit. The City shall' pay; during 1983- 84, th.e insurance premium in the amount. of $35..56 per employee, per month. Section. 10. Life Insurance The City sihal provide,~at no cos to-the employee, group term life insurance coverage -in the principal amount of $7,500 per employee. Section ll. Long Term Disability Insurance The City shall pay during fiscal year 1983-84, the amount of $'15.00 per month, per employee.. This amount shall not exceed, however, the total cost of fhe premiwm 'for the long term disability insurance plan. - 3 - Section l2, Holidays, General The ho:Tdays for fhe calendar year shall be' the total of ten, (10); the City, shall pay fo,r these holidays, in °the month of December, i'n lieu of giving time off. Section l'3. Sick Leave, ..:Accrual Sick leave for the fire Department shall be accumulafed on the basis of shifts withshfts° equaling twelve (T2) days o,f sick leave. to be accumulated per year on the basis of 11.2 hours per month. Fire Department 4D hour employees shall accumulate sick leave as other employees of the City. Section 14. Sic-k Leave;; 'Tamil Leaves of absence up o four working: days..wi ~h pay per year may be granted to empl"oyees ~~n the event of serious illness or injury i'n the empl'oyee's immed'ia'te family and will be charged' against sick leave.. The immediate family shall consist of the spouse, children, parents, brothers, sisters`, or other individuals whose relation hip to the employee is that of a dependent or near dependent. In each case., the appointing power shall grant such ic.k leave only when in his opin'ion' the relationship of the sick or disabled person to the employee warrants such use of sick leave. .Section 15. Sick Leave, Retirement In the event of r.e-tinement an employee who has completed ten (10) years or more with the City shal`1 receive fifty percent (50%) of his accumulated but unused sick leave but not to exceed. 672 Hours. Service Vacati on After completion of twelve months 5 shifts per year After compl.eti:on of five years 7 shifts per year After compl>eti~on of ten years 8 shifts per year After completion of fifteen years 9 shifts per year Vacation entitlement accumulated in excess of two years will be lost. -4- .-.., _ Any eligible employee with the consent of the head of his department and the Personnel Officer may defer 2.5 shifts of his annual vacation to the succeeding calendar year, subject to the other provisions of this rule. A written report of each deferred Vacation signed by the appropriate department head and the Personnel Officer noting the details shall be kept on file with the Personnel Officer. The times during the calendar year in which an employee may take his vacation-shall be determined by the department head with dine respect for the wishes of the employee and particular regard for the needs of the service. If~ the requirements of the service are such that an employee cannot take part or all of his annual vacation in a particular calendar year, such vacation shall be taken during the following calendar year. New employees shall. be allowed to use their accumulated vacation prior to December 31st for vacation in the succeeding calendar year. Section 19. Retirement ' The City will implement its contract with PERS to provide the 2% at 55 Retirement Plan without changing the current benefits. .Section 20. Education The City sha ll reimburse employees of this unit for books and tuition upon the satisfactory completion of the course. To be eligible .for reimbursement, the course must be (a) Fire service ralated, (b) approved by the Chief, and~(c) completed at a Junior College or Indian Valley College. Section 21.~ PERS Actuarial Study The City agrees to pay for an actuarial study during 1983-84 for the purpose of evaluating the 20%,@ :50 PERS plan and the widow's. clause Section 21263. This study shall be completed by April of 1984. Section 22. Job Classification Study The City agrees to jointly study the establishment o.f a job classification during FY 1983-84, to determine the duties of those firefighters and firefighter/paramedics assigned to function as apparatus operators, with the establishment of a classification by January 1984.
